A Site Specific Development Plan and Use by Special Review Permit for an Oil and Gas Support Facility (offices, storage yard and warehouse) in the A(Agricultural) Zone District. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. Weld County Road Classification Plan: WCR 71 &WCR 136.5 are a local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. • Access/Roadway: The applicants are requesting three new accesses from WCR 71 for the site. 1. Each access point will require a completed Access Permit Application Form to be reviewed by our Traffic Engineer prior to construction. Instructions for completing the access permit application are available on the Public Works Website. The access permit will be reviewed for location and design including adequate truck turning radiuses. 2. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), any onsite and offsite requirements, and a maintenance agreement including dust control for the haul routes. Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496 ext. 3764 for a Right-of-Way permit for any work that may be required in the right-of-way. A special transport permit will be required for any oversized or overweight vehicles that may access the site and may be obtained by contacting Amy as well. Site: Multiple structures are proposed at the site including an office, warehouse, shop, communications tower, and gas processing plants. An estimated maximum of 25 people will use this site per day with 4-8 employees at the site full time. 3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. • Stormwater: The applicant submitted a "Draft Preliminary Drainage Report" dated January 2011 and signed and stamped by Chad Masching, P.E. with GEI Consultants, inc. A signed and stamped Final Drainage Report, following the checklist available on the Public Works website, will need to be reviewed and approved before the Final Plat is recorded. 5. Please provide full size (24"x36")drawings with the Final Drainage Report. 6. The project will disturb over an acre of land therefore a State approved Stormwater Management Plan will be required. With the submittal of the Final Drainage Report, please provide a copy of Storm Water Management Plan application as submitted to the State. Please provide a copy of the approved permit once it has been obtained. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. 7. The project will disturb over an acre of land, therefore a Weld County Grading Permit will be required before construction. 8. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 9. The application indicates that there will be up to 8 employees and 24 people may utilize the site on a daily basis. There are no buildings currently on the parcel. The application indicates that a septic system will be installed. As this is a commercial facility, the septic system must be designed by an engineer and approved by the Board of Health. An Underground Injection Control Class V Injection Well permit from the • Environmental Protection Agency for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day) may be required. The applicant will need to submit documentation that a permanent water source is available. A well permitted through the State Division of Water Resources, for business use, is an acceptable water source. Bottled water is not acceptable as this is a full time business. If the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). A dust abatement plan was submitted that indicates all access and parking areas will be graveled and magnesium chloride will be utilized if necessary. The plan states that water will also be provided for dust suppression but the source of the water was not provided. Water trucked in specifically for dust suppression uses is acceptable. Due to the location of the facility, noise should not be an issue. However, the applicant should use best management practices regarding noise. A waste handling plan was submitted that indicates various oils, paints, chemicals and solvents which will be located on site. The name, address and phone number of the various companies that will be used for waste handling shall be supplied. A copy of the Spill Prevention, Control and Countermeasure Plan (SPCC) should be kept onsite and a • • copy provided to Environmental Health Services. An above ground storage tank permit • from the State will be required for any petroleum storage. According to the application, the shop will be used for repair and maintenance of equipment. There was no mention if a floor drain will be included in the shop. The installation of a floor drain is only acceptable if it is an enclosed system which drains into a vault that is emptied independently and not into the septic system. An air emission permit from the State may be required for the processing or generation plants. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall update the dust abatement plan to include the water source for dust suppression. The plan shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. 2. The applicant shall submit evidence of an Air Pollution Emission Notice • (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. The documentation shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. 3. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. The documentation shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. 4. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. 5. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that a well is appropriately permitted for the business • 2 use. The documentation shall be submitted to the Environmental Health Services • Division of the Weld County Department of Public Health and Environment. 6. In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 7. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. The documentation shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. 8. The applicant shall submit documentation that floor drain wastes from the shop are captured in a watertight vault and hauled off for proper disposal. Alternately, the applicant can provide evidence that there will not be a floor drain in the shop. The documentation shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. • 9. The applicant shall update the waste handling plan to include the following: 1) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). The plan shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed • 3 for final disposal in a manner that protects against surface and groundwater • contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan" and SPCC plan, at all times. 5. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges from the washing in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. • 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Adequate drinking, hand washing and toilet facilities shall be provided at all times. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11.In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). 12.Floor drain wastes shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. • 4 13.The Spill Prevention, Control and Countermeasure Plan shall be available on • site, at all times. 14.This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 15.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). If usages of the existing structures are proposed to change from its current use, a building permit for change of use for each may be required. 1. Building permits shall be obtained prior to starting. A plan review is required for each building or structure for which a building permit is required. Two complete sets of plans are • required when applying for each permit. Include a Code Analysis Data sheet for the Weld County Building Department for each structure that requires a permit. Submittal plans shall include a floor plan showing the specific uses of each area for the building. Plans shall bear the wet stamp of a Colorado Licensed Architect or Engineer. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; 2006 International Energy Conservation Code; ANSI 117.1 Accessibility Code; 2008 National Electrical Code and Chapter 29 of the Weld County Code. 4. All building plans shall be submitted to the local Fire Protection District for review and approval prior to issue of building permits. Water Division 1, Water District 1 Dear Mr. Parko: • This referral does not appear to qualify as a "subdivision" as defined in Section 30- 28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the submitted information, there will be no irrigation at the site and water will be initially proved with bottled water from a commercial supplier. It appears there is no immediate use of ground water for the oil and gas support facility in the A Zone District. However, as the use of the site expands, EOG may apply for a water well permit if and when needed. The well permit application would be evaluated pursuant to the applicable statutes and rules at the time it is submitted to this office. According to the submittal, during the construction phase of the project, EOG and Pecan will use off-site water via water trucks to maintain dust suppression.
