Per Weld County Drainage Criteria Addendum Section 5. 5, development is required to obtain written permission from local irrigation ditches to release stormwater into a ditch. Please obtain written permission for the release of Detention Pond 2 into the Home Supply Ditch. The following comments shall be addressed with the Final plat application: • 1. Please provide a written agreement with the power company to move the overhead line. 2. Easements shall be shown on the final plat in accordance with County standards (Sec.24-7-60) and / or Utility Board recommendations. 3. Intersection sight distance triangles at the development entrance will be required. Department of Public COLORADO • Health and Environment CASE NO.: PZ-1140 NAME: Merino Conservation Group The Weld County Health Department has reviewed this proposal. The applicant proposes a 9 lot PUD on 34.5 acres. The minimum lot size of 2 acres, coupled with the overall density of one septic system per 3.8 acres does meet current Department policy. The application has satisfied Chapter 27 of the Weld County Code in regard to water service. A letter of commitment to serve the 9 lots was received from Little Thompson Water District. The Weld County Attorney has also approved the water service commitment. • The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer will be provided by individual sewage disposal systems. No new percolation data has been submitted since the Sketch Plan application. The sketch plan comments are reiterated here: Preliminary information in the geotechnical report conducted by Northern Colorado Geotech, dated October 3, 2006 and submitted in the application, indicates that most of the site is expected to be suitable for conventional septic systems. A weathered sandstone layer was identified at between 10 and 11 feet. This impermeable layer may cause a perched and/or trapped water table to occur over time, causing some septic systems to be engineered. This Department is not requiring septic system envelopes on the lots. The envelopes indicated on the change of zone plat can be removed. The initial impact plan (section 27-6-40), in the application materials, adequately addresses all impacts. The application indicates that the perimeter trail has been removed and replaced with a nature trail. It appears that lots 7, 8, 9 and 1 do not have direct access to the nature trail and the road would be utilized to walk to the trail. As there is a chance to connect adjacent trails in the future and to promote walkability of the neighborhood, all lots should have direct entry to a trail system. We strongly encourage the developer to design the trail system so there is • direct access for all lots. • The Department recommends approval with the following conditions, which should appear as notes on the change of zone and final plats, (except for#7 which shall be included in the covenants): 1. Water service shall be obtained from Little Thompson Water District 2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. • 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. 8. As stated in our letter from February 2, 2009, policy BSM 85/05-003, Fire Protection, section VI, Fire Hydrant Locations, Distribution and Specifications, are still in effect. We had decided a single fire hydrant was sufficient for the development. The location of the hydrant on the site plan is also sufficient. At this point no information on the size of the • structures on the estate lots has been submitted. We recommend the developer seriously consider running an addition water line into the development, separate from the domestic water line to accommodate NFPA 13D residential sprinkler systems. Policy BSM 85/05-003, section V, describes Fire-Flow Requirements for Buildings. One and two family dwellings less than 3600 square feet require a minimum fire flow and duration of 1000 gallons per minute. This is water available from the fire hydrant to fight fire. Fire flow and duration for residential dwellings in excess of 3,600 square feet shall not be less than specified in Table B105.1. (Policy attached). It has been confirmed that there is not adequate infrastructure for the developers to install fire hydrants as previously • shown on the site plan. The revised drawing shows that the fire hydrant has been removed. The lack of adequate fire flow indicates only one solution; installation of approved NFPA 13D residential sprinkler systems in all structures. Section II Fire Protection 2.1 Definitions a) The fire area is the floor area, in square feet, used to determine the required fire flow. b) Fire flow is the flow rate of a water supply, measured at 20 psi (137.9KPa) residual pressure; that is available for firefighting. Section III Modifications 3.1 Decreases. Fire-flow requirements may be modified downward by the chief for isolated buildings or a group of buildings in rural areas or small communities where development of full fire-flow requirements is impractical. 3.2 Increases. Fire-flow requirements may be modified upward by the chief where conditions indicate an unusual susceptibility to group fires or conflagrations. An upward modification shall not be more than twice that is required for the building under construction. Section IV Fire Area 4.1 General. The fire area shall be the total floor area of all floor levels within the exterior walls, to include below ground floors and the • garage, and under the horizontal projections of the roof of the building, except as modified in Section 4.2. 4.2 Area Separation. Portions of buildings which are separated by one or more four— hour area separation walls constructed in accordance with the International Building Code 2006 Edition , without openings provided with a 30 — inch (762 mm) parapet, are allowed to be considered as fire separate fire areas. 4.3 Type I and Type II-F.R. Construction. The fire area of buildings constructed of Type I and Type II-F.R. construction shall be the area of the three largest successive floors. tillatriP Fire-Flow Requirements for Buildings 5.1 One and Two Family Dwellings. The minimum fire flow and flow duration requirements for one and two family dwellings having a fire area which does not exceed 3,600 square feet (344.5 m2) shall be 1,000 gallons per minute (3785.4 L/min). Fire flow and flow duration • for dwellings having a fire area in excess of 3,600 square feet (344.5m2) shall not be less than that specified in Table B105.1 page # 394 Exception: A reduction in required fire flow of 50 %, as approved, is allowed when the building is provided with an approved automatic sprinkler system. 5.2 Buildings other than One and Two Family Dwellings. The minimum fire flow and flow duration for buildings other than one and two family dwellings shall be as specified in Table B105.1. Exception: A reduction in required fire flow of up to 75 %, as approved, is allowed when the building is provided with an approved automatic sprinkler system. The resulting fire flow shall not be not less than 1,500 gallons per minute (5677.5 L/min). • Section VI Fire Hydrant Locations, Distribution and Specification as Modified 6.1 Fire hydrants installed within the District shall meet the following: a) Fire hydrants shall be A24015 Mueller improved, A423 AWWA Mueller Centurion or approved equal. b) Hydrants shall have a 5 '/ "or larger valve opening, two 2-1/2" hose nozzle, one pumper nozzle and a 6" or larger mechanical joint. c) Nozzles shall have National Standard threads and shall be of traffic hazard type with safety features which will prevent barrel breakage. d) Operating nut, studs and cups shall be 1" square or pentagon and open right. • e) Single and two family dwellings shall have fire hydrants spaced so that no structure shall be more than 400' from the fire hydrant as measured via the street. Fire hydrants shall not be spaced more than 800' apart. 0 Multi-family (higher density than one and two family dwellings) shall have fire hydrants spaced so that no structure shall be more than 400' from a fire hydrant as measured via the street. Fire hydrants shall not be spaced more than 800' apart. g) Commercial and industrial developments shall have fire hydrants spaced so that no structure shall be more than 250' from a fire hydrant as measured by via the street. Fire hydrants shall not be spaced more than 500' apart. h) When a multi-family dwelling, commercial or industrial building is protected by a automatic sprinkler system and the fire hydrant connection is in excess of 150' from the fire hydrant; there shall be required an on site fire hydrant and water distribution lines capable of supplying the needed fire flow as designed for the automatic fire • sprinkler system. i) Fire hydrants shall be installed on a loop water distribution line, whenever possible. j) Fire hydrants shall be within 15' of the curb or designated roadway and with no obstruction within 3'. k) When fire protection, including fire apparatus access roads and water supplies for fire protection, is required to be installed, such protection shall be installed and made serviceable prior to and during the time of construction. Exception: When alternate methods of protection, as approved, are provided, the requirements of Appendix C page 395 of the International Fire Code, 2006 Edition may be modified or waived. District Wildlife Manager Suzanne Kloster made a site visit and consulted the CDOW Information Source Maps for Weld County to assist in compiling CDOW comments found in this letter. This general area provides winter range for bald eagles,overall range for black-tailed prairie dogs,foraging areas for ducks and geese,winter range for geese,overall range for mule deer,overall range for pheasant, overall range for Preble's meadow jumping mouse(PMJM),and overall range for white-tailed deer. • Additionally,typical species that may be found on site include: coyote,red fox,raccoon, striped skunk, songbirds,miscellaneous raptors,amphibians and snakes. The Home Supply is a major irrigation ditch crossing the north side of the property,and a smaller irrigation ditch is located adjacent to the east boundary. Since riparian habitat along waterways may provide habitat for PMJM we would encourage consultation with United States Fish and Wildlife Service concerning potential need for surveys for this listed species if development will impact riparian habitat. Alternatively,adequate setback from development along riparian corridors may eliminate the need for survey work. Although these ditches are man-made waterways,wildlife use these pathways as movement corridors. A minimum 100 foot non development buffer perpendicular to these ditches would allow continued free movement and minimize potential conflict between wildlife and humans. Fencing along the ditches should allow for unrestricted movement by wildlife. Noxious weeds are a serious threat to wildlife habitat,and a difficult and costly issue for landowners. During construction please clean all construction equipment thoroughly prior to off loading on site,and again before the equipment leaves the property. It would also be valuable to have a weed management plan in place during construction as well as after development is completed. Aquatic invasive species are a risk with any construction in wet areas. If heavy equipment to be used for the project has previously been used in another stream,river,lake,pond,or wetland,one of the following disinfection practices is necessary prior to construction to prevent the spread of New Zealand mud snails, zebra mussels,quagga mussels,whirling disease,and any other aquatic invasive species into this drainage. CDOW submitted a letter to Weld County Planning dated,October 11, 2009 concerning the project and potential impacts to wildlife resources including potential habitat for Preble's meadow jumping mouse(PMJM),a State and federally listed threatened species. Planning staff asked you to follow up with CDOW about PMJM habitat and potential impacts should the project be completed. During our meeting I agreed to complete a site visit and follow up by letter. Potential PMJM habitat along a ditch on the north end of the property is the concern. • I visited the site,adjacent to Weld County Road 3,this morning and walked the ditch located near the north boundary of the parcel. The ditch is a relatively small irrigation lateral used for irrigating this property and for transporting water for down slope users. The ditch has a raised dike,and for the most part is vegetated with upland grass species,forbs and annual weeds. There are small patches of riparian grasses in the ditch bottom and lower banks,however upland grasses do predominate. There are no dense stands of willow or other woody plants found along the ditch,probably due to the fact that the ditch is burned periodically. Based on the quality of the grass stand,and lack of woody vegetation,this ditch does not provide quality habitat for PMJM. Therefore development of the parcel according to plans submitted by the applicant would not impact this species. Additionally,setback required by the ditch company for maintenance should adequately protect habitat along this ditch from degradation,and provide adequate movement corridor for wildlife. We appreciate your concern for developing this parcel in a manner that will retain quality habitat for wildlife while providing an attractive setting for people in a semi-rural landscape. Keep equipment moist for at least 10 minutes OR • Remove all mud and debris from equipment(tracks,turrets,buckets,drags,teeth,etc.)and spray/soak equipment with water greater than 140 degrees F for at least 10 minutes. Clean hand tools,boots,and any other equipment that will be used in the water with one of the above options as well. Incorporating statements discouraging feeding of wildlife,other than songbirds, in covenants or other suitable format would benefit wildlife and help keep people and wildlife safe. Intentional feeding of big game animals, including deer,provides potential for disease in wildlife, increases opportunity for conflict with humans,and is therefore prohibited in Colorado. Abatement of routine wildlife issues on private lands are the responsibility of the property owner. County leash ordinances will protect wildlife,pets and people. Livestock allowed on site should be secured in facilities that provide adequate protection from predators. We would recommend the CDOW publication,Developing with Wildlife in Mind,for ideas on how to create a development that minimizes risk for wildlife. Potential property owners will find additional recommendations and information in these CDOW publications: Your Guide to Avoiding Human-Coyote Conflicts,Living with Wildlife: Canada Geese,Don't Feed the Wildlife,and Too Close For Comfort all of which may be found on the CDOW website (http://wildlife.state.co.us/Education/LivingWithWildlife/) Hunting has been a long-standing tradition in this area. Hunting is the primary tool for balancing wildlife populations with available habitat. While the sound of firearms may be disconcerting to people not familiar with hunting,rules and regulations for the sport make it an extremely safe pastime. Hunting leases also provide an additional revenue source for farmers and ranchers. We would continue to support • hunting on lands in this area until development or safety issues preclude it.
