HomeMy WebLinkAbout20110110.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000057 AGAINST JOEL GARCIA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Joel Garcia, ZCV #1000057, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of January, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Joel Garcia was not present; however, Ramon Macias was present to represent said property owner at said hearing, and WHEREAS, after hearing the testimony and statements provided, the Board deems it advisable to refer the matter back to the Department of Planning Services. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV#1000057 be, and hereby is, referred back to the Department of Planning Services. Michelle said he was missing his Certificate of Conveyances. He submitted a building permit to convert the shed back to a shed (from a dwelling unit). He told her he removed 2 of the mobile homes to new properties. He will provide Michelle with the new addresses. 06/22/2010 Application received SE-1179(Kim Ogle) referral completed. 06/22/2010 Application received RE-5037 (Kim Ogle) referral completed. 08/03/2010 Other RE-5037 conditionally approved by Kim Ogle 08/03/2010 Other SE-1179 was conditionally approved by Kim Ogle. 11/17/2010 Office visit Joe Gutierrez(ZCV10-00123) came to the Greeley Planning Office with Joel Garcia (although staff believes this was not actually Joel, but Armondo or something). First we discussed Joel Garcia's case. The guy indicated through Joe (interpreter)that the mobile homes have been removed. He indicated he had a little more miscellaneous debris to clean up, but most of that was already cleaned off too. I had Kim Ogle come up and explain all of the outstanding issues prior to recording RE-5037 and SE-1179. I advised them that I would schedule both cases for January 11, 2011. If the properties were brought into compliance prior, the hearing would cancel. If not, they would need to attend the hearing to request any additional time. 12/06/2010 Certified receipt Certified Receipt received- Signed. 12/28/2010 Office visit Joe Gutierrez(ZCV10-00123) and another gentleman came to the Greeley Planning Office again. They had received a letter from Peggy advising that their building permit had expired. They kept saying we discussed that the last time they were in the office. I explained I did not discuss anything about building permits. Peggy and I do two completely different enforcement jobs. He said that I granted them until January 11, 2011. I said I scheduled the hearing for January 11, 2011 for them to come into compliance with all the zoning issues, which means they have to meet all the conditions of approval for RE-5037 and SE-1179 and have both plats recorded. I explained that is why I had them talk to Kim Ogle.
