RE: RECORDED EXEMPTION NO. 261 - HENRY HAAS.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 22nd day of June, 1977, in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Henry Haas , 1 mile east of
Windsor, Weld County, Colorado, more particularly described as
follows :
A tract of land located in the East Half (Eh) of
Sec. 15, T6N, R67W, of the 6th P1M. Weld County,
Colorado being more particularly described as
follows:
Commencing at the South Quarter Corner (Ski Cor) of said
Section 15, and considering the South line of said Section
15 to bear N89°45'30" E and with all other bearing herein
relative thereto;
Thence N0°36'23" E, 93.34 feet;
Thence N89°33'00" E. 440.09 feet;
Thence N0°27'00" W. 5.00 feet to a point on the Northerly
right-of-way line of State Highway 392, being the true
point of beginning;
Thence N89°45'30" E along said Northerly right-of-way line

does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Henry Haas , be exempt from the
definition of the terms, "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
June, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 29th day of June, A.D. , 1977 .

RE: Recorded Exemption #261
Dear Commissioners :
The attached application, plat, and related items are in reference
to a request by Henry Haas for a recorded exemption. The parcel of
land in question is described as Pt . of the EZ of Section 15, T6N,
R67W of the 6th p.m, Weld County, Colorado. Said property is located
1 mile east of Windsor on the north side of State Highway 392. The
subject property contains 136. 98 acres of predominantly Class II ,
III , and IV irrigated soils. The request is to split the property
into parcels of 2. 84 acres and 134.14 acres. As indicated in a
letter dated May 26, 1977, Mr. Haas intends to continue to reside
in the residence located on the proposed Lot B. Additionally, his
intent is to convey the 134. 14 acre parcel to his nephew, Ronald
Adler, who desires to use the parcel for agricultural purposes.
Based upon the information submitted and the adopted policies in the
county, the Planning Commission staff recommends the request be
approved for the follow reasons:
1 . The Windsor Planning Commission has indicated the request to
split complies with their Comprehensive Plan and recommends the
recorded exemption be approved.
2. The proposed split conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
District (Section 3.R(a) of the Weld County Zoning Resolution) ,
and the Weld County Comprehensive Plan since the use would be
compatible with the surrounding agricultural uses.

We are now both retired from our lifelong pursuit as farmers,
and in view of the fact that our nephew and his wife, Ronald
G. Adler and Barbar;.. H. Adler, for sometime have been seeking
to remain in the agricultural field by :.urchasing a farm of
their own, we felt it would be quite a_-. ro -riate to sell our

Also, since we are both lifelong residents of the Windsor area,
it is our desire to continue to make our home during our retire-

meeting will take place in the County Commissioners ' Hearing Room,

there to answer any questions the Board might have with respect to

Commissioners, the Town of Windsor Planning Commission will review

The Colorado Division of Highways has reviewed the at:0Tication from Henry
Haas for a Recorded Exemption located in the SE ;, Sec. 15, T. 6 N. , R. 67 W. ,
north of S.H. 392. The Division has the following comments for your due
consideration.
The Division has adequate right of way for future highway needs in this
area (based on 20-year projections of normal growth).
Using our right of way plans on Project S 0392(1 ) - copy attached - and
scaling from the S a corner of Sec. 15, 440.09 feet to the point of beginning
of Lot B, thence 457.57 feet along the right-of-way line to the east side of
Lot B, it appears that access to Lot B is located on Lot A. This easterly
line falls between the existing house and driveway to the house. The Division
is not, at this time, willing to grant additional driveways in this area.
Our plans show two existing driveways to the total parcel . It would be our
recommendation that there should be separate driveways to each lot. If the
above-mentioned driveway to Lot B is, in fact, located on Lot A, then that
driveway should be abandoned and an application for a new driveway should
be made.
Driveway applications should include four copies of a sketch or drawing
showing the proposed driveway. Applications are to be sent to Mr. David N.
Fraser, District Maintenance Superintendent, P. 0. Box 850, 1420 Second Street,
Greeley, Colorado 80631 .
The above-mentioned request for a driveway will be on the condition that
the existing driveway is abandoned if, in fact, it is located as shown on our
plans.
