RE: APPROVAL OF RECORDED EXEMPTION NO. 377 - CHARLEY AND RUBY
WYKOFF.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 5th day of February, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 377, being the property of
Charley and Ruby Wykoff, described as part of the Northwest Quar-
ter Southwest Quarter of Section 19, Township 4 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more particu-
larly described as follows:

"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Charley and Ruby Wykoff be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 5th day of
February, A.D. , 1979.

RE: Recorded Exemption #377
Dear Commissioners:
The attached application, plat and related items are in reference to
a request for a recorded exemption by Charley and Ruby Wykoff . The
property is described as Pt. NW$SW$ Section 19, T4N, R68W of the 6th
P. M. , Weld County, Colorado. This property is located 1/2 mile south
of Colorado Highway 56 on the east side of County Road 1. The property
contains approximately 23. 2 acres of Class II and III irrigated soils.
The request is to split the property into parcels of approximately 1. 3
acres and 23 acres.
On January 8, 1979, the Board of County Commissioners approved a re-
quest by the Wykoffs for a lot size variance so that they could make
application for this recorded exemption. At the time they made the
decision on that request , the Department of Planning Services Staff sub-
mitted a letter of recommendation to the Board. A copy of that letter
of recommendation is included in the attached packet. Nothing has been
received by our office that would change our recommendation of approval
for this request as outlined in the letter to the Board of County Com-
missioners dated January 8, 1979. This request complies with the pro-
visions of Section 9-4 A. of the Weld County Subdivision Regulations.
It should be noted that the parcel is located in the 100 year floodplain
of the Little Thompson River, according to Panel No. 080266-0725A of the
Preliminary Flood Insurance Rate Maps dated October 31, 1978. However,
the improvements on the parcel already exist and the proposed floodplain
reg a . ons govern only future improvements.

RE: Lot Size Variance #79
Dear Commissioners:
The,attached letter and related materials are in reference to a re-
quest for a lot size variance from Charley and Ruby Wykoff. The
property on which this request has been made is described as Pt. NW}
SWI Section 19, T4N, R68W of the 6th P. M. , Weld County, Colorado.
This property is located 1/2 mile south of Colorado Highway 56 on
the east side of County Road 1. The property contains approximately
23.2 acres of Class II and III irrigated soils. The request is to
obtain a variance from the minimum lot size requirement, Section 9-4A.
(6) so that they may make application to apply for a recorded exemp-
tion.
If this lot size variance is granted, the Wykoffs will proceed with
their application for a recorded exemption to divide the property
into two parcels. Mr. and Mrs. Wykoff wish to retain 1.2 acres more
or less which includes the existing improvements. The balance of the
property will be used in combination with a parcel located across the
road in Larimer County which presently has an existing dairy operation
located on it . Mr. Wykoff' s son, Gary C. Wykoff, will continue opera-
tion of the dairy after Mr. Wykoff's retirement.
Based upon the information and the adopted policies in the county, the
Department of Planning Services Staff recommends this request be ap-
proved for the following reasons:
1. The request is in compliance with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) in that the proposed use of the property will be com-
patible with the surrounding agricultural land uses.

2. The request is in compliance with the intent clause of the Agri-
cultural Zone District (Section 3. 3A of the Weld County Zoning
Resolution) and the Weld County Comprehensive Plan in that the
request will be encouraging agriculture and related uses to
continue as the predominant land uses.
3. The request complies with Section 9-4A. (6) of the Weld County
Subdivision Regulations.
It should be noted that the parcel is located in the 100 year flood-

Gentlemen:
At the meeting of the Board of Trustees of the Town of Berthoud, it
was voted to recommend approval of the above exemption enabling Mr. & Mrs.
Wykoff to sell their part of the farm which lies in Weld County and retaining
approximately 1.2 acres which is now their home.
This exemption was also reviewed by the Berthoud Planning Commission
and they also recommended approval.
