WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of
land, being the property of Mr . and Mrs. Jay D. Scruggs, and
Mr. and Mrs. J. V. Wall , and more particularly described as
follows :
That part of the East one-half (El) of Section 28 ,
Township 2 North, Range 66 West of the Sixth Princi-
pal Meridian, Weld County, Colorado, described as :
Beginning at the East one-quarter corner (E4 Cor) of
said Section 28 , and considering the East line of the
Northeast one-quarter (NE4) of said Section 28 to
bear North 00°18 ' 00" West with all other bearings
relative thereto; Thence South 89°52 ' 05" West along
the South line of the South one-half (SI) of the
Northeast one-quarter (NE4) of said Section 28 , a dis-
tance of 225. 00 feet to a point on the West line of a
parcel described in Book 586, Reception No. 1508307,
Weld County Records, said point being the True Point of
Beginning;

does not come within the purview of the definition of the terms
"subdivision" and "subdivided lands" as set forth in CRS 106-2-33

(a) and (b) 1963 , as amended, and
WHEREAS, the Board of County Commissioners of the County
of Weld, State of Colorado, desires to exempt this particular
division of land upon the recommendation of the Weld County
Zoning Administrator for the reasons as stated and pursuant to
its authority under CRS 106-2-33 (d) 1963 , as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Mr. and Mrs. Jay D. Scruggs , and
Mr. and Mrs. J. V. Wall , Jr. , be exempt from the terms "subdivi-
sion" and "subdivided lands" as provided for in the new Weld
County Subdivision Regulations at Section 2-1, A. , (3) adopted
August 30, 1972 .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 7th
day of May, A.D. , 1975.

Dear Sirs:
The attached plat, application and other items are in reference
to a request by Mr. and Mrs. Jay D. Scruggs and Mr. and Mrs.
J. V. Wall , Jr. , for a Recorded Exemption. The proposed lots
are 71 .65 irrigated acres and 59.69 irrigated acres.
The Planning staff recommends approval of the Recorded Exemption
for the following reasons:
1 . The proposed split conplies with the intent clause, Section 9-2,
of the Weld County Subdivision Regulations in that non-productive
agricultural land may be developed for higher or more productive
uses.
2. The proposed split complies with the Weld County Comprehensive
Plan because the proposed use is compatible with the agricultural
zoning.
