TAP FEE AGREEMENT
THIS AGREEMENT, made and entered into this 12th day of
April , 1968, by and between the CENTRAL WELD COUNTY
WATER DISTRICT, hereinafter called the first party, and
and Weld County Qrain Company , hereinafter
called second parties, WITNESSETH:
WHEREAS, first party is a legally formed water district in Weld
County, Colorado, and
WHEREAS, second parties are desirous of purchasing One water
• taps of 5/8" inches in diameter from the said District, and
WHEREAS, second parties property is not in the legally constituted
district,
NCW, THEREFORE, in consideration of the premises and the terms
and conditions of this agreement, it is mutually agreed as follows:

1. Second parties hereby agree to pay the tap fee/which is in
the amount of $ 150.00 , either by cash or by promissory note, con-
currently with the execution of this agreement.
2. Further, second parties shall be delivered water at the
following rates, and the charge may be raised or lowered by first party in
their discretion upon thirty days notice: regular rate schedule
•
3. In the event second parties desire to sell the water tap or taps
purchased from the District, they hereby agree to give the District first
option to repurchase said taps, at the tap price paid to the District when
said taps were originally purchased from the District. In any event no
water tap may be transferred from the premises for which it was originally
• purchased without the prior consent of first party.
4. Further, in the event second parties desire to sell any of their
irrigation water and separate it from their premises, they hereby agree
• to give first party the first option to purchase said irrigation water, at
the then market price, and to execute all necessary documents in connec-
tion therewith, including documents for the transfer of any such irrigation
water.
5. Further, second parties agree to pay all rates and charges
as set by first party.
b. Second parties hereby agree and consent to give any and all
easements either for their water lines or any other water lines as part
of the consideration hereunder free of charge.
7. If any provisions of this agreement, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not
• affect other provisions or applications of the agreement which can be given
effect without the invalid provision or application; and to this end the pro-
visions of this agreement are declared to be severable.
8. The description of the premises for which these taps are being
purchased is as follows:

9. It is further mutually agreed that this agreement shall extend to
and be binding upon the heirs, executors, administrators and assigns of
the parties hereto.
