RE: ACTION OF THE BOARD CONCERNING ZCV #1000135 AGAINST SANDRA
CARPIO FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Sandra Carpio, ZCV #1000135, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of January, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, at which
time the matter was continued to February 8, 2011, to allow adequate time for the property
owner to attend the violation hearing, and
WHEREAS, on the 8th day of February, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Sandra Carpio, property owner, was not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until March 8, 2011, to allow adequate time for the property owner to
properly screen the property from all adjacent properties and public rights-of-way or remove the
remaining derelict vehicle from the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #1000135 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Sandra Carpio to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until March 8, 2011, to allow adequate time for
the property owner to properly screen the property from all adjacent properties and public
rights-of-way or remove the remaining derelict vehicle from the property.

VIOLATION REMEDY:
As I have previously indicated while the presence of a NONCOMMERCIAL JUNKYARD consisting of now 1
remaining DERELICT VEHICLE is an allowed use within an Agriculturally zoned unincorporated townsite, such
as Gill, it must be completely SCREENED from all adjacent properties and public rights-of-ways; otherwise,
any Derelict Vehicles shall be operational at all times and evidence of current registrations shall be submitted to
this office.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is partially or totally
dismantled; has all or portions of its body work missing or is substantially damaged; does not have valid
registration with the State, as required by Section 42-3-103,42-3-138 or 42-12-102, C.R.S., and/or the number
plate assigned to it is not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is
lacking proper equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or
otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202 to 42-2-227, C.R.S.
This definition shall not include implements of husbandry, farm tractors or vehicles customarily operated in a
FARMING operation.
NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand materials are stored or
handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials
and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT

Regarding the trash accumulation at the Carpio residence 27349 3rd
Ave. Gill, I talked to Sandra Carpio today and she said she was
getting a dumpster and trash service. I gave her the returned
Certified letter I sent she said didn't get it because she was on an
extended vacation in San Antonio. I asked her to call me when the
trash is taken care of.

11/18/2010 Telephone call Sandy Carpio (970-590-3089) called. She indicated that she has
been receiving letters from me and just wanted to touch base. She
said the household trash has been removed from the property. She
said there were 3 derelict vehicles, but she's already removed 2 of
them - leaving 1. She said it works, it is just making a pinging noise
in the engine and she hasn't been able to afford to get it fixed, so she

also hasn't wasted the money on license plates, since it isn't
currently working. I advised her that it sounded like, based upon
what she was saying, the only remaining items considered part of a
Noncommercial Junkyard would be the 1 (one) Derelict Vehicle. She
asked what she has to do. I explained that the vehicle would either
need to be restored and registered, removed or screened from all
adjacent properties and public rights-of-ways. She said she couldn't
afford to do it-she is a single mom. I explained that I would push
out the Violation Hearing until January. She said, so that means I
have to go to court over this. I explained the first step was a
Violation Hearing, then the Board would refer it to the County
Attorney's Office for legal action, then court. She said she would
see what she could do.
01/07/2011 Phone call Sandy Carpio (970-590-3089)called. She indicated that she is
scheduled for a Violation Hearing on 01/11/11; however, she was just
given her work schedule and even though she requested the time off
of work-they did not approve the request. She has to work that
day. I indicated that I would request 1 (one)continuance(which puts
her at the February 8th Violation Hearings). I advised her that the
BOCC is pretty good at granting 1 (one)continuance; however, I did
not foresee them granting any additional continuances. She said she
understood, but she couldn't help it.

for legal action.

Dear Carpio Sandra:
It has come to the attention of the Department of Planning Services staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are as follow:
While the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES
is an allowed use within an Agriculturally zoned unincorporated townsite, such as Gill, it must
be completely SCREENED from all adjacent properties and public rights-of-ways; otherwise,
any Derelict Vehicles shall be operational at all times and evidence of current registrations
shall be submitted to this office.
However, the presence of household trash is not an allowed use. All household trash shall be
removed from the property.
DERELICT VEHICLE:A vehicle that is inoperable(unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State,as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or
otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202 to
42-2-227, C.R.S. This definition shall not include implements of husbandry,farm tractors or
vehicles customarily operated in a FARMING operation.
NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals, paper,
rags, rubber tires, building materials and bottles.A NONCOMMERCIAL JUNKYARD may also
include the storage or keeping of DERELICT VEHICLES registered last or currently registered
under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows,the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
