WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a 48 Hour Film Project Location Release between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and 48 Hour Film Project, Inc., commencing upon full execution, with further terms and conditions being as stated in said release, and WHEREAS, after review, the Board deems it advisable to approve said release, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the 48 Hour Film Project Location Release between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and 48 Hour Film Project, Inc., be, and hereby is, approved. ("48HFP") and their respective parents, subsidiaries and affiliates, licensees, successors and assigns (collectively "the Released Parties"), for good and valuable consideration, receipt of which is hereby acknowledged, permission to access, enter upon and use the Property identified above and the contents thereof and the appurtenances thereto (the "Property") for the purpose of photographing and recording 1cert9iin scenes in connection in and in connection with a motion picture ("Film") being produced by k�j•e Wood e ("Producer") as part of the 48 Hour Film Project for -a a ,Ea1CO (City) on or abo t '1/-yoti[ (date) (the "Project"), as well as in connection with any "behind the scenes" recordings taped, filmed, recorded and/or otherwise produced by 48HFP with regard to the "making of' the Project ("Documentary Footage"), during production thereof. All physical embodiments of filming, recording and photography on the Property shall hereinafter be known as the "Materials". 48HFP and/or Producer may place all necessary facilities and equipment on the Property and agree to remove same after completion of work and leave the property in as good of condition as when received. 48HFP and/or Producer will use reasonable care to prevent damage to said Property. Owner irrevocably grants to Producer and 48HFP all rights of every kind in and to the Materials including without limitation the right to exploit the Materials throughout the world, in any and all languages, an unlimited number of times, in perpetuity in any and all media, now known or hereafter invented, in and in connection with the Film and/or the Documentary Footage, 48HFP or otherwise and for advertising and promotional purposes in connection therewith and all rights, including copyright in the Materials shall be and remain vested in Producer and/or 48HFP. In no manner limiting the foregoing, Producer and 48HFP shall have the perpetual right to edit, dub, subtract from, add to or modify the Materials in any manner, combine the Materials with any other material and/or incorporate it into other Film and/or the Documentary Footage(s). Owner's signature hereon subsequent to the production of the Materials shall have the same effect as if Owner had signed in advance thereof. Owner hereby waives any right of inspection or approval of the appearance of the Property in the Materials, and the uses to which such appearance and/or the Materials may be put. Owner acknowledges that Producer and/or 48HFP will rely on this permission and this Release potentially at substantial cost to them and Owner hereby agrees that neither Owner, nor any tenant, nor other party now or hereafter having an interest in the Property (collectively "Releasing Parties"), shall have any right of action against the Released Parties or any of them or any other party arising out of the production (including without limitation trespass to real or personal property and/or invasion of privacy) or any use of said Materials whether or not such use is, or may be claimed to be, defamatory, untrue or censorable in nature. In no manner limiting the foregoing, none of the Releasing Parties will be entitled to equitable or injunctive relief in conjunction with any claim or action of any kind against the Released Parties or any of them. The undersigned represents and warrants that the undersigned has all rights and authority to enter into this agreement and to grant the rights granted hereunder. No other authorization is necessary to enable Producer and/or 48HFP to use the Property for the purposes herein contemplated. Producer and/or 48HFP are not obligated to actually use the Property or produce the Film and/or the Documentary Footage or include the Materials in the Film and/or the Documentary Footage for which it was shot or otherwise. This is the entire agreement. This release shall bind Owner and Owner's personal representatives and/or executors. The 48 Hour Film Project is a wild and sleepless weekend in which : '""%�c. you and a team make a movie—write, shoot, edit and score It—in just 9 48 hours. -cf.* . Then It will show at a local theater, usually in the next week. In 2010, nearly 40,000 filmmakers made 3,000 films in 80 cities on five continents. This year, we're even bigger, with filmmakers around th�world taking the challenge to make a film in just 48 hours. Our Mission The 48 Hour Film Project's mission is to advance filmmaking and promote filmmakers. Through its festival/competition, the Project encourages filmmakers and would-be filmmakers to get out there and make movies. The tight deadline of 48 hours puts the focus squarely on the filmmakers—emphasizing creativity and teamwork skills. While the time limit places an unusual restriction on the filmmakers, It is also liberating by putting an emphasis on "doing"instead of"talking." Our History Back in May 2001, Mark Ruppert came up with a crazy idea: to try to make a film in 48 hours. He quickly enlisted his filmmaking partner, Liz Langston, and several other DC filmmakers to form their own teams and join him In this experiment. The big question back then was: The answer was a resounding yes, and now ten years later and with more than 300 competitions having taken place around the world, it is amazing to consider the success of the Project. 2011 marks the 10th time we've visited Atlanta, Los Angeles, New York and Austin, and the 12th time for DC. Our smallest team has consisted of one person who sets up the camera then runs around to be "on-camera". Our largest team to date was a team from Albuquerque with 116 people and 30 horses! We've had about 12,500 teams in the Project over the years, and at 15 people per team, that translates to roughly 200,000 people who have answered the call to come on out and make a movie.
