RE: FINDING AND ORDER: ABATEMENT OF NUISANCE CONDITION ON PROPERTY
OWNED BY MID PLAINS INVESTMENTS, LLC - C.R.S. 25-1-518
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mid Plains Investments, LLC, owns property located at 1401 East 18th Street,
Greeley, Colorado 80631 ("the Property"), on which household trash, including food waste, has
accumulated,thereby constituting a nuisance in need of abatement in accordance as per provisions
of Section 25-1-518, C.R.S., and
WHEREAS, despite efforts by the Department of Public Health and Environment ("DPHE")
staff to resolve said matter, the nuisance was not abated, and
WHEREAS, on the 25th day of July, 2011, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said nuisance condition, and
WHEREAS, a representative for Mid Plains Investments, LLC, was not present or
represented at said hearing, although notice of said hearing was provided by the DPHE, and
WHEREAS, staff requested that the matter be continued to August 15, 2011, and then to
August 24, 2011, in order to allow the property owner adequate time to bring the property into
compliance, and to allow staff adequate time to determine the status of the situation, and the Board
deemed it advisable, and
WHEREAS, on August 24, 2011, the Board of County Commissioners finds the property to
be in compliance with Section 25-1-518, C.R.S., and the requirements of the Department of Public
Health and Environment, and deems it advisable to dismiss the matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board finds the property to be in compliance Section 25-1-518, C.R.S.,
and the requirements of the Department of Public Health and Environment, and that the matter be,
and hereby is, dismissed.

The Weld County Department of Public Health and Environment is withdrawing a request of the
Board of County Commissioners as Board of Health to consider taking a nuisance abatement
action. The responsible party has abated the trash nuisance and obtained both trash service and a
dumpster. See three attached photos taken on August 18 and 22, 2011.

The Department intends to request a continuance (until August 15, 2011) of the planned Board of County
Commissioners hearing as Board of Health. The purpose of the hearing was to seek an abatement order for a trash
nuisance at Mid Plains Investments LLC Apt Building 1401 E. 18th St. This continuance request is based on the
resumption of trash service and improved trash storage conditions. According to the apartment caretaker, Mr. Bryan
Bunning, the remaining trash build-up will be moved to the serviced dumpster after each pick-up (2x/week). Please see
attached agreement and photo demonstrating progress.

Nuisance Condition from Trash&Notice of Hearing
Dear Mr. Richardson or representative of Mid Plains Investments, LLC:
In response to complaints, your property, located at 1401 E. 18th Street(East Highway 34)Weld County,Colorado was
investigated by Troy Swain of this Department on June 28 &July 12, 2011. The inspection from an adjacent public rights-of-
way revealed that household trash from the apartment building has been accumulating on the property. The trash, which
included food waste,was not stored in closed rodent proof containers and was uncovered and accessible to flies,rodents and
other pests. This trash allows for the attraction,breeding and the emergence of birds,insects, rodents and other disease vectors.
The Department sent written notice to abate this condition via Certified Mail,U.S. Mail,and posting of the property on June 28,
2011 and the trash has still been accumulating. Conditions observed during the Department's investigations constitute a
nuisance and a human health hazard.
The above described conditions constitute a"nuisance"according to the Colorado Revised Statutes,which provides the
following in Title 25,Article I, Part 518 (25-1-518 C.R.S.):
The county or district board of health shall examine all nuisances, sources of filth,and causes of
sickness, which,in its opinion,may be injurious to the health of the inhabitants,within its ...,
county...,and it shall destroy,remove, or prevent the same as the case may require.
At a public meeting of the Weld County Board of Commissioners on Monday July 25 at 9:00 AM, this Department will
request the Board issue an order to abate, within 24 hours, the above identified nuisance conditions on your property. Should
you not abate this nuisance condition the Commissioners may have the nuisance abated and the costs of this abatement assessed
against the property. A representative of Mid Plains Investments, LLC is requested at this meeting, which will be held in the
Commissioners' hearing room on the first floor of the Centennial Center,at 915 101h Street,Greeley,Colorado. If you have any

Dear Sir:
In response to complaints, your property, located at 1401 E. 18th Street(East Highway 34),Weld County,Colorado(Parcel
Number 096110308002)was investigated by this Department. The inspection revealed that trash,which included food waste,
