Am-USR#1002)
Dear Mr. Hill:
This letter agreement concerns the issuance of building permits for construction by Encana Natural Gas
Inc. ("Encana"), of a gas compressor,storage vessels, and natural gas fueling dispenser(collectively
referred to herein as "the Structures") within the future right-of-way("ROW")for Weld County Road
("WCR") 22 and the associated setback at 16157 CR 22, Ft. Lupton, Colorado. The Structures, as
proposed, will be situated no more than 50 feet from the centerline of the road. Because the future
ROW for this stretch of WCR 22 is 140 feet (70 feet on each side of centerline), the required setback for
the Structures would be 90 feet from centerline (70 foot future ROW plus 20 foot setback). Thus, at 50
feet from centerline, the Structures will be located within the setback and the future ROW. With this in
mind, Weld County cannot issue building permits for construction of the Structures if they are
permanent in nature. It is my understanding, however,that the Structures will be temporary.
Additionally, Encana has agreed that it will remove the Structures at its sole cost from the future ROW
and setback if and when Weld County notifies Encana that the future ROW for WCR 22 is needed and
will be constructed. Your signature below will acknowledge the agreement by Encana.
