This letter is in response to your comments in your letter dated,September 9,2010.
Regarding the Certificate of Conveyance for the property under review:enclosed.
Regarding the Affidavit of Interest Owners Surface Estate:updated as of October 2,2010 and enclosed.
• Regarding an Access Permit Application Form: This is not applicable.The access is already established. It
was engineered and constructed by CDOT. It is maintained by CDOT on the CDOT ROW.We have no
intention to change,modify,or reconstruct said access.
Regarding the septic system:the septic was reviewed and certified for current use on construction 2000.It
has been reviewed and recertified, September 22,2010,information enclosed. It will not be servicing any
more individuals until the phase 2 construction is completed. At that time,because of the location of the
phase 2 building,the septic field will need to be moved and enlarged to accommodate construction and
additional people. This is all contingent on the economic conditions and application for building permits.
Concerning an updated letter from the State Engineer's Office regarding potable water for the property and
the verification of a GASP contract: I contacted the State Engineer's Office.They informed me that they
will respond only to a direct request from Weld County,for this information.

We are requesting a Special Use Permit for a business commercial junkyard or salvage yard,equipment,
and vehicle service repair.
Proposed use:A business recycling facility including a commercial junkyard or salvage yard,the leasing
and sales of parts,vehicles,and equipment,vehicle service/repair,the storage of vehicles,rvs,trucks,
trailers,and heavy/construction equipment,and the display and sale of carports.
The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in
• effect. Please reference letter from Planning Services,dated June 30,2010,copy enclosed.
We currently have less than 25 people per day using this site. We currently have between I and 3
employees employed at this site,on any day. Hours of operation are 8:30 to 5:00 on Monday through
Friday. We currently have one structure on this site.Fire protection is provided by Mountain View Fire
Protection District,and shown to be in compliance with inspection on July 12,2010.
Water is supplied to the facility from a well with Permit Number 015774-F,enclosed.
Sewage disposal permit and verification,enclosed.
Waste handling plan,enclosed.

Dear Ms. Daniels-Mika:
• We have reviewed the above referenced proposal to add a 2,400 square foot metal building
on the 2.6 acre lot 3, to establish an auto parts/vehicle restoration facility. Water is supplied to
the facility from a well with Permit Number 015774-F which was decreed in Water Court Case
Number W-2849. As stated in our June 11, 1992 letter a well with these uses is subject to
administration during periods of river call.
• The applicants representative has supplied documents indicating that application is being
made to have stream depletions replaced under a contract with the Ground Water Appropriators
of the South Platte (GASP), Once this contract is executed, the well can operate as Jong as the
contract is kept'cu>rent. Based on this new information we have no objection to preliminary
approval of the proposal. Final approval should be withheld until the applicant supplies to you and
to this office a copy of the executed contract with GASP.

CONTRACT • 1
• This is an agreement between Groundwater Appropriators of the South Platte*Ter Besin,Inc.,a Colorado
non-pofit corporation (hereinafter called "GASP"), and the undersigned party (hereinafter called "the party
of the second part").

RECITALS
1. GASP represents that It'Is a Colorado non-profit corporation and that its irtmary purpose is the ac-
quisition and development of augmentation water for persons owning, controlilng,I or operating wells in the
South Platte River Valley,reducing the necessity for state regulation of their we] thereby protecting the
economy which it dependent upon those wells and increasing the benefice) use of pze water available in the
South Platte River Basin. (((•
2. The party of the second part represents that he Is a resident of the State of rado,that he owns,con-
trols or operates the wells listed on the attached well data sheet and that he d hres a share of the augmen-
catito water and benefits of the program for protection of his listed wells.

1. The party of the second part requests that the wells described on the well data sheet be registered in

3. With respect to each well registered In is augmentation plan, GASP agrees,to use its best efforts to
develop, put into effect and have accepted by the State Engineer a plan which will minimize the need for regu-
lation of the well by the State Engineer during the calendar year a .. and to provide the owner of such well
with a share of the augmentation water which GASP develops, for use by such iwner in the protection of
• his well from!.egulation. Nothing In this agreement shall require GASP to initiatd or defend actions In con-
nection with any augmentation plan Cr in connection with the rights of any w11 owner,or to bear the cost
of any proceedings.
• 9.' GASP will use its best efforts to allocate to each well which it accept,'for registration,an equitable share
of any benefits to be derived from the plan. However,it Is understood that the benefits which are allocated to
each well will depend on a number of factors,Including the number and location of hells which ate accepted for
' registration.
5. Neither this contract nor any benefits which may accrue to the party•of.hie second part hereunder
may be assigned to any other party or any other well, without the express written,consent of GASP.

Janet,
Here are the calculations to include with your submittal. The volume you need is about 1,600-
1,700 cubic feet. If you make your depression 1 foot deep then you could use a rectangular area
of 40x40 or you could do a skinny one along your property line that is 2 feet deep and 20x40.
You can adjust the rectangular area(water quality features should be 1-2 feet deep)to whatever
will fit the best into your site downstream of your operations area as long as it meets the volume
of 1,600-1,700 cubic feet. Please show the area on your site plan and label it as "Water Quality
Feature,No Build or Storage Area". Please let me know if you have any additional questions. I
will be available Friday but I'll be out of the office next week. If you need assistance next week
you can call and ask to speak to Clay Kimmi, our drainage engineer.

Here are the calculations for the Water Quality Depression. I've written
the steps on the 3rd page. Your areas don't need to be exact,just an
estimate. The depression should be downstream from your parking/operations
area. Make the depression work for you, if it fits into your site to have a
long skinny rectangular depression along your property line then that is

To assess undermining for planning purposes,a useful first step is to consult maps of the Boulder-Weld State Geologist
coal field that were prepared by the Division of Mined Land Reclamation and are depicted at a scale of and Director
linch equals 200 ft.
If it is found that an area is undermined, a determination should be made to confirm that the mine maps arc
accurate,and that subsidence has occurred (and to what degree)- The appropriate mine map must be
obtained to plan the subsurface investigation. A description of the mine, as it relates to the subject
property, should be provided, e.g., entryways and air shafts should be identified,and the type of mine
operation shouldbe discussed, If mines were operated through room and pillar extraction,the dimensions
of the rooms and pillars should be mentioned.
Based on the mine layout, drillhole locations should be chosen,both to confirm the accuracy of the map
and to document the subsidence. Drillholes must be advanced through the mined section,which may be as
•
deep as 400 ft below ground level. A Ethological and geophysical log should be provided for each
drillhole. A geolograph,which records drilling ft/minute, is very useful for determining void space.
Geophysical logging should include a caliper tool for a confirmation of subsurface void space.
The report that is prepared after drilling is completed should include a description of units encountered in
the drillholes,plus a drillhole-by-drillhole discussion of lithologies, whether circulation was lost and where,
and how complete collapse of the mine workings was,based on void space that was found.
Lastly, the report must supply a strain analysis based on what has been developed by the United Kingdom
National Coal Board.* Because most of the work in the UK was long wall mining,modifications must be
made to adapt the analysis to abandoned room and pillar mines. The theoretical strains resulting from
subsidence can then be used to estimate the magnitude of the soil pressures on below-grade walls, and
whether these pressures would cause failure.
Other procedures for evaluating subsidence potential besides using the National Coal Board equations
include using models or statistics. These methods may be valid if the initial assumptions are correct. Please
