Application Package- Incomplete
Dear Ms. Magee:
On March 24, 2011,the Division of Reclamation, Mining and Safety (Division) received the 110 Construction
Materials Reclamation Permit Application package for the Peters Ranch Pit, File No. M-2011-022. Preliminary
review of the information received determined the following items must be received before the Division can
consider the application as being submitted and technical review can begin:
Application Form:
1. On Page 1, Item #3, the Applicant states the proposed permitted acreage for the Peters Ranch Pit is 10
acres. The Limited Impact (110) application package submitted by the Applicant is for a construction
material extraction operation affecting LESS than 10 acres. Please revise Item #3 on the application
form and all applicable exhibits to indicate less than 10 permitted acres (i.e. 9.99 acres or less).
2. The Division requires the Operator/Applicant's name to remain consistent and match the exact name
registered with the Secretary of State's office (Basic Energy Services, L.P.)throughout the application.
Please revise the Applicant's name on all applicable sections of the application form. A copy of the
summary page from the Colorado Secretary of State for Basic Energy Services, L.P. is attached for
reference.
3. The Division requires the Applicant to provide documentation giving the signer the authority to sign on
behalf of the company. The authorization document may be in the form of by-laws, resolution, affidavit
signed by corporate secretary, certified secretary statement or a notarized statement on company
letterhead.
4. The Applicant did not complete the "notary" section of the certification page (page 7) of the Construction
Materials Regular 110c Operation Reclamation Permit Application Form. The date indicated in this
section must match the date indicated in the notary section of the form.

5. The Division did not receive a copy of Addendum 1—Affidavit of Posting Notice at Location of Mine Site
with the application package as required by Rule 1.6.2(1)(b). A sample of this notice is attached to the
application form available on the Division's website.
Exhibit A-Legal Description (Rule 6.3.1(11):
The legal description must identify the affected land, specify affected areas and be adequate to field locate the
property. Description shall be by township, range, and section,to at least the nearest quarter-quarter section.
A metes and bounds survey description is also acceptable. Also, the street address or lot number(s) may be
used. This information is available from the County Assessor's office or U.S. Geological Survey (USGS) maps.
6. The Applicant provided a legal description by township, range and section, but only to the nearest quarter
section. Please provide a legal description to the nearest quarter-quarter section for the proposed Peters
Ranch Pit project. The description must match the information provided for Item #10 on the application
form.
7. Alternatively, the Applicant may revise the metes and bounds survey description submitted on the maps
labeled T-1.0 and submit the description in Exhibit A. The metes and bounds description must be revised
in response to Item #1 above.
Exhibit A—Location Map (Rule 6.3.1(3)):
A map showing information sufficient to determine the location of the affected land on the ground and
existing and proposed roads or access routes to be used in connection with the mining operation. Names of
all immediately adjacent surface owners of record shall also be shown. The operation location map shall be
a standard 1:24,000 scale U.S. Geological Survey map. The location of the proposed operation shall be
shown and labeled with the mine site name.
8. The Division did not receive a Location Map with the application package. Please provide a Location Map
in accordance with Rule 6.3.1(3).
Exhibit B—Site Description (6.3.2):
The Operator/Applicant shall include a description of the vegetation and soil characteristics in the area of
the proposed operation. The local office of the Soil Conservation Service (SCS) may provide you with this
information as well as recommendations for Exhibit D - Reclamation Plan.
9. The Division did not receive a description of the vegetation characteristics in the area of the proposed
operation. Please provide the required vegetation information.
Exhibit E—Map (6.3.5j
10. The Division did not receive a Reclamation Plan Map as required by Rule 6.3.5 with the application
package. Please provide a Reclamation Plan Map with the following information:
(a) show the gradient of all reclaimed slopes (horizontal:vertical) sufficient to describe the post mine
topography;

(b) indicate where vegetation will not be established and the general area(s) for shrub or tree
planting;
(c) if ponds are a part of the Reclamation Plan, outline the final shore configuration of the ponds
and shallow areas if the future land use is for wildlife;
(d) state the average thickness of replaced overburden by reclamation area or phase; and
(e) state the average thickness of replaced topsoil by reclamation area or phase.
11. Rule 6.2.1(2) requires maps be signed by a registered land surveyor, professional engineer, or other
qualified person. The maps submitted to the Division were not signed. Please resubmit signed copies
of the maps. Additionally, please label the Mining Plan and Reclamation Plan Maps accordingly.
Exhibit G -Source of Legal Right-to-Enter(6.3.7)
The Applicant submitted a letter signed by John Peters granting Basic Energy Services permission to dig test
holes at the proposed gravel pit. The letter is not an acceptable source of the Applicant's Legal Right-to-
Enter.
12. Please provide a description of the basis for legal right of entry to the site and to conduct mining and
reclamation, for Owners of Record described in Rule 1.6.2(1)(e)(i). This may be a copy of access lease,
deed, abstract of title, or a current tax receipt. A signed statement by the Landowner and
acknowledged by a Notary Public stating that the Operator/Applicant has legal right to enter and mine
is also acceptable.
Exhibit I - Proof of Filing with County Clerk(Rule 6.3.9):
13. Please provide an affidavit or receipt indicating the date on which the revised application was placed with
the local County Clerk and Recorder.
Your application will not be considered filed until the information listed above is received and found sufficient
to begin our review. A decision date will be established 30 days from the date of receipt of all of the requested
information. Additionally, if you have already published notice you will need to republish notice, after the
Division considers the application submitted. Republication must occur once within ten (10) days of the
submittal date. We will notify you when you should initiate republication of your notice. The final date for
receiving comments is ten (10) days after the date of publication or the next regular business day.
You have sixty (60) days from the above date to submit all necessary documents that the Office needs for an
application to be considered filed. If, at the end of the sixty day period, the application has not been
determined to be filed with the Office,the Office shall deny the application and terminate the application file.
The response due date is May 30, 2011.

This letter shall not be construed to mean that there are no other technical deficiencies in your application.
The Division will review your application to determine whether it is adequate to meet the requirements of the
Act after submittal of all required items.

Responsibilities as a Permittee:
Upon application approval and permit issuance,this application becomes a legally binding document. Therefore,there are a number of
important requirements which you,as a permittee,should fully understand. These requirements are listed below. Please read and initial
each requirement, in the space provided, to acknowledge that you understand your obligations. If you do not understand these
obligations then please contact this Office for a full explanation.
/6/�/�'/�j — 1. Your obligation to reclaim the site is not limited to the amount of the financial warranty. You assume legal liability
for all reasonable expenses which the Board or the Office may incur to reclaim the affected lands associated with your
mining operation in the event your permit is revoked and financial warranty is forfeited;loit 2. The Board may suspend or revoke this permit,or assess a civil penalty,upon a finding that the permittee violated the
terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information contained in the
aapplication or your permit misrepresent important material facts:
r. 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary,
ak substantial civil penalties.to you as permittee can result;
4. Any modification to the approved mining and reclamation plan from those described in your approved application
requires you to submit a permit modification and obtain approval from the Board or Office;
5. It is your responsibility to notify the Office of any changes in your address or phone number;
6. Upon permit issuance and prior to beginning on-site mining activity,you must post a sign at the entrance of the mine
site,which shall be clearly visible from the access road,with the following information(Rule 3.1.12):
a. the name of the operator;
b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land
Reclamation Board;and,
akc. the permit number.
�- 7. The boundaries of the permit boundary area must be marked by monuments or other markers that arc clearly visible
and adequate to delineate such boundaries prior to site disturbance;
8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed
in your application,as well as with the provisions of the Act and the Mineral Rules and Regulations in effect at the time the

permit is issued.
9. Annually,on the anniversary date of permit issuance,you must submit an annual fee as specified by Statute,and an
annual report which includes a map describing the acreage affected and the acreage reclaimed to date(if there are changes
from the previous year),any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date
of the permit approval. Annual fees are for the previous year a permit is held. For example,a permit with the anniversary
date of July I, 1995,the annual fee is for the period ofJuly I. 1994 through June 30, 1995. Failure to submit your annual
fee and report by the permit anniversary date may result in a civil penalty,revocation of your permit,and forfeiture of your
(-)4‘....._ financial warranty. It is your responsibility, as the permittee,to continue to pay your annual fee to the Office until the
Board releases you from your total reclamation responsibility.
10. For joint venture/partnership permittee:the signing representative is authorized to sign when document and a power
of attorney(provided by the partner(s))authorizing the signature of the representative is attached to this application.

NOTE TO COMMENTORS/OBJECTORS:
It is likely there will be additions,changes,and deletions to this document prior to final decision by the Office. Therefore,if you have
any comments or concerns you must contact the applicant or the Office prior to the decision date so that you will know what changes
may have been made to the application document.
The Office is not allowed to consider comments,unless they arc written,and received prior to the end of the public comment period.
You should contact the applicant for the final date of the public comment period.

As an authorized representative of the applicant,I hereby certify that the operation described has met the minimum requirements of the

I. All necessary approvals from local government have been applied for(Section 34-32.5-11 0(1)(a)(VIII).
2. To the best of my knowledge,all significant,valuable and permanent man-made structure(s) in existence at the time this
application is filed, and located within 200 feet of the proposed affected area have been identified in this application
(Section 34-32.5-I 15(4)(e),C.R.S.). (NOTE: For 110 operations,the affected area includes all lands delineated by the permit
boundary.)
3. No mining operation will he located on lands where such operations are prohibited by law (Section 34-32.5-I15(4)(f),
C.R.S.).
4. As the applicant/operator,I do not have any mining/exploration operations in the State of Colorado currently in violation of
the provisions of the Colorado Land Reclamation Act for the Extraction o[Construction Materials(Section 34-32.5-120,C.R.S.).
5. I understand that statements in the application are being made under penalty of perjury and that false statements made herein
are punishable as a Class I misdemeanor pursuant to Section 18-8-503,C.R.S. 1984.
This form has been approved by the Mined Land Reclamation Board pursuant to section 34-32.5-110,C.R.S.,of the Colorado Land
Reclamation Act for the Extraction of Construction Materials. Any alteration or modification oJthis form shall result in voiding any
permit issued on the altered or modified form and subject the operator to cease and desist orders and civil penalties for operating
without a permit pursuant to section 34-32.5-123, C.R.S.

Permit with the Colorado Mined Land Reclamation Board. Anyone wishing to comment on the
application may view the application at the Weld County Clerk and Recorder's Office, 1402 N. 17th
Ave. Greeley, CO 80631, and should send comments prior to the end of the public comment period to
the Division of Reclamation, Mining and Safety, 1313 Sherman St., Room 215, Denver, Colorado
