The Board of County Commissioner approved permit was for a dry mine producing sands, gravels and stones that were processed on site and trucked from the mine site via an easement to the East 1-25 Frontage Road. The easement crossed lands owned by others. At time of determination of compliance, Connell Resources was also operating an asphalt batch plant from the premises approved through a State paving contract. The batch plant is to be removed at termination of contract with evidence of such provided to the Department of Planning Services. Staff indicated that should Connell request a permanent batch plant on site an amendment to the current application would be required. Also discussed at the April 28, 2011 meeting was a proposed southerly access from the mine site utilizing County Road 17 right-of-way. Staff noted that right-of-way exists, however, there is presently no physical road, and any improvements to County road right-of-way will require an Access Permit. In addition to the Access Permit, a Long Term Road Maintenance Agreement approved by the Board of County Commissioners would be required. A follow-up meeting was held in our offices on May 4, 2011 to further explore the possibility of a new southern access from the mine site and west of the Lone Tree Creek. Staff directed you to contact the adjacent property owners as part of your due diligence prior to moving forward with any application. On April 2011 a letter was submitted to Mr. Peter Hays with the Division of Reclamation, Mining and Safety [DRMS] addressing the Technical Revision to State Permit M1980-002. The letter to Mr. Hays addressed acreages within the permitted boundary and references a revised permitted area for Section 17 with access road and Section 20 with access road. The proposed access from Section 20 onto County Road 17 is not a permitted access through SUP-411, and further there is no road there. County Road 17 ends approximately 950 feet south of the location delineated on the King Surveyors, Inc., Pit Access Description, Exhibit 2 of 2 dated April 6, 2011. The information of a Section Line Access onto a non-existent and non-maintained adjacent road was not provided to DRMS as part of the Technical Revision. doll— 1 43 1 eanintifikaiVlik- &o/3/// PL I'1 '7 A second concern is lack of notification to adjacent property owners adjacent to the permit boundary and adjacent to the improved section of County Road 17. Mr. David Newbold is the property owner for land adjacent to the permit boundary and a second parcel south of the permit boundary. On this second parcel is sited his residence and aerial photography indicates that the structure appears to be relatively close to the road. The Department of Public Works indicates that the current estimated count on this section of road is approximately 10 trips per day. Has Connell Resources contacted Mr. Newbold to discuss their proposed second haul route from the Tucker mine site? This increase volume of traffic may be a concern to Mr, Newbold, the property owner, and also to Mr. Gary Wilson and Terry Grazing Association property owners adjacent to County Road 17 Section Line and also north of and adjacent to County Road 126, two vacant parcels. Given the correspondence to the State, specifically to DRMS, this office has several concerns with the proposed transfer of succession from Varra Companies, Inc. to Connell Resources, Inc. The Technical Revision for M1980-002 is not accurate and will require an amendment. Weld County has reservations with allowing a second access to a mine without the knowledge of adjacent property owners and their approval of said access without a public hearing. Given our concerns as outlined herein, please notify this office of your intentions specific to the points raised. If your intent is to propose a second southerly access, as previously discussed, staff is inclined to allow a proposal to move forward through the Minor Amendment process. This process allows for public notification and comment on the proposal. Should this be the application requested, staff is able to meet with you and provide assistance and direction if required. "rand.Innctinn•Duranao Active and Inactive Min PERMIT#: M-1980-002 INSPECTOR'S INITIALS: PSH INSPECTION DATE: May 6, 2011 Succession of Operator Connell submitted a Transfer of Permit and Succession of Operators Application Form on April 11, 2011 and selected Option B. By selecting Option B, Connell did not waive their right to a 30-day processing period and were required to submit a replacement Financial Warranty for the same dollar amount maintained by the current Operator ($131,400.00). The Division approved the Transfer of Permit and Succession of Operators for the Tucker Aggregate Pit on April 11, 2011. Connell is now the permitted operator of the Tucker Aggregate Pit and Varra Companies, Inc. has been released from reclamation responsibility at the site. The Division is required to recalculate the required reclamation bond within 60-days from the date of the transfer is completed (June 10, 2011). Technical Revision On April 19, 2011, Connell submitted a Technical Revision (TR-04) to change the permit boundaries of the pit in order to mine and reclaim the area in a more resourceful way and incorporate the current disturbance into the permitted acreage. The original total permit acres for the site was 220 acres, however due to the age of the permit file the boundaries were poorly defined. Connell conducted a survey of the site to accurately delineate the permit boundaries and incorporate the current disturbance and future mining areas into a 215.077 acre site. Based on the revised permit boundary submitted in the Technical Revision (TR-04) and the observations from this inspection, the current financial warranty in the amount of($131,400.00) is adequate to reclaim the site per the approved Reclamation Plan. Inspection Observations The Tucker Aggregate Pit is actively mining. A processing plant (crusher) and portable asphalt plant were located at the site during the inspection. Mining is complete in the northern section of the site and the highwalls have been resloped. The asphalt plant was located in this section of the site. Mining restarted in the center of the site and is planned to continue south. Stockpiles of recently stripped topsoil and overburden were observed along the western boundary. Two large and well-vegetated stockpiles of topsoil were located in the northwest corner of the site and will be used to reclaim the northern portion of the site. Additional topsoil and overburden stockpiles are scattered in the middle of the site. The typical soil profile at the site is three (3) feet of topsoil and overburden and seven (7) feet of sand and gravel. An overhead power line is located along the southern permit boundary. A structure agreement for the power line is not on file with the Division. The Operator will need to provide a structure agreement, per Rule 6.5, prior to mining within 200 feet of the structure. Mr. Johnson stated Connell is working on obtaining the required agreement. The mine sign and permit boundary markers were not observed, as required by Rule 3.1.12. Mr. Johnson stated the mine sign would be installed at the entry gate after all permit numbers were issued for the site and the temporary wood lath boundary markers would be replaced with metal posts within 30 days. These issues are noted as a problem at the beginning of this report and will require corrective actions by the Operator.
