RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 217 -
JOE SEEWALD.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is yested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 14th day of July, 1976 , in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Joe Seewald, more parti-
cularly described in Exhibit "A" attached hereto and incorporated
herein by reference, does not come within the purview of the
definition of the terms , "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and
WHEREAS, said Board of County Commissioners did approve
Recorded Exemption No. 217 described in Exhibit "A" attached
hereto, by Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has been informed by the Weld County Department of
Planning Services , that the aforementioned Recorded Exemption
now needs to be amended in order to add additional acreage to
Lot A of Recorded Exemption No. 106 due to the fact that at
present, the leach field system connected to the septic tank
facility for the residence located on Lot A extends beyond the
property lines of Lot A of Recorded Exemption No. 106 , all as
shown on Exhibit "B" attached hereto and incorporated herein
by reference. The request, if approved would simply change the
property line boundaries and would not create an additional
parcel, and
WHEREAS, after considering the facts presented to the Board
of County Commissioners , said Board has agreed that since the
requested amendment to Recorded Exemption No. 217 is simply a
change in the property line boundaries and would not create an

additional parcel, it would be in the best interest of Weld
County to approve the amendment to said Recorded Exemption No. 217.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land referred to in Exhibit "B" attached
hereto, be, and hereby is, exempt from the definition of the
terms, "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , and that the amend-
ment to Recorded Exemption No. 217 , be, and hereby is, granted.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 21st day of
November, A.D. , 1977.

Petitioner and studied the recommendations of the Weld County
Planning Commission, and having been fully informed, now desires
to exempt this particular division of land pursuant to its
authority under 1973 C.R. S. 30-28-101 (10) (d) , as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Joe Seewald, Longmont,
Colorado, be exempted from the definition of the terms "sub-
division" and "subdivided lands" as provided for in the new
Weld County Subdivison Regulations at Section 2-1, A. , (3)
adopted August 30 , 1972.
The above and foregoing Resolution was , on motion duly

RE: Amendments to Recorded Exemptions #106 and #217
Dear Commissioners:
The attached materials are in reference to a request from Joe Seewald
for an amendment to recorded exemptions #106 and j#217. The properties
in question are described as Pt . of Section 31, T3N, R68W of the 6th
p.m. , Weld County, Colorado. Said property is located on the west
side of Union Reservoir (Calkins Lake) . Mr. Seewald is requesting the
recorded exemptions be amended in order to add additional acreage to
Lot A of recorded exemption #106 . Additional area needs to be
added to Lot A of recorded exemption #106 because at present the leach
field system connected to the septic tank facility for the residence
located on Lot A extends beyond the property lines of Lot A of recorded
exemption #106. The request if approved would simply change the
property line boundaries and would not create an additional parcel .
Based upon the information submitted, the Department of Planning
Services recommends approval of this requested amendment since the
impact would not appear to be any different than the original request
which has already been approved.

A well permit was issued for tis r,ror-erty in July 1973 ,
and dug in July 197) . The well location was s_ ecified by the
State Engineer of the Water Dept. in Denver.
A building permit was issued to my son-in-law and daughter
in 1974. ::t the time of building it was speciefied by the
Health Jept. that the sgptic system is to be no less than
10u feet from the well. To do this 1 granted my daub titer
perwiss or, tc cross the boundary lines to instal_ the system.
Since that time my daughter and her husband divorced , the
roperty sod tc someone else and now I am giving the new
owner additional land to cover this system, providing you
approve of this request.
