RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #775 AND AMENDED
USE BY SPECIAL REVIEW PERMIT#775-CATHOLIC CHARITIES AND COMMUNITY
SERVICES OF THE ARCHDIOCESE OF DENVER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 11, 1987, the Board approved Use by Special
Review Permit #775 for an overnight lodging shelter for homeless people, for the Archdiocese of
Denver, and Amended Use by Special Review#775, on August 11, 1993, for an overnight shelter
for homeless people in the A(Agricultural)Zone District, for Catholic Community Services, both on
the following described real estate, to-wit:
Lots 9, 10, and 1, except the north 12 feet, Espanola
Subdivision, Weld County, Colorado
WHEREAS, the Board has received a request from Catholic Charities and Community
Services of the Archdiocese of Denver, 2500 First Avenue, Building CG, Greeley, Colorado 80631,
to vacate Use by Special Review Permit#775 and Amended Use by Special Review#775, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#775 and Amended Use by Special Review
Permit#775 be, and hereby are, vacated, effective August 29, 2011.

Request: The current property owners and prospective purchasers of the old
Guadalupe Center (originally approved under USR-775 and
amended under AMUSR-775) be vacated with the effective
vacation date of August 29, 2011. The new Guadalupe Center will
open on that date and at that time the use of the old facility for
overnight housing will no longer be necessary.
USR-775 and AMUSR-775 Background:
On February 11, 1987, Use by Special Review Permit 775 was approved by the Board of County
Commissioners for an overnight homeless shelter (for up to 20 individuals). On August 11, 1993
Amended Use by Special Permit 775 was approved by the Board of County Commissioners for an
expansion of the overnight homeless shelter to accommodate up to 40 individuals.
The Departments of Planning Services is in support of this request.

As we discussed, I do not see any issue with the current owner, Catholic Charities,
requesting termination of the USR for the homeless shelter and having the effective date of
the vacation occur when the property is under different ownership. It might be a different
case if the new owner wanted the use to continue. Here, however, the new owner appears to
be pushing for the termination so the property can be appraised. In requesting the
termination, I would suggest having Catholic Charities or their representative (the realtor
Joe Murphy?) explaining the reason in writing for asking for the vacation and for the
granting of the vacation after closing. You should also have the prospective owners write a
similar letter so that when the Commissioners consider the request, the prospective owners'
wishes will also be clear if they choose not to appear for the meeting. Let me know if you
have any questions.

This is a new request for me (see below). A buyer wants to vacate the USR for a homeless
shelter but is wondering if the existing owner can submit a request to vacate the USR - but
wants to make the date of the vacation effective on August 29th (after the property has
closed and the property is under different ownership) . It sounds like they need the vacation
in hand before the property can be appraised.

Sorry to bother you.
I have a request here for a USR vacation of the homeless shelter in Espanola (I am sending via mail as well). I am
requesting that both USRs (the original and the amendment) be vacated because they both apply to the homeless
shelter. I also requested that the applicant provide the original letters at the meeting.
The applicant is asking when this could be scheduled. I know that Wednesday, August 10th will have hearings but I
wanted to check with you to see if that will work or given the move and all of the other things you are dealing with)we
move this back to Monday,August 15`h
Also, the applicant was asking when the signed resolution for this would be available (they are scheduled to close on
August 30`h)
Just let me know and I will inform the realtor.

Dear Sir/Madam,
Catholic Charities & Community Services of the Archdiocese of Denver requests that
the Weld County Commissioners approve our request to vacate the referenced USR
effective August 29, 2011. As you know, a new Guadalupe Community Center will open
on that date and the use of the old facility for purposes of overnight housing of people in
need will no longer be necessary. Additionally, we have entered into a contract to sell
the property to Luis De La Cruz and Rosaura Garcia Martinez and the property will
transfer to them on August 30, 2011 assuming the closing occurs as scheduled.

The new owners are going to apply to vacate the alley and combine the two lots with a replat.
They have picked up the appropriate applications at your office.
Attached is the letter from Catholic Charities to the County Commissioners. Where will the
meeting Monday be held? Will the commissioners agree or disagree at the meeting? If they
agree, will there be some kind of paperwork issued and how soon?

Joe,
I can find no record of a replant ever having occurred between 1987 and 1993. Back in 1993 -
applicants were allowed to designate a USR on only a portion of the property (it did not need
to cover the entire property) . My guess is that the USR plat was reflecting what the facility
was intending to use on the ground. Because Espanola is a platted community - a resubdivision
must occur to change or vacate any lots lines or platted alleys. As an example, A
resubdivision adjusting lot lines between lots 10 and 11 was done in 2001 (see attached) .

Dear Mr. Murphy,
A USR does not create property boundaries nor vacate alleys. According to our records there
is still a platted alleyway that separates the front lot from the back lot. A resubdivision
would be required to vacate the platted alleyway and a resubdivision would be required to
combine the parcels to create one lot.
It also came to the attention of our Department yesterday that a 12-foot wide portion of Lot
1 (at the north end of lot one) was sold to the Templo Bethel Assembly of God Church. We have
no record that a resubdivision (as required) was done before this parcel was sold. Is this
parcel a part of the site to be sold?

Tom,
Sorry to bother you again but another question has come up. The original USR shows an
"alley" between the building and adjoining lot. The more recent USR shows that the two lots
have been joined and the "alley" has been incorporated into the property. I have attached
both USRs for your review.
Someone in the planning department is telling the buyer's agent that it will cost $800 to fix
the "alley" problem. Could you confirm for us that there is no "alley" and this is not an
issue?

I am still awaiting a call back from the county clerk about the process for vacating a
special use permit.
COUNTY CLERK DOESN'T OVERSEE THE VACATION PROCESS. YOU CAN MAKE THAT REQUEST THROUGH THE
PLANNING DEPARTMENT. THE REQUEST NEEDS TO BE IN WRITING FROM THE OWNER AND ADDRESSED TO THE
BOARD OF COUNTY COMMISSIONERS. I CAN TAKE THE REQUEST TO THE BOCC DURING A 9:00 HEARING AT
WHICH TIME THEY WILL ACT ON THE REQUEST.
The current "Assessed" value is based on 29% of "Actual" because the Use by Special Review
(USR) Permit zones the property as commercial.
THE USR DID NOT ZONE THE PROPERTY COMMERCIAL. THE PROPERTY IS STILL ZONED AGRCULTURE. THE
PROPERTY IS ASSESSED AT A COMMERCIAL RATE BASED ON PART BECAUSE OF THE COMMERCIAL USES.

See the response from our attorney's office (in quotes) below. We need a written request
asking for the vacation of the Use by Special Review Permit (the case # is USR-775) . Ideally
an authorized representative from the Church (who can act on behalf of the Church) should
sign the letter.

meetings (held weekly) . Occasionally these are reviewed at their 9 AM business meetings as

Commissioners - then the USR is officially vacated.
The underlying zoning on the property is A (Agricultural) . A single-family residence is a use
by right in the A (Agricultural) zone district. However, if any other uses are proposed on
the property (a church. . ) - then a new USR may be required. Also, conversion to residential
use or construction of a new residential structure would require the proper building permits
and would be subject to the A (Agricultural) setback and offset requirements. The link to the
