HomeMy WebLinkAbout20112376.tiff -P c, C. ✓, Cr — I I WELD COUNTY CODE ORDINANCE 2011-6 IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS, OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to read as follows. CHAPTER 29 BUILDING REGULATIONS Amend Sec. 29-1-20. Definitions. Agricultural building means a structure designed and constructed to house farm implements, hay, grain, poultry, livestock or other horticultural products. This structure shall not be a place of human habitation or a place of employment where agricultural products are processed, treated or packaged, nor shall it be a place used by the public. Amend Sec. 29-2-70. National Electrical Code. The publication of the National Fire Protection Association, known as the National Electrical Code, 2011 Edition, NFPA No. 70-2011, is incorporated by this reference as a part of this Building Code for the purpose of establishing standards for the inspection of electrical installations and issuance of electrical permits in the County, with the following amendments: A and B - No change C. Add Section 250.52 (A) (5) (c): "Two 5/8" by eight foot ground rods shall be installed a minimum of 6 feet apart." PAGE 1 2011-2376 ORD2011-6 Remainder of Section - No change Amend Sec. 29-3-20. Exemptions. A. Exemptions from the permit requirement of this Building Code shall not be deemed to grant authorization for any work to be done in any manner in violation of any of the provisions of this Code, any laws of the State or other resolutions or ordinances of the County. Unless otherwise exempted by this Chapter, separate plumbing, electrical and mechanical permits will be required for the items listed below. B. A building permit shall not be required for: 1 thru 12 - No change 13. Agricultural buildings. a. A certificate of compliance for agricultural exempt buildings is required to be completed, signed and filed with the Department of Planning Services so as to verify setbacks and establish any applicable flood hazard requirements. Remainder of Section - No change PAGE 2 2011-2376 ORD2011-6 BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and sub sections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and sub-sections in said Code. BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 2011-6 was, on motion duly made and seconded, adopted by the following vote on the 19th day of September, A.D., 2011.
