SUBJECT: Clean Energy Bid Proposal Bid
CNG FUELING STATIONS BID NO#B 1000151
Weld County received one bid for CDOT Project AQC C030-040, (17782) to purchase
equipment for the construction of three natural gas fueling stations within the North Front Range
and Upper Front Range TPR's.
The Evaluation Criteria is as follows:
I. Qualifications and specific experience of key team members.
2. Project understanding and approach.
3. Experience with similar types of CNG design/build projects.
4. Proposed project schedule.
5. Demonstrated ability to perform work satisfactorily as confirmed and evidenced by references.
6. Eligibility to participate in contracts for Federal, State, and County funded projects.
7. Proposal Cost and Cost Effectiveness (monetary stewardship of the CMAQ program).
8. Quality and completeness of the proposal.
9. Firm's stability in the industry.
10. Adherence to submission requirements as outlined in this request.
The proposal was not consistent with numbers 2, 7, 8, and 10 of the Evaluation Criteria;
therefore, I recommend we reject the bid from Clean Energy for the following reasons:
1. Total Bid Cost - $2,896,878 Grant Funds Available - $1,335,910 (difference of$1,560,968)
2. Station Locations (Ault, Eaton, Gilcrest)
3. Pricing variation (Difference between County pricing versus Public pricing)
4. CDOT form#606 not submitted at bid opening
5. Ownership uncertainty, numerous locations in the bid does state this project is a design/build
"turnkey" operation, yet the proposal implies Weld County will be the owner.
As a result, I recommend we amend our current contract with CDOT to create three separate
CDOT contracts for each station so we can re-bid each station location separately.

RE: Bid Rejection for Project#17782
Dear Mr. Ott:
Weld County received and opened one bid from Clean Energy for Project #17782 (Weld County Bid#:
B1000151) on January 31, 2011. On February 23, 2011, The Board of County Commissioners reviewed
the bid for fairness and accuracy and recommended the bid be rejected.
The basis for rejection pertains to the mandatory requirement that the bidder submit an Anti-Collusion
Affidavit at bid opening. Clean Energy did not submit CDOT Form 606 (Anti-Collusion Affidavit) with
the proposal at bid opening. Rule 4.13 states, "An individual bid shall be rejected and shall not be read if
the bid is not accompanied by an affidavit relative to collusion." In accordance with the Code of Federal
Regulations, CFR 635.112, which states in part that "each bidder shall file a statement executed by, or on
behalf of the person, firm, association, or corporation submitting the bid certifying that such person, firm,
association, or corporation has not either directly or individually, entered into any agreement, participated
in any collusion, or otherwise taken any action, in restrain to free competitive bidding in connection with
the submitted bid. Failure to submit the executed documents will make the bid nonresponsive and not
eligible for award consideration."
Therefore, it is Weld County's intent to amend our current contract with CDOT to create three separate
CDOT contracts for each station so we can re-bid each natural gas fueling station individually. If you have
