HomeMy WebLinkAbout20110806.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2608-JOHN AND BETTY MERRITT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 28th day of March, 2011, considered the request of John and Betty Merritt, 746 E. State Highway 60, Loveland, CO 80537, for a mobile home to be used as a Principal Dwelling, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot A of Recorded Exemption #4737; part of the NE1/4 of Section 6, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, at said meeting, the four Board of County Commissioners in attendance heard all of the testimony and statements of those present, and studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter. Upon a motion and second to approve, which resulted in a tie vote due to the excused absence of Commissioner David Long, the matter was tabled until April 11, 2011, to allow adequate time for Commissioner Long to review the written and recorded testimony and make a determining vote, and WHEREAS, on April 11, 2011, having been fully informed, Commissioner Long voted in favor of the motion to find that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 23-4-130 of the Weld County Code. 2. It is the opinion of the Board that the applicant has shown compliance with Section 23-4-200 of the Weld County Code as follows: a. The proposed use is compatible with the surrounding area, and in harmony with the character of the neighborhood, and its effects upon the immediate area. b. The proposed use is consistent with Chapter 22 of the Weld County Code and any other applicable code provisions or ordinance in effect. c. The permitted use will be compatible with the existing surrounding land uses. d. The general health, safety, and welfare of the inhabitants of the area and the County will not be affected. efey a I Ap>?I. II 2011-0806 PL2017 ZPMH #2608-JOHN AND BETTY MERRITT PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of John and Betty Merritt for permission to place a mobile home to be used as a Principal Dwelling on the above described parcel of land, which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld County Code, be, and hereby is, granted subject to the following conditions: 1. The applicants must obtain a building permit for a mobile home and comply with all of the installation standards of Chapter 29 of the Weld County Code, applicable to mobile homes, prior to locating the mobile home on the property, including evidence of water and sewer. 2. The property is in violation of Chapter 29 of the Weld County Code (Violation #BCV11-00014). The applicants shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure compliance of the property. 3. All proposed and/or existing structures will/do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies, listed as Groups A, B, E, F, H, I, M, and R in Section 302.1 of the 2006 International Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of the Section 23-3-10 of the Weld County Code. 4. Any future structures or uses, on the site, shall obtain the appropriate zoning and building permits. 5. Effective January 1, 2003, building permits issued on the proposed site will be required to adhere to the fee structure of the County-Wide Road Impact Fee Program. 6. Effective August 1, 2005, building permits issued on the proposed site may be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee Programs. 7. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. Septic permit SP-0900132 has expired; the permit shall be renewed and it must receive final approval from the Weld County Department of Public Health and Environment. 8. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicants/landowners shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the 2011-0806 PL2017 ZPMH #2608 —JOHN AND BETTY MERRITT PAGE 3 Weld County Code. All vegetation, other than grasses, need to be maintained at a maximum height of twelve (12) inches, until the area is completely developed. 9. When demolishing or removing an existing structure, specifically a mobile/modular home, the applicants shall contact the Weld County Treasurer's office at 970-353-3845, to ensure the taxes have been paid and the structure is removed from the tax roll. 10. The applicants shall maintain compliance with Section 23-4-200 of the Weld County Code, at all times. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of John and Betty Merritt for permission to place a mobile home to be used as a Principal Dwelling on the above described parcel of land, which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld County Code, be, and hereby is, granted subject to the hereinabove listed conditions. The applicant must obtain a building permit for a mobile home and must comply with all installation standards of Chapter 29 of the Weld County Code applicable to mobile homes prior to locating the mobile home on the property, including evidence of water and sewer. 2. The property is in violation of Chapter 29 of the Weld County Code (Violation #BCV11-00014). County Road 11 would like to express our opposition to granting the requested permit, by John and Betty Merritt. The reason that we oppose this is request is that we had recently purchased our house, which is down the road from the subject address, and have put a lot of work and money into fixing up our house. We did this as an investment in our future, partly because the area as many very nice housing developments with many high-end houses. Now with the possibility of a used mobile home being placed in the area, we fell that this has put our investment into our house at risk, if the permit is granted. We also fell that it will decrease the salability and our total property value of our home (which we don't need that that to happen now) . We also fell that this will undoubtedly set a precedence which will allow for more Mobile Homes to be placed in the area, leaving a greater impact to the value of our home. We believe that Mobile Homes have a place for people who chose to live in them and that is in a Mobile Home park, not in the country surrounded by expensive homes. If the owners of the property whish to have a house on their property, perhaps they could look into a modular home such as the one that is being installed now at County Line Road and HWY 60.
