RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#1104-GUY GRIGSBY
AND AMY FIELING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 21, 1996, the Board approved a Site Specific
Development Plan and Use by Special Review Permit#1104 for a single family dwelling unit on a lot
less than the minimum lot size in the A(Agricultural) Zone District for Guy Grigsby and Amy Fieling
on the following described real estate, to-wit:
Located in the NW1/4 of Section 33, Township 2
North, Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Guy Grigsby and Amy Fieling, 6870
County Road 5, Erie, Colorado 80516, to vacate said Use by Special Review Permit#1104, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#1104 be, and hereby is, vacated.

The Department of Planning Services has received the attached letter dated May 25, 2011 from
Guy Grigsby and Amy Fieling. They are requesting that USR-1104 be vacated from their parcel,
1313 33 200008 since RE-5065 has satisfied the condition of the Use by Special Review.
Background information:
Legal Description: Lot B of RE-3176 being part of NW4 of Section 33, Township 2 North, Range 68
West of the 6th P.M. Weld County, Colorado
Location: East of and adjacent to CR 5 and North of State Hwy 52
USR-1442: USR-1104 was approved by the BOCC on February 21, 1996, for a Site
Specific Development Plan and Special Review Permit to allow a single
family dwelling on a parcel of land less than the minimum Lot size in the in
the A (Agricultural) Zone District.

FOR A SINGLE FAMILY DWELLING UNIT ON A LOT LESS THAN THE MINIMUM LOT
SIZE IN THE A(AGRICULTURAL)ZONE DISTRICT-GUY GRIGSBY AND AMY FIELING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 21st day of
February, 1996, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Guy Grigsby and Amy Fieling, 939 Alta Street, Longmont, Colorado 80501, for a
Site Specific Development Plan and Special Review Permit#1104 for a single family dwelling unit
on a lot less than the minimum lot size in the A(Agricultural)Zone District on the following described
real estate, to-wit:
Located in the NW%of Section 33,Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, Guy Grigsby, applicant, was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for
review of said Special Review Permit, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having been
fully informed,finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows:
a. This proposal is consistent with the Weld County Comprehensive Plan's
Urban Growth Boundary Area Goals and Policies. The Urban Growth
Boundary area section provides for the County to encourage land-use
development proposals as long as they conform to the desires of affected
municipalities. This land use is located in the Urban Growth Boundary Area
of the Tri-Area Planning Commission.
b. This proposal is consistent with the intent of the A(Agricultural)Zone District
and is provided for as a Use by Special Review.
c. No overlay districts affect this site.
d. Special Review Permit Development Standards will provide adequate
protection of the health,safety,and welfare of the neighborhood and County.
