Question number one is already answered in my response to the December 8, 2010 letter you sent me. I submitted a response dated December 20, 2010. In question #4, in your letter it asked the same thing you are requesting. I answered the question in #4 in my response "please refer to it". • 2. a. This question is also partially addressed in my December 20, 2010 response. I indicated that I am limited to 25 members, and if in the future memberships double, the 15 to 35 people would presumably be doubled to 30 to 70 people. This is going by the past years of operation using weekend counts. The weekday counts are from no activity to 10 people on site. I haven't had to restrict or set restrictions on numbers of people on site because members want an uncrowded setting, thus abuse of privileges hasn't been an issue. Most memberships have two people without children. The members that have children have an • average of two so this would make the average • occupancy per site of three persons. Picnic tables are allowed. Most people just put down an indoor/outdoor rug in front of their doorway to address the deck question. Portable wood decks have been used by some in years past. Signage will indicate campsites 1 thru 30 with an arrow pointing to the west and sites 31 thru 50 indicated with an arrow pointing to the east Each site will be numbered with a wooden post with a metal number attached. In response to the question about what types of self contained campers, motor homes, 5th wheel • campers that are allowed—self contained recreational vehicles covers all types no matter what type of hitch it takes to pull them ie., bumper hitch pulled, 5th wheel hitch pulled or self propelled motor home. I have made all campsites the same size and have no restrictions on what type of self contained camper can be on the site. Permits—All members have been informed of the permit requirements the county now has. • December 20, 2010 Clarification response to completeness review letter of December 8, 2010 1 . Water Skiing, camping on primitive campsites. There will be limited hunting on the site which consists on one to two guided hunts per week, done by Jim Roth lessee of property. Hunting parties consist of about 3 hunters. 2. The general use of the property will still be ranching. Grazing of cattle belonging to the landowner, Ed On. The water skiing and camping areas are fenced off from the cattle. The two uses can, and have coexisted, and are compatible with each other. The oil production is and has been compatible with ranching, water skiing and camping because of difference of location on property. With no structures, elevation changes, or for that matter any changes to looks and with literally 1000's of • trees, over 100 acres of native grass, bushes, • etc., all left unchanged, it makes the impact on the natural setting of property virtually undisturbed. 3 . I, Jim Roth, feel with no structures being added to the property there is very minimal noise levels. And, with trees screening the view of the campsites, to a degree, creates a very low impact on the entire area. The water skiing and camping aspect creates another use for a unique property for a limited number of people to enjoy. • 4. West of property farming and ranching. North farming, fish farm facilities, hunting, rock and -gravel mining "North east". South ranching and farming. Last lake and learning facility "old school house building". The camping and water skiing use of this property will not disturb or impact the uses of the surrounding properties. The north properties are screened by trees and are across the Poudre River. All surrounding properties are distant enough that impact will be very minimal. The properties on the West, North and East have abundant trees and natural grass, bushes, etc. • 5. a. The membership is limited to 25 members and their families members Not all members will be likely to be on the site at the same time. Many weekdays have no activity at all. Weekends we might have 15 to 35 people maximum on the site as a total on all the lakes. This total includes members and guests. Many members ski or wakeboard for 2 hours or so and then leave. Guest policy is one family per campsite and past activity numbers are indicated above. • b. I have stated in the first submittal that there are no employees and I, Jim Roth, am the Manager and Lessee. c. I have no desire to have a commercial hunting component and don't propose one. Limited, guided hunts done by my company, Western Waterfowl Outfitters, will use the property averaging no more than one to two days a week maximum. The property won't handle any more hunting than this and still maintain quality hunting experience. Hunts a iiuli�lil • consist of about 3 persons. • d. There will be no structures built on this site The rules that spoke of structures and storage will have been struck from the regulations. The club rules were taken from my other club and the structure and storage part don't, and didn't pertain to this club. The boat ramps are existing and are gravel. No further development of them is required. The lake edge and campsites will be left as they are, only mowing as needed is done. e. The cattle are owned by the landowner, Ed On, that graze on this site, and I, Jim Roth, have nothing to do with the ranching aspect of the land use. f. I, Jim Roth, address the size, type, etc. of vehicles used to tow boats and campers on this site. They are personal SUV's, pickup trucks, either one-half ton pickups, three-quarter ton pickups, and a few members have one ton pickups. I included in my first submittal the bills from Gallegos Sanitation for the last season, as Kim asked. This company will be the trash and portolet service for this site. • Q. There are no existing or proposed sewage disposal systems. Campers are self contained • and are taken off site to be emptied. h. Portable docks are allowed in the water and are anchored by weights to the bottom of the lake. 6. No additional landscape is needed since there is an abundance of trees and grass in place. 7. No reclamation is needed since no elevations will be changed and natural grass is, and will be in place. • 8. NA 9. NA 10. No stockpiling of wastes will occur. The trash dumpster is located near the entry way of the site on the North side of the pole barn, screening it from view. It has lids on it and is from Gallegos Sanitation. The dumpster is a 3 yard dumpster and was found adequate last season. It is on wheels but not on a pad. • Site Specific Questionaire November 2, 2010 1 . Water skiing and camping with primitive campsites. No structures and no elevation changes. 2. Just the fact that the property isn't being changed from its natural ranch like setting the USR proposal won't impact the intent of the counties comprehensive plan. • 3. Again, no changes in property will be done. 4. Farming, ranching and recreation and hunting and gravel mining are the current uses of the surrounding properties. 5. a. I am requesting a 50 member club but, the current lease limits use to 25 total members, not including families and guests. b. No employees c. Over night camping allowed April 1st thru Labor Day Monday. Boat use limited from sunrise to sunset. d. No structures proposed • e. Cattle grazing on and off through out the year. f. Common tow vehicles for boat trailers, personal vehicles and the required oil field traffic to pump wells and remove contents of tanks on site. g. Greeley fire department is the fire protection provider. Nox lock will be on entrance gate to provide emergency access to property if needed. h. No potable water source is on site. No irrigation is done on site. i. Outside sewage disposal will, and is, being • done by Gallegos Sanitation. They also do the trash dumpster service. Colorado Boating Statues and Regulations: All Licensees must know current Colorado boating statutes and regulations. These statutes and regulations apply to the use of watercraft and floatation devices as well as the use of the facilities. These state statutes and regulations are minimum requirements, and we also call to your attention the fact that fishing licenses are required and associated laws and regulations issued by the State of Colorado are in effect on the Eagle Lakes Water ski Club lakes. Zebra Mussels and other invasive aquatic species: All State laws governing the control of Zebra mussels and other invasive aquatic species need to be obeyed and the laws will be enforced. • 2. If for any reason the emergency response crew (ambulance, paramedics, fire department, police, etc.. are called, meet them at the main entrance with the gate unlocked and be ready to expedite the process of locating the party in need of professional assistance for injury or any other needs. 3. Boats Inboard or outboard 4. Season The boating season shall commence on April l' and close at the end of the day on Labor Day, unless you are notified in writing of any change in the opening or closing date. 5. Insurance All boats must have general liability insurance of no less than $300,000.00. A copy of proof of valid liability insurance coverage from your insurance company for the entire season must be provided when you apply for, or renew your annual license. That insurance must show Jim • Roth AND Ed Orr as additional insureds. 6. License in Club A license in the Eagle Lakes Water ski Club (membership) is required and the license is issued in the name of one person. The membership automatically includes members of the immediate family, (Husband, Wife and Children). A license holder shall acknowledge in writing receipt of these regulations and execute a general release. The form of release and the acknowledgement are provided with these regulations and is to be returned with payment and proof of insurance. 7. Guest Policy The Licensee, for himself, guests, and invitees, assumes ALL responsibility and liability and does agree to hold Jim Roth, Eagle Lakes Waterski Club manager AND Ed Orr, landowner, totally harmless from any and all actions and liability of any type. • 8. Land Rules and Regulations a. Speed limit: The speed limit is no more than 20 miles per hour without exception anywhere on the property. Lower limits may be posted and must be obeyed and this will be very strictly enforced. Repeated violations will result in the vehicle and driver being BANNED from the property. b. Parking: Parking is permitted in designated areas only and all guest vehicles must be on the responsible Licensee's space. c. Boat Trailers: Boat trailer parking is permitted in the designated boat trailer parking areas only. For safety reasons, riding on on trailers to and from parking areas is prohibited. d. Camp Fires: Fires are only permitted in designated pits at campsites and under supervision at all times. e. Noise and Disturbances: Consideration of other campers must be extended at all times. Noise levels must be kept to a minimum, especially in the late evening hours. After 11 P.M. no noise of any kind, that can be heard beyond the campsites, is permitted. f. Dogs and Pets: All pets must be leashed or under positive • control at all times. Any dog that continually barks will be banned from the lake. NO WARNINGS!! g. Firearms: No firearms are permitted at the lake during boating season. h. Boat Parking: All boats at the lake must be parked in the area designated for boat parking or at your campsite. i. Vehicles on Path: No motor scooters, NO ATVs, NO Motorcycles, No dune buggies, etc., at the lake at all. This applies to guest as well. j. Golf Carts are allowed 9. Lake, Boating, and Skiing Rules a. Counter-clockwise rotation on lakes only. Lakes are considered rotations lakes, which means only one (1) boat using the lake at a time for skiing, etc. Rotation time is 30 minutes. Members are to communicate with each other and adhere to the established time limit for rotation. b. Boats: In board or outboard motors. • c. Speed limit: A 35 MPH speed limit is enforced on the lake. Officials from the State of Colorado will be enforced to assist in this enforcement. Boating above the wake speed at the lake is limited to the hours between Sunrise and Sunset. After or before these times all boating is restricted. d. Alcohol: Boating under the influence will be subjected to the Colorado Boating Statues and Regulations 33-13-108.1 and 33-13-108.3, and again law enforcement officials will be assisting in the enforcement of this laws. Revocations of the license will result for any violation. e. Boating Patterns: Counter- clockwise E Fallen Skier: Skiers that have fallen should be signaled with an orange flag as soon as possible to indicate and alert other lake users of a skier down. g. Watercraft Exclusion: There will be no jet ski, ski-cycles, ski- kites, sailboats, canoes, ski-doos on the lake. Paddleboats MUST stay with 20 yards of the shore. h. Flotation Devices: Floating or other leisure devices such as inner tubes, torpedoes, etc., may be used so long as this is done • in a safe manner and doesn't interfere with normal skiing and boating activity. These devices must be kept away from the ' skier drop zones or heavy ski traffic area. The use of personal flotation devices is a requirement at the lake. Paddleboats MUST stay within 20 yards of the shore and life jackets must be worn at all times i. No tubing until after 10:00 A.M. 10.Campsite Rules a. Campers: Only units licensed as recreational camper Units/vehicles or tents are permitted for use on the campsite. b. Camper Waste: Absolutely no camper waste may be dumped in the rest room facilities provided at the lake. Waste dumping on any private property, reservoir, county or state road will result in immediate license revocation. c. Lots: Must be kept wood free and grass and weeds maintained no taller than four (4) inches. d. Trash: Trash dumpsters are provided for members use. All spaces must be maintained trash free at all times. e. Lot neatness: Everything, except for one picnic table and one • fire pit, has to be cleared and removed from the space before leaving. No other storage, for example, under the camper or under plastic tarps, etc., will be permitted. Removable storage sheds and removable picnic shelters can be constructed. Plans for the construction of storage sheds must be submitted to Jim Roth for approval prior to any construction. f. Fire Pits: All fire pit locations size, and type must be approved by Jim Roth. g. Pesticides and chemicals: Before any weed or pest chemicals are used on any site, please verify with management that the product involved is approved for use in vicinity of a lake or reservoir. 11. Miscellaneous Rules a. One license shall entitle the said member to one specific boat per lot only. No guest boats shall be permitted. Any change of ownership of boats must be reported to Jim Roth, Eagle Lakes Waterski manager, along with a copy of the new insurance policy. b. A boating license in good standing at the end of one boating season shall have first chance at renewal of the site and license for the next year, subject to approval Jim Roth. c. Members and guests are to leave the hunting blinds alone. Destruction of the blinds will lead to immediate termination of license. d. Should any Licensee wish to hold a special picnic or function, a request must be submitted to Jim Roth prior to the event. e. It is imperative that wildlife at the reservoir not be disturbed. Keep a responsible distance. f. No money will be returned if your license is terminated. g. No fishing is allowed in areas with heavy ski traffic. h. Swimming is permitted no more than 15 feet from shore. Care must be taken to remain visible to incoming skier traffic and boats. Use of personal floatation devices is recommended. i. Licensees must keep all entrance gates closed and locked if locks are provided. Do not leave gates open for others in your party arriving later, and do not admit others without proof of membership. • j. Jim Roth and agents or employees are not responsible for ANY accidents, property damage, injury, or loss of life. In using these premises and facilities you are doing so at you own risk. Be advised that agents, or employees of Licensor or Land owner will patrol the entire area and they are authorized to enforce these rules and regulations. k. Any violation of any rule, regulation, or law may result in suspension, termination, or cancellation of license at the sole and absolute discretion of Jim Roth whose decision is absolute and final. 1. No structures of any type are permitted except those approved. You may put up a tent or a dining canopy for the day or weekend use, and the same must be removed when you leave. Any permanent structures, improvements or fixtures, whether approved or not, become the property of the management and can't be moved or removed. m. Boats and campers left at the reservoir are left at your own risk and responsibility. You may leave your camper and/or boat at your campsite during the boating season. _ • On or before Labor Day of each year, all boats, campers, and property must be removed or stored on site at designated off- season storage areas. The storage rate will be $50.00 per/month and must be paid in advance for the total storage time. n. If clean up of your lot is deemed necessary by an agent or employee of the Licensor or management, you will be charged at the rate of$50.00 per/hour for any clean up. o. Each lot will be adequate size for campers. p. All traffic must stay on pre existing roads. q. Eagle Lakes Waterski Club has no control over water levels. There will be NO pro-rated or refund on membership dues if, in fact, there is a change in water levels. • _• • By signing this release and acknowledgment form I hereby state that I have read ALL six (6) pages and understand all the rules and regulations.
