HomeMy WebLinkAbout771155.tiff Sal _ 4 RECORD OF PROCEEDINGS 100 Leaves MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY , COLORADO June 6 , 1977 Tape # 77- 56 & 57 The Board of County Commissioners of Weld County , Colorado , met in regular session in full conformity with the law and by-laws of said Board at the regular place of meeting in the Weld County Centennial Center , Greeley , Colorado , on Monday , June 6 , 1977 , at the hour of 9 : 00 A . M . ROLL CALL : The meeting was called to order by the Chairman and on roll call the following members were present , constituting a quorum of the members thereof : Chairman , June K . Steinmark Commissioner , Victor L , Jacobucci , Pro Tem Commissioner , Norman Carlson Commissioner , Ed Dunbar Commissioner , Leonard Roe Also present : Acting Clerk to the Board , Jeannette Ordway County Attorney , Thomas 0 , David Director of Engineering Services , Ca Frank Smith Purchasing Director , Bette Rhoden MINUTES APPROVED : The Board approved the minutes of the Board of County Commissioners ' meeting of June 1 , 1977 . A motion was made and seconded . Motion carried ADDITIONS TO AGENDA : The Chairman included on the agenda , hand written warrants after the County Engineer ' s presentation ; policy regarding the retention of County owned mineral rights , item #8 under New Business ; and the resignation letter of a department head , item #9 under New Business . APPOINTMENTS , HEARINGS , REPORTS AND COMMUNICATIONS : The Board approved those listed on the agenda with the following additions : Commissioner Coordinator Reports - Commissioner Carlson informed the Board that Elmer "Bud" Reynolds , Communications Director , will be on vacation this week and . that a l l is going well in that Department . Commissioner Jacobucci reported that approximatley 20 miles of chip and seal has • been completed . He added that the Road Crews are preparing 64th Avenue for oiling . Commissioner Jacobucci commented on the rock crusher ' s production and down time , He. noted that the patching process will resume this week . Commissioner Roe reported that he had met with the Legislators last week to discuss the Social Service foster care situation and the possible future cost to the County of $ 1 , 200 . 00 per month for the care of said youngsters , Commissioner Dunbar noted that there are three meetings scheduled for the Planning Department for this week . he elaborated on the development of the Ault Land Use Plano Commissioner Dunbar reported that C . Richard McCoy , prospective purchaser of the old County Nursing Nome , apparently did not come to Greeley last week so they were unable to meet with him , Coissioner Dunbar reminded the Board that the insurance has lapsed on the old nursing home . The Chairman suggested that the Court Attorney be Instructed to send a letter to Mr , McCoy regarding this matter . Terworary Insurance was also discussed . • . / / 5D Chairman Steimmark :announced that due to numerous questions regarding the purchase of the motorgraders and the anticipated purchase of the rock crusher, she has prepared an explanation of the Intragovernmental Fund. The Chairman read the report into the record. Northgle.nn FRICO Water Project presentation, Richard Lundahl, Project Director - The Chairman announced that said presentation will be wade directly after this Board Meeting. Petition to vacate alley, Cill, Colorado — The Chairman reviewed said petition. She then asked that a copy of said petition be sent to the County Engineer for his review. • REQUEST TO OPEN PORTION OF COUNTY ROAD 33: Commissioner Roe referred to the legal opinion, regarding this matter, that had been prepared by Assistant County Attorney, P. Kay Norton. The opinion recommended that the procedure outlined in said opinion he used for the opening of a county road and/or the vacation of a county road. Commissioner Roe made a motion that the County Engineer survey the proposed County Road 33 and make a written report to the Board. Commissioner Jacobucci seconded the motion and it carried unanimously. SECOND READING, ORDINANCE #9, AMENDMENTS TO INDIVIDUAL SEWAGE DISPOSAL SYSTEMS REGULATIONS: The County Attorney read the proposed ordinance into the record. Commissioner Dunbar made a motion that the second reading of the proposed ordinance be approved and that the publication of the second reading be authorized. Commissioner Carlson seconded the motion and it carried unanimously. CANCEL PUBLIC WELFARE WARRANTS FOR THE MONTH OF APRIL, 1977: The Chairman read the resolution into the record. Commissioner Dunbar made a motion to cancel said warrants totaling • $12,613.00. Commissioner Roe seconded the motion and it carried unanimously. NELSON, HALEY, PATTERSON AND QUIRK REQUEST FOR FULL TIME PROJECT REPRESENTATION: The contract for administration services was discussed Ly the Board. The costs beyond 1976 were not established at the time of the original contract because the project schedule was uncertain and it was impossible to predict salary rates. Therefore, a request has been made that the monthly fee for Full Time Project Representation be approved at $1,625 per month during 1977 and at $1,725 per month during that part of 1978 in which project work continues. Commissioner Carlson made a motion to allow for these expenditures as requested. Commissioner Roe seconded the motion and it carried unanimously. TAVERN LICENSE RENEWAL REQUEST, L.I.E., INC., DBA YE GREELEY VILLAGE INN, AND DANCE LICENSE REQUEST: This renewal was reviewed by the Board, as was the report of incidents over the past year, from the Weld County Sheriff's Department. Mr. Lester Edgett, representing L.I,E., Inc., was present and answered questions. After discussion, Commissioner Dunbar made a motion to renew the tavern license and to grant the dance license for the remainder of this year. Commissioner Jacobucci seconded the motion and it carried unanimously. AUTHORIZE CHAIRMAN TO SIGN REQUEST, TREASURER'S DEED: The Chairman reviewed the request sub- mitted by the Weld County Treasurer. Commissioner Roe made a motion to authorize the Chairman to sign said authorization, Commissioner Jacobucci seconded the motion and it carried unanimosuly. AUTHORIZE COUNTY TREASURER TO ACCEPT SURETY BOND AND TO ISSUE DUPLICATE TAX SALE CERTIFICATE: The Chairman read this request, submitted by the County Treasurer, into the record. Commissioner Dunbar made a motion to authorize the issuance of duplicate tax sale certificate #48, thereby accepting the surety bond. Commissioner Carlson seconded the motion and it carried unanimously. AUTHORIZE BOARD OF COUNTY COMMISSIONERS TO CONVENE AS BOARD OF EQUALIZATION FROM JULY Ii, 1977 TO JULY 29, 1977: Commissioner Carlson made a motion authorizing the Board of County Cosmissioners to convene as the Board of Equalization from July 11, 1977 to July 29, 1977. Commissioner Roe seconded the motion and it carried unanimously.. ADOPTION UP POLICY REGARDING THE DISMISSAL OP WELD COUNTY EMPLOYEES FOR INCLUSION IN THE PERSONNEL MANUAL: The County Attorney, Thomas David, read the new policy into the record. Commissioner Roe made a motion that the County Attorney include in the Page 2, Jung 6, 197/ • a A ' o solut km the matter of returning county property , and that portion E-6 of the Personnel Manual bt' rescinded , and that this policy be adopted . Cornissioner Dunbar seconded the motion and it carried unanimously . RETENTION OF' COUNTY OWNED M1PERAL RIGHTS : AC to discussion , Commissioner Roe nwde a motion that the mineral rights owned by Weld County he sold with the real estate ( surface rights ) . Comniss loner Carlson seconded the motion and added that this action • concurs with State Statutes , The motion carried unanimously , RESIGNATION LETTER OF A DEPARTMENT READ : A letter of resignation has been submitted by Robert Mau , Ambulance Director , effective date immediately . Commissioners Dunbar and Roe made motions to accept said resignation . Commissioner Carlson seconded the motion and it carried unanimously , COUNTY ENGINEER : SPEED CONTROL SIGN , COUNTY ROAD S - Frank Smith , County Engineer , reviewed the need to install speed control signs on County Road 5 between County Road 12 and State Highway 52 . Commissioner Jacobucci made a motion to authorize speed control signs as stressed by the Engineer . Commissioner Carlson seconded the motion and it carried . All Commissioners voted aye except for Commissioner Dunbar . Commis - sioner Dunbar voted nay • CLAIMS APPROVED : On motion it was moved and seconded to approve the following claims . Motion carried . Payroll Health Department Fund $9 , 628 , 43 General Fund 89 , 91 The Chairman called a break . (Change Tape ## 77 - 57 ) COUN'T'Y ATTORNEY : AUTHORIZE COUNTY ATTORNEY TO DEFEND WELD COUNTY IN CIVIL ACTION # 29202 The County Attorney presented this resolution that reflected the Board ' s action with respect to the pending case in Dist.r. ict. Court entitled , Kenneth E . Koch , et. al vs Board of County Commissioners . Said action is a result of the Park Land Estates decision . ' ! ELD OVER : 1 ¢ Authorize Advertising for sale of property held by Treasurer ' s Deed 2 . Lease for Frederick site with Union Pacific 3 . Authorize purchase of motor graders RESOLUTIONS : Stand as listed on the agenda , Let the minutes reflect each motion as made , seconded , and carried by the Board as an individual unanimous vote in favor of the motion . There being no further business , the meeting was adjourned at 10 : 35 A . M .
