Hello Kim -attached is a letter of notification regarding a temporary variance from the Longmont Distel USR permit
limitation of daylight hours of operation to accommodate a public works project on 1-25, which requires night operation of
the Longmont asphalt plant and hauling of asphalt and aggregate material to the job site. The project is projected to
commence around April 24. The original hard copy of this notice is being mailed to you. Please let me know if you have

Dear Kim:
Aggregate Industries(Al) has been awarded the contract for Colorado Department of Transportation
(CDOT) Project No. IM 0253-216.as noted in the enclosed notice of award from CDOT dated January
25. 2011. The project includes rbbilization, asphalt paving, shouldering and other associated work on
portions of 1-25 in Weld County as noted below. which requires mandatory night work in order to
maintain the least disruption to traffic flow. In order to accommodate the terms of this public works
project. Al needs to exercise a temporary'variance from the Longmont Distel USR permit limitation of
daylight hours of operation to allow night operation of the asphalt plant.truck loading and hauling of
material to the project site. The following provides summary information related to this project:

Project Description: Rubblization. asphalt paving, shouldering, median embankment, cable barrier
replacement. guardrail replacement. erosion control, seeding. edge drains, and
restriping.
Project Dates(apx.): April 24, 2011 through October 31. 2011
Estimated Tons: 111W— 31.913 tons
SMA — 11.781 tons
Class 6 Base— 12.946 tons
Filter Rock - 558 tons
Natural Fines — 14.000 tons
Night Truck Haul: Approximately 50 round-trip truck trips/night. Project includes hackhaul of
concrete and asphalt millings.
Night Plant Operation: It is estimated that the hot plant will run at night for 4 or more hours.

required by CDOT. Approximately 1200 tons of asphalt per night will be processed. Asphalt and/or
aggregate material will be loaded out and hauled to the project site. requiring approximately 50
round-trip truck hauls per night. Operation of the hot plant will include use of a loader to feed the plant.
and on nights when aggregate materials are hauled to the site, a loader will be used to load out from
stockpiled material to haul trucks.
Al does not propose deviation from the primary haul route designated in the permit for the plant. The
primary haul route from the Longmont Distel plant is Weld County Road 20-1/2 east to Weld County
Road 7. then north on Weld County Road 7 to Hwy. 119. Al has entered into road maintenance and
improvements agreements with Weld County Public Works which include long-term repairs and
maintenance of the designated haul routes and Al is committed to continued adherence to the terms of
those agreements.

This is confirming notice, for record, that on January 25, 2011 you were awarded the contract for the
construction of project IM 0253-216,on the basis of the bid as submitted.
At the bid opening briefing held on January 13, 2011, the following people were present: Jill Sweeney, Mike
Attergott.
The work and the contract time will commence as authorized in writing by the Chief Engineer in the"Notice to
Proceed". No work is to begin until the "Notice to Proceed" is received from the Department of
Transportation.
If contract item 625 and/or 629 were a part of your bid proposal for this project, surveyors and/or Engineers'
Professional Liability insurance is required for the amount of not less than $1,000,000 in the aggregate, as
indicated in subsection 107.15, fourth paragraph of the Standard Specifications for Road and Bridge
Construction. See the specifications for additional insurance requirements which includes,but are not limited
to: shop drawings, mix designs, contractor performed design work, change orders, and approved value
engineering change proposals.
A pre-construction conference will be set by the resident engineer. Glenn Frieler is the Resident Engineer on
the project.

In accordance with the Aggregate Industries Distel Pit regulations, all drivers
must abide by the following:
The loader has the right-of-way.
There is a 15-mph speed limit anywhere within the Distel Operation.
While in the pit, drivers must not get out of their truck unless
absolutely necessary, and then a hardhat and reflector vest must be
worn.
When a truck is in loading position, under no circumstance should a
driver get out of his/her truck
Do not tarp or do paperwork in the pit or on the scale. If you need to,
do so in the tarping area south of the scale.
Drivers must come to a complete stop before entering onto the scale.
Approach and exit the scale slowly.
Trucks must be maintained to DOT operating standards
All trucks must have operating back-up alarms
No truck will be allowed into the pit after hours without specific
authorization
The use of jake brakes is not permitted in the pit
If you are a visitor in any other type of vehicle, you must check in with
the scale house before entering the pit, and a hardhat, reflector vest
and vehicle beacon must be used.
If drivers do not adhere to these regulations, it could result in a suspension
from the pit. Thank you for your cooperation.
