BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
FEBRUARY 9, 2011
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, February 9, 2011, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Barbara Kirkmeyer, Chair
Commissioner Sean P. Conway, Pro-Tem
Commissioner William F. Garcia
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:
County Attorney, Bruce T. Barker

MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of February 7, 2011, as printed. Commissioner Long seconded the motion,
and it carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: Doug Meyer, County resident, stated the Weld County Comprehensive Plan
references Conservation Easements, and he submitted an article, by Dan Byfield, marked Exhibit A,
which he read for the record. In response to Commissioner Garcia, Mr. Meyer stated Conservation
Easements have historically been into perpetuity; however, he has found that a recent trend is to
establish them for shorter periods of time.
CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed.
Commissioner Long seconded the motion, and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: On behalf of the Board, Commissioner Conway
presented Commissioner Rademacher with a hockey stick signed by the Colorado Eagles Goalie, as a
memento in honor of his return from an extended medical leave, and expressed the Board's desire that
it serve as an inspiration for a continued speedy recovery.
Commissioner Conway also reported that on February 3, 2011, the Board spoke on behalf of HB-1082
before the Colorado legislature, which was approved following a lengthy hearing, and the next step is to
get it passed by the Appropriations Committee within the next week. He commented this is the first
time in more than two years that the County has been successful concerning the matter.
Commissioner Long commended Commissioner Conway on his presentation, which was thorough and

accurate. He stated he was struck by the comments of Representative Ballas who justified supporting
the bill based on the potential loss of some business at mechanic shops, versus the justification based
on the impact to thousands of Colorado residents. Commissioner Kirkmeyer stated she was also struck
by the comments of Representative Reisburg regarding the defunding of a contract that was not
necessary in the first place, yet he failed to address the impacts to local governments who are losing
contracts as a result of the State budget. She further stated the Board also needs to remain diligent in
expressing the fact that the Environmental Protection Agency (EPA) sets its standards to protect the
public health, and Weld County's readings are at .071, which is well below the EPA standard of .080.
Commissioner Kirkmeyer referred to Senate Bill 124, which deals with the TANF (Temporary
Assistance for Needy Families) reserves and changing the process, and she indicated she will be
speaking before the Committee on February 10, 2011, concerning the matter. She commended Judy
Griego and Lennie Bottorff, Department of Human Services, and County Attorney, Bruce Barker, for all
of their assistance in compiling the fact sheet and drafting the Bill. She stated she is optimistic that this
Bill will benefit Weld County, as well as other counties, and she hopes it is successful.
Commissioner Conway stated he participated in the South Platte Round Table last night, and each of
the various Round Tables have sent their reports to the Governor. He stated, on March 3, 2011, all of
the Round Tables will meet to discuss areas of agreement, or disagreement, regarding the challenges
of providing water for the future, and he extended an invitation to his fellow Commissioners to
participate in the dialog with associates from the western slope and southern Colorado. He mentioned
the meeting is also open to the public, and he commented the South Platte Basin has a lot at stake and
the area must be very proactive in protecting the most productive agricultural lands in Colorado, while
still ensuring they meet future demands of municipalities.
BIDS:
PRESENT BID #61100034, SIGN MATERIAL FOR 2011 - DEPARTMENT OF PUBLIC WORKS:
Monica Mika, Director of Finance and Administration, explained this is a very complex bid containing 49
separate items. In response to Commissioner Conway, Ms. Mika indicated there is only one Colorado
vendor, which is typical, as many of the products are very specific and not available locally. Said bid
will be presented for approval on February 23, 2011.
PRESENT BID #61100038, 4X4 FULL-SIZE EXTENDED CAB DIESEL PICKUP - DEPARTMENT OF
PUBLIC WORKS: Ms. Mika stated this bid is part of the ongoing rotation of vehicles utilized by the
Department of Public Works. Said bid will be presented for approval on February 23, 2011.
PRESENT BID #B1100050, 2011 CRUSHING OF RECYCLED ASPHALT MININGS - DEPARTMENT
OF PUBLIC WORKS: Ms. Mika stated there is only one vendor on this bid, which happens to be local;
however, she intends to verify that no one was excluded. Said bid will be presented for approval on
February 23, 2011.
NEW BUSINESS:
CONSIDER FOOD DISTRIBUTION AGREEMENT FOR COMMODITY SUPPLEMENTAL FOOD
PROGRAM AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director, Department of Human
Services, stated this is an ongoing agreement for the administration and operation of the Commodity
Supplemental Food Program and Weld County will act as a pass through for the Weld County Food
Bank, for a term ending September 30, 2011. Commissioner Long moved to approve said agreement
and authorize the Chair to sign. Seconded by Commissioner Rademacher, the motion carried
unanimously.

CONSIDER APPLICATION FOR COLORADO EMTS PROVIDER GRANT AND AUTHORIZE CHAIR
TO SIGN: Dave Bressler, Director, Weld County Paramedic Service, stated this application is being
submitted as a result of an accident involving one of the ambulances while at the scene of a separate
traffic accident. He explained the ambulance was struck from behind during a snow storm when
another vehicle slid into the unit. Mr. Bressler confirmed an insurance claim was filed and the damaged
unit has since been sold. He stated the funds received from this grant will replace the damaged unit,
and since the loss was the result of an accident, the State will provide 90 percent of the funds, and the
County will be responsible for a ten percent match. He further stated, if successful, the funds will be
awarded in June, 2011. Commissioner Long moved to approve said application and authorize the
Chair to sign. Seconded by Commissioner Garcia, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:30 a.m.
