Dear Mr. Ogle:
This letter is in response to a request from Robert Stahl related to the decreed uses of the nontributary
Laramie-Fox Hills aquifer well on his property. The decree referenced above allocates all of the Laramie-
•
Fox Hills aquifer water beneath a 45 acre tract in the above described quarter section to Robert M. and
Mary E. Stahl for the following purposes: domestic, municipal, industrial, agricultural, commercial,
irrigation, stock watering, recreational, fish and wildlife, fire protection, and exchange. The average
annual appropriation from the Laramie-Fox Hills aquifer is limited to 10.6 acre-feet of water.
The above referenced Laramie-Fox Hills well permit Mr. Stahl currently has does not allow for all of the
decreed uses. However, Water Court decrees control over well permits issued by the State Engineer and
well permit number 41068-F is specifically referenced in the decree. Thus, while I would recommend to
Mr. Stahl that he change his existing well permit issued in 1992 to match his Water Court Decree issued in
2010, he may legally withdraw up to 10.6 acre-feet of water per year for any and all of the decreed uses.
Issuance of a well permit matching the decreed uses will be automatic, once an application is made to the
Office of the State Engineer.
