WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 19 , 1979 at 2 :00 o 'clock p.m. , the Board of County Commissioners of Weld County, Colorado held a hearing to consider the request of Continental Pipeline Company, P. O. Box 728, Cheyenne, Wyoming 82001 , for an amendment to Special Use Permit No. 187 , and WHEREAS, the applicant has requested an amendment to Spe- cial Use Permit No. 187 for an oil storage facility located on a tract of land described as follows : A parcel of land located in the Northwest Quarter of Section 2 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, said parcel being more particu- larly described as follows : Beginning at a point on the North line of said Northwest Quarter, Section 2 , from whence the Northwest Corner of said Sec- tion 2 bears North 89°25 ' 51" West, 30 .00 feet and with all other bearings contained herein relative thereto; thence South 89°25 ' 51" East, 208 . 7 feet; thence "South" , 238. 7 feet; thence North 89°25 ' 51" West, 208. 7 feet; thence "North" , 238. 7 feet to the point of beginning; thus described tract containing 1.144 acres . Excepting therefrom a 20-foot wide strip of land lying along and included within the South and East boundaries of the above described parcel, said strip to be used as an irrigation ditch easement. WHEREAS, the Board reviewed the testimony of the applicant and of all others present, and reviewed the recommendations of the Weld County Planning Commission, and having been fully informed, is satisfied that the request for an amendment to Special Use Permit No. 187 should be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Special Use Permit No. 187 be, and hereby is, amended for an oil storage facility PL0753 790340 as set forth in the recommendations of the Weld County Planning Commission dated August 7 , 1979 and is subject to the Develop- ment Standards contained in the Special Use Permit. BE IT FURTHER RESOLVED by the Board that the findings of fact and reasons for approval contained in the Planning Commis- sion recommendations be, and hereby are, adopted by the Board of County Commissioners. City of Fort Lupton Planning Commission B. Colorado Oil and Gas Commission C. Weld County Health Department D. Colorado Geological Survey E. Weld County Engineering Department F. Town of Frederick Recommendations of the referral entities are addressed or included in the attached Development Standards. The Planning Commission recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and approved for the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. 3. The Special Use Permit plat being amended to show the asphalt drive and paved areas on the plat. Continental Pipeline Company SUP DEVELOPMENT STANDARDS 1. The permitted use on the hereon described parcel of land shall be a crude oil truck unloading facility; and, a transfer facility to receive pipeline gathered crude into the facility and deliver crude via underground pipeline to Continental Pipeline Company ' s mainline injection station at Fort Lupton. Facilities shall be limited to those shown hereon. 2. There may be two automatic transfer (A.C.T. ) units at the site. Each A.C.T. unit shall consist of a strainer, a meter, and an automatic sampler together with necessary valves, piping, and related appurtenances. One 500 bbl tank will be installed for each A.C.T. unit into which all trucked crude will be unloaded prior to movement through the A.C.T. units. 3. An existing paved apron complete with catch basins shall be placed in the area of the unloading activity so as to gather and contain any oil which is lost during unloading operations. 4. The aboveground piping and equipment at the facility shall be enclosed by a six-foot chain link fence topped with three strands of barbed wire. 5. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 6. All accesses to the Special Use Permit area shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 7. One (1) existing 5, 000 barrel crude oil storage tank and two (2) 500 barrel crude oil storage tanks may be located at the facility in order to accommodate- truck unloading volumes, as well as volumes to be transferred from the permit area to Continental Pipeline ' s Fort Lupton Station. 8. Transfer pumping equipment may consist of the following: a) Two (2) 200 horsepower electric motors necessary to drive two vertical centrifugal pumps may be installed for transferring crude oil from the 5M bbl tank via pipeline to Continental Pipeline ' s Fort Lupton Station. �iw l (b) Four (4) 15 horsepower electric motors necessary to drive four horizontal centrifugal pumps may be installed in conjunction with pumping crude from the trucks to the two 500 bbl tanks and subsequent pumping from the two 500 bbl tanks through the A.C.T. units. 9. The hauling of crude oil by trucks to the facility shall essentially be limited to daylight hours, with exceptions occurring during possible emergency situations. 10. An earthen dike shall be constructed around the existing storage tank to ensure containment of any possible oil spills and exclusion of any foreign fluids from adjacent property. This dike will also serve as containment for the two proposed 500 barrel tanks. 11. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting, maintenance and weed control. 12. Aluminum fence lattice shall be interwoven with the existing six-foot chain link fence around the facility to provide property landowners with visual screening. 13. The facility shall comply with all State and County Health Standards and Regulations pertaining to air quality, water quality, noise emission and sanitary disposal systems. 14. Safety and fire protection will be as prescribed by the Ft. Lupton Fire Protection District and Industry Standards and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 15. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 74 'l ® gj Comments : 1 . The Platte Valley Soil Conservation District has sent a letter regarding this request. A copy of the letter dated April 17, 1979 is in the attached packet. 2. Our office has received letters of opposition from 2 adjacent property owners regarding this request. Both parties are concerned with the potential safety hazards of such a facility. Copies of the letters are in the attached materials . 4' The Weld County Plai____ng Commission held a schc__led meeting on August 7 , 1979 in the Weld County Centennial Center County Commissioners Hearing Room, first floor, Weld County Centennial Center , 915 10th Street, Greeley, Colorado. Chairman Carlson welcomed two members to the Planning Commission being Don Billings of Platteville who replaced Percy Hiatt and Bob Ehrlich of Milliken who replaced Ben Nix. He then called for a motion to approve the minutes of July 17 , 1979. Jim Gilbert made a motion to approve the minutes as presented. His motion was seconded by Frank Suckla. All present cast a unanimous vote of "aye" to approve them as presented. APPLICANT: Gary Merideth CASE NUMBER: N/A SUBJECT : Amend Sundown Planned Unit Development LEGAL DESCRIPTION: Pt. SW, SWk, Section 3 , T5N, R66W LOCATION: Northeast corner of 59th Avenue and U. S . Highway 34 Business APPEARANCE : Gary Merideth DISCUSSION: Mr. Merideth stated that he desires to change the present use to an athletic club comprised of a raquetball/handball facility of 10 courts and a health club containing an exercise, sauna, steam and whirl- pool area. He stated that the usage will be somewhat less in terms of traffic density because of the use and there will also be fewer employees . There being no questions at this time Tom Honn read the Planning Staff' s recommendation for approval . Chairman Carlson asked if the front half of the property will remain the way it was originally proposed. Mr. Merideth responded that the front half of the property would be vacant land. There are presently no plans for any use of this property at this time. Bob Freemen of Colorado Interstate Gas Company then read a letter " from the Land Department of Colorado Interstate Gas regarding their concern for public safety, health and welfare because CIG owns a 50 foot wide natural gas pipeline right-of-way running north to south through the Planned Unit Development. Within this right-of-way are two high pressure natural gas pipelines . In order to maintain, repair and operate these pipelines they asked that the Planning Commission not approve construction of buildings, roadways or paved parking areas on top of these pipelines . Discussion followed. Mr. Merideth stated he was aware of these pipelines and could foresee no problem in the future with it. APPLICANT: Weld County Disposal , Inc. CASE NUMBER: SUP-396 : 79 :18 SUBJECT: Amend SUP-319 :76 : 24 - Oil Field Fluids Recycling and Disposal Site LEGAL DESCRIPTION: Pt. NW4 NW4j Section 12, T1N, R66W LOCATION: 2 miles east and Z mile south of Fort Lupton DISCUSSION: Tom Honn stated that the applicant has requested this application be continued to the August 21 , 1979 Planning Commission meeting because the applicant needs to submit additional information to the Colorado Department of Health Water Quality Control Division. The information was requested in an attempt to comply with a Notice of a Violation and Cease and Desist Order issued to the operation on March 20, 1979 by the Colorado Department of Health. The Planning Staff' s recommendation reflected this request for continuation. MOTION: Be it therefore resolved to recommend the application be continued to the August 21, 1979 Planning Commission meeting based on the Planning Staff' s recommendation. APPLICANT: St. Vrain, Ltd. CASE NUMBER: SUP-397 : 79 :19 SUBJECT: Open Cut Mining Permit for Sand and Gravel Extraction LEGAL DESCRIPTION: Pt. Section 9, T2N, R68W LOCATION: 5 miles south of Mead APPEARANCE: John Haines DISCUSSION: This request for sand and gravel extraction will be on property containing 292 acres of which approximately 135 acres will be mined. The end result of the operation will be a private recreation area. Land use in the area is primarily agricultural with a very small amount of counuiercial-industrial activity scattered throughout. By use of maps , Mr. Haines was able to show the various stages of reclamation, etc. He also stated the area is in a floodplain and flood storage area of the creeks . Access to the site will be on County Road 7 which is a paved road. Some nesting fowl could be displaced during the operation; however, the ponds from the operation will provide nesting for waterfowl and more lakes . Truck traffic will be approximately 100 trucks per day. Some discussion followed. Tom Honn then read the Planning Staff ' s recommendation for approval, the Development Standards and the comments . • . Planning Commission 1 ates Page 3 August 7 , 1979 Chairman Carlson then asked if anyone wished to speak favorably or unfavorably regarding the request. At this time Morton Latovsky in representing William Englehart of Temperature Processing Company stated that his client is opposed to the operation for several reasons , these being: dust; increase in insect population; his well water level will be decrease because of evaporative loss in the four ponds that will be created during the operation; who is responsible for reclamation; there are too many gravel pit operations in the area already and that access to the site will go within 70 feet of Mr. Englehart' s property. However, one of the conditions is that it will be limited to 125 feet. He also stated he was unable to find any record of a current trade name affidavit for St. Vrain, Ltd. Mr. Englehart then went into further detail the items expressed by Mr. Latovsky. He especially wanted it made clear that he owns the property between Pits 3 and 4 which is where the access road would go through. Rosie Heaton was opposed to it because she feels there will be a real problem with hunters and dogs on her property. Trees will also have to be destroyed in the process . W. G. Richards stated he already has a problem with kids swimming in ponds surrounding his property. He was concerned about who will be responsible if someone drowns . Russ Anson responded that it depends entirely upon the circumstances . Ward Burrett stated he was opposed because the roads will be deteriorated and thee are already too many gravel pits in the area. Dorothy Larson stated her property value will be decreased, there will be pollution, and the roads will deteriorate. Some discussion again followed. MOTION : Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the Planning Staff' s recommendation. Also with the condition that the boundary survey be amended to show the 60' access strip owned by Temperature Processing Company and the access moved so that it does not cross said 60 foot access prior to the Board of County Commissioners hearing. Motion by Jim Gilbert, seconded by Bette Kountz. A vote of "aye" was cast by Don Billings , Fred Otis , Chuck Carlson, Jim Gilbert, and Bette Kountz. A vote of "no" was cast by Frank Suckla and an abstention vote was cast by Bob Ehrlich. Motion carried. NW4 NW4, Section 34, T3N, R66W LOCATION: 1 mile south and 22 miles east of Platteville APPEARANCE: Richard Lomkin DISCUSSION: Mr. Lomkin stated he wishes to have a dairy operation consisting of approximately 400 cows . His property contains 20. 9 acres of which 4 to 5 acres will be used for the dairy operation. There being no questions at this time, Tom Honn read the Planning Staff' s recommendation for approval, the Development Standards and the comments. Some discussion followed regarding the access . Mr . Ehrlich questioned whether the pen size for each cow was designed according to regulations and adequacy of the facility for waste disposal. NW4 NW4j Section 2, T1N, R67W LOCATION : Southeast of the intersection of County Roads 21 and 14 APPEARANCE : Steven Theede 1 DISCUSSION: Mr. Theede stated they Continental Pipeline Company 1`1 wants to have a crude oil truck unloading facility and a transfer 1, facility to receive pipeline gathered crude into the facility for subsequent delivery by pipeline to their Fort Lupton station to increase the accuracy of measuring receipting volumes from truck transports . m Three conditions on the original Special Use Permit were : 1) There would be no night loading; 2) Visual screening of the area; 3) An asphalt type driveway must be installed for access and egress from the, facility. In regard to night loading, Mr. Theede stated that electrical lock-out equipment has been installed on the pump units which cuts power from 8 : 00 p.m. until 6 : 00 a.m. This virtually eliminates night hauling. An aluminum type lattice screening has been installed to screen equipment in the facility. He also stated that an asphalt access has also been installed. A 5, 000 barrel tank is presently at the facility to receive crude oil from the pipeline and to receive crude ,' oil from trucks . They wish to install an additional two 500 barrel ', ' tanks to increase efficiency at the facility. Tom Honn then read the Planning Staff ' s recommendation for approval, the Development Standards and the comments . Chairman Carlson then asked if anyone wished to express their opinion favorably or unfavorably regarding the request. At this time Mr. and Mrs. Jack Berger expressed their opposition because they feel the facility is not safe if the tanks were to explode as condensate is mixed with the oil and could cause a safety problem. They feel the facility is too close to homes in the area to be safe if there was a fire or explosion. Mr. Gilbert stated that they are in compliance with their permit now and assured them they are concerned too about the safety of people in the area if there was an explosion. ' Discussion followed. MOTION: Be it therefore resolved to recouuuend approval with the Development Standards to the Board of County Commissioners based on the Planning Staff' s recommendation. Honn stated that the Board of County Commissioners recently received a letter and a copy of the application for site approval of a new sewage treatment facility for the Erie Water and Sanitation District. The application is the same application that was attached to the Special Use Permit request approximately one year ago for a sewage treatment facility which was denied by the Board of County Couunissioners . The Planning Staff recommends that the Planning Commission authorize the Chairman to sign for disapproval of the request. Discussion followed regarding this request. Although no motion was made for the Chairman to sign for disapproval , the Commission did authorize him to do so. There being no further business , the meeting was adjourned. It is the opinion of the Department of Planning Services staff that the requested changes do not substantially differ from the original Special Use Permit approved by the Board of County Commissioners on May 17, 1973 . 2 . It is the opinion of the Department of Planning Services staff that this proposed operation is in compliance with the provisions of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the 'neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the County. Transfer pumping equipment may consist of the following: a) Two (2) 200 horsepower electric motors necessary to drive two vertical centrifugal pumps may be installed for transferring crude oil from the 5M bbl tank via pipeline to Continental Pipeline ' s Fort Lupton Station. (b) Four (4) 15 horsepower electric motors necessary to drive four horizontal centrifugal pumps may be installed in conjunction with pumping crude from the trucks to the two 500 bbl tanks and subsequent pumping from the two 500 bbl tanks through the A.C.T. units. 9. The hauling of crude oil by trucks to the facility shall essentially be limited to daylight hours, with exceptions occurring during possible emergency situations. 10. An earthen dike shall be constructed around the existing storage tank to ensure containment of any possible oil spills and exclusion of any foreign fluids from adjacent property. This dike will also serve as containment for the two proposed 500 barrel tanks. 11. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting, maintenance and weed control. 12. Aluminum fence lattice shall be interwoven with the existing six-foot chain link fence around the facility to provide property landowners with visual screening. 13. The facility shall comply with all State and County Health Standards and Regulations pertaining to air quality, water quality, noise emission and sanitary disposal systems. 14. Safety and fire protection will be as prescribed by the Ft . Lupton Fire Protection District and Industry Standards and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 15. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. Comments : 1 . The Application for a Special Use Permit was withdrawn pending compliance with previously agreed to requirements. To this end, a threefold project was under- taken and has been satisfactorily completed. First, all night unloadings at Spindle "A" were terminated immediately following the meeting of May 15. To ensure that this provision would be strictly adhered to in the future, a time clock was installed to prevent any unloading equipment from operating between the hours of 8 PM and 6 AM. Only under emergency conditions will night unloading be permitted at Spindle "A" , and then only with the previous approval of Continental Pipe Line. Secondly, fence lattice has been in- stalled to block the view of the public from the pumping equipment. Finally, the gravel drive has been replaced by an asphalt drive extending to the county road on each of the facility' s two entrances. We believe Continental Pipe Line has now, in good faith, complied with all previous permit requirements and request approval for revisions to these facilities. Further, we believe the revisions requested will reduce the activity at Spindle "A" and improve its appearance. The facility will continue to be automated. Staff employees, based at CPL' s Ft Lupton Pump Station, will maintain and supervise the operations at the un- loading facility. There will be no personnel physically assigned to the Spindle A Station, thereby, eliminating the need for a water supply or a sewage disposal system. Under current operations, transport operators unload their contents directly into an Automatic Custody Transfer (A.C.T. ) Unit for measurement. Each A.C.T. Unit consists of a strainer, a meter, and an automatic sampler, together with necessary valves, piping, and related appurtenances. From the A.C.T. Unit, the crude is pumped into the 5000 barrel tank for subsequent delivery, via underground pipeline, to Continental Pipe Line Company' s mainline injection station at Ft Lupton. With the proposed modifications, transport operators will make the necessary connections to the facility to unload and pump their contents directly into designated, breakout tankage. This tankage will allow the crude to settle and weather before it is to be measured automatically. Once the crude in the tank reaches a predetermined level, a pump will automatically initiate the transfer of volumes from that tank, through the Automatic Custody Transfer Unit for measurement, and into the existing 5000 barrel tank. The required modifications will include the complete re- moval of an existing A.C.T. Unit, the relocation of one A.C.T. Unit, the construction of two 500 barrel tanks, and the instal- lation of two truck unloading pumps . The revised facility will reduce the current number of companies unloading at Spindle A, as well as the number of truck meter manifolds to only two. The resulting effect on the operations of the Spindle A Station will be twofold: 1) An overall decrease in unloading and truck traffic of approximately fifty-six percent, and, 2) Night unloading will essentially be eliminated except in emergency situations . Since the total thruput at the Spindle A-Spindle B Stations will remain unchanged as a result of the proposed modifications, vapor emissions in the Spindle area will not differ significantly from emissions currently experienced. The location of two 500 barrel tanks will be inside the existing earthen dike to ensure containment of any possible oil spill from adjacent property. Continental Pipe Line Company Special Use Permit Page Two The facility is currently designed to eliminate the hazard of ground water pollution through the use of a paved apron in the vicinity of the unloading activity complete with catch basins which will gather and contain any oil which is inadvertently lost during unloading operations. The aboveground facilities at the site will continue to be enclosed by a six-foot high chain link fence with three strands of barbed wire for safety and security. JKP-mlc 3-5-79 , CONTINENTAL PIPE LINE COMPANY-SUP PROPOSED DEVELOPMENT STANDARDS 1) The permitted uses on the parcel of land described by the attached drawing: a) A crude oil truck unloading facility; and, b) A transfer facility to receive pipeline gathered crude into the facility and deliver crude via underground pipeline to Continental Pipe Line Company' s mainline injection station at Ft Lupton. 2) There is no need for sewer or water service for the permitted use. 3) There shall, at the present, be two automatic custody transfer (A.C.T. ) units at the site. Each A.C .T. unit shall consist of a strainer, a meter, and an automatic sampler together with necessary valves, piping, and related appurtenances. One 500 bbl tank will be installed for each ACT unit into which all trucked crude will be unloaded prior to movement through the ACT units. 4) An existing paved apron complete with catch basins has been placed in the area of the unloading activity so as to gather and contain any oil which is lost during un- loading operations. 5) The aboveground piping and equipment at the facility shall be enclosed by a six-foot chain link fence topped with three strands of barbed wire . 6) The conditional use permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 7) Access to the SUP area shall be limited to the one access point off County Road 21. The traffic pattern at the facility shall be one-way only. 8) At the present, one (1) existing 5000 barrel crude oil storage tank and two (2) 500 barrel crude oil storage tanks will be located at the facility in order to accom- modate truck unloaded volumes, as well as volumes to be transferred from the permit area to Continental Pipe Line' s Ft Lupton Station. 9) Transfer pumping equipment will consist of the following: a) Two (2) 200 horsepower electric motors necessary to drive two vertical centrifugal pumps are installed for transferring crude oil from the 5M bbl tank via Continental Pipe Line Company-SUP Proposed Development Standards Page Two pipeline to CPL' s Ft Lupton Station. b) Four (4) 15 horsepower electric motors necessary to drive four horizontal centrifugal pumps will be installed in conjunction with pumping crude from the trucks to the two 500 bbl tanks and subsequent pumping from the two 500 bbls tanks through the ACT units. 10) The hauling of crude oil by trucks to the facility shall essentially be limited to daylight hours , with exceptions occurring during possible emergency situations. 11) An earthen dike has been constructed around the existing storage tank to ensure containment of any possible oil spills and exclusion of any foreign fluids from adjacent property. This dike will also serve as containment for the two proposed 500 barrel tanks. 12) The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting, maintenance, and weed control . 13) Aluminum fence lattice will be interwoven with the existing six-foot chain link fence in designated areas around the facility to provide property landowners with visual screening. 14) The facility shall comply with all State and County Health Standards and Regulations pertaining to air quality, water quality, and noise emission. Located that close to homes creates a definite safety hazard. March 23, 1979 To The Weld County Planning Commission: In reply to your letter of ?March 21, 1979, we strongly object to having any more tanks placed on the land located Southwest of the intersection of County Roads 21 and 11i. There are three homes close by the tank, two within 250 feet and the other one within 300 feet. These people are in danger of fire or exolosions from the trucks hauling there. The material they are hauling is crude oil and condensate which is highly flammable. We would perfer to have the tank moved that is therenow, due to the danger to the people who live near the tank. The tank should be at least 3 mile away from all buildings. They are also in violation of the agreement made at past hearings, one being not to haul any oil after dark but they are hauling around the clock. Being the tenant of the surrounding land of which I farm, and living within 300 ft. of the existing storage facilities, and also having two houses in which hired help reside within 300 ft. of the site, which is less than one acre of ground, I strongly object to any further enlargement of the capability of storage at this facility. In my opinion, it should never have been allowed to be built that close to the road and dwellings in the first place. At this facility, they not only deliver and store crude oil but condensate as well, which is, in some cases, as flammable or if not more flammable, than some gasolines. For these reasons and many more, I am objecting to the facility. Enclosed is an article from the Greeley Tribune of March 23, 1979. Notice the direction of the wind. It seems that every other month, we see something in the paper of this nature. I feel this facility is nothing more than a time bomb, waiting to go off. I feel that Continental Pipeline Company slipped this facility in while the county and we were in the dark. I'm sure that there are limitations and guidelines within other counties and states that would have prevented this facility from being built in the first place. The facility was built before a permit was issued, which seems to be the way Continental Pi3eling Company operates. They will offer something in black and white, and then they try to get out of it . If you have the time and money, you may ge:, something close to what you agreed to in the first place. 4; y 4 page 2 To substanstiate these claims, other than my own, I would suggest that you refer to Speci .l Use Permit No. 187 and the tapes of the Board of County Commissioners' public hearings, April 9, 1973 and May 9, 1973, on Special Use Permit, No. 187, espe- cially section three. That was also brought up in SUP 324,.:76 :79 dated Dec. 7, 1976, none of which stipulations have been met to date. I am sure that within six years a person or company should have had ample time to meet the requirements if they wanted to. But in my opinion, their commitment is worth nothing more than the paper it is written on. For these reasons, and reasons brought forth in earlier hearings, and for the aake of my family and the tenants in the nearby houses, I ask you to decline the amendment to SUP 187:73 :2, and see that the entire facility be taken out.
