HomeMy WebLinkAbout20111136 RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000148 AGAINST KEITH CAMPBELL AND LUCINDA LOUDON-CAMPBELL FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Keith Campbell and Lucinda Loudon-Campbell, ZCV #1000148, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of March, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Lucinda Loudon-Campbell, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 10, 2011, to allow adequate time for the property owner to have the barn vacated by the current tenants and restored to its original purpose. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000148 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Keith Campbell and Lucinda Loudon-Campbell to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until June 10, 2011, to allow adequate time for the property owner to have the barn vacated by the current tenants and restored to its original purpose. VIOLATION REMEDY: During my last inspection conducted on January 6, 2011, I noted the camper/trailer-RV still had steps, a propane tank and storage around it. There was also a truck parked next to it. As I indicated in my initial letter, the utilization of a camper/trailer-RV as a dwelling unit is not an allowed use within Weld County, unless the unit is situated at an approved camping facility. To bring this aspect into compliance, it would need to be disconnected from all utilities(i.e. propane, electric, water, etc), compacted (if an model that expands), steps put away, no storage around it, etc. vise Planning Department ZONING VIOLATION CASE SUMMARY While I realize you that you have scheduled a Pre-Application meeting, in order to place this violation case on hold, a Use by Special Review(USR) application is necessary. Once an application has been deemed complete by one of our Planners and your case initiated, my violation case will go on hold pending the outcome of that application. If this occurs prior to the above scheduled Violation Hearing, the hearing will be cancelled. RECOMMENDATION: The Department of Planning Services recommends this case be forwarded to the County Attorney's Office for immediate legal action. She said she received a letter and was calling to discuss it. I asked about the barn. She said she had a barn, but no one besides horses stay in it. She said she does rent out the barn for horses(not people). I asked if I could schedule a time to inspect the barn. She said sure. Inspection scheduled for Friday, December 17th. She said she does have people staying in an RV temporarily. I asked what her definition of temporary was. She said they would be gone within 30 days. I told her I would be sending her a letter which would grant 30 days for the RV to be disconnected from all utilities(water, electricity, etc)and mobile(no skirting, etc). She said it would be done. 12/21/2010 Phone call After speaking with Vermida (Appraiser), she indicated that it taxed as a barn as well. She said they would send someone out there to take a peak after the holidays. She validated 1 (one) house situated on the parcel. 12/28/2010 Phone call Lucinda Campbell (970-532-4036 home or 303-726-2389 cell)called and left a message. I called her home number- N.A. - I then called her cell number and left a voice mail 12/29/10 @ 1017. 01/05/2011 Phone call Lucinda Campbell (970-532-4036 home or 303-726-2389 cell)called and left a voice mail on the building inspection hot line. I called her back. She indicated that the RV-Camper/Trailer had been disconnected from all utilities and is no longer occupied. She indicated that portion of the violation is ready for inspection. I then asked how the Pre-Application form was coming along. She said she needed to get that done. She asked if I was able to find any pictures at the Assessor's Office. I advised her that they were not able to locate any pictures, but they as well believe the barn is what she is referring to as the second home (Built in 1983). I could not validate or dismiss the complaint regarding the occupancy of the barn. No pictures were taken during this inspection. Zoning Code Inspection 12/20/2010 Noncompliance Inspection Result Comment During an on-site inspection with Lucinda to validate that one of the barns had not been converted into a house, she started walking past the barn that looked like a house. I said I think this is the one that I'm talking about. She said oh, because that is a house. I said no, you are only being taxed for 1 (one) house and 7 outbuildings. She said that has always been a house. I explained that it could have been that when she purchased the property, it had already been converted, but it was not converted legally. We walked through the Merrick screen showing all structures. I told her that I would come back to the office and view our records again and let her know. She said that would be helpful. We receive our mail at P.O. Box 1815, Berthoud, CO 80513 and would appreciate any further correspondence be mailed there as we do not get our mail when delivered to 20242 CR 5 as this is Lucinda's mailbox. We were contacted by Lucinda in August of 2010. At that time she stated the barn/home on her property was being vacated by the present tenant and she would like us to rent the property. We moved in the first week of September 2010. Prior to that, on August 8, 2010, my husband suffered from a traumatic brain injury and was hospitalized for a week at Longmont United Hospital. Upon his release he was unable to care for himself, needed the aide of a walker and spotter to be mobile and began having seizures. At this time he continued to have regular epileptic seizures, which are completely debilitating, and is being followed by numerous physicians and the Traumatic Brain Injury team at the Veteran's Hospital in Denver. Due to the ongoing need for medical care and medications we are financially destitute and are working diligently to get back on our feet. We have sold much of our belongings, including a horse, our car and my wedding ring, to pay the rent and pay for necessities. Lucinda has been aware of our situation from the get go. She portrayed the home as livable and up to all county codes. We only recently found out (this past week) that she has always been aware of the code status of the barn home and has disregarded it for the past several tenants and approximately seven years. She has most recently filed bankruptcy, closed her numerous bank accounts, bought a fifth wheel trailer to live in on the property and rented out the main home (as of approximately May 1, 2011). When Lucinda was told she was not able to occupy the trailer she moved it to the back of the property out of site and continued to dwell in the trailer. The people who rent stalls in the barn, as well as the new home renters, have informed us her intentions are to move us out asap and move into the barn home. She fully intends to reside in this barn home as her main residence and this has been her plan for many months. When we moved into this home she shared this future plan with us as well. There are numerous other individuals who would gladly testify to the fact she was aware of the violations, if they would have had notice. We have located another home however, due to a water heater and pipe break, repairs need to be made as well as cleaning and repair to the carpet and flooring. We are approximately 10-15 days out from being able to move. Our horses have already been removed from the property. A 2.cv to-Cot 8' . Due to the fact we are unable to vacate immediately we would appreciate some time to get out since this is due to no fault of our own and we were also mislead. In addition, we would like this letter to remain anonymous until we are able to move for fear of retaliation. One of our cats has very recently been sprayed with diesel fuel and almost died and we fear further occurrences. When confronted Lucinda did not deny the heinous action stating it was just a cat.
