HomeMy WebLinkAbout20111144 RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000164 AGAINST BEVERLY ENGER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Beverly Enger, ZCV #1000164, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of May, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Beverly Enger, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 10, 2011, to allow adequate time for the property owner to remove all trash from the property and either remove the derelict vehicle or restore it to running condition. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #1000164 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Beverly Enger to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until July 10, 2011, to allow adequate time for the property owner to remove all trash from the property and either remove the derelict vehicle or restore it to running condition. She was kind of stand-offish to vatsemN Planning Department ZONING VIOLATION CASE SUMMARY begin with. She calmed down. She said it has been a rough year. Her mother recently passed away and she had some other issues. She said 1 of the derelict vehicles is her mothers and it just needs to be registered. 1 of the trucks(2 tone brown Chevy) is going to go back to the guy who initially sold it to her, she just needs to find his business card in order to call him back. She said she already has a dumpster and is just looking for time to kind of cleaning up the property, but with the snow it is difficult. She said she is also having to battle with her brother over the estate. I told her I would be willing to send a 60 day letter at the end of the the 30 day time frame that is on a letter that I sent out today. So, that would mean on February 4 - I would send a letter that would grant until April 4th. We briefly discussed that if the property wasn't in compliance I would most likely be scheduling her into the May Violation Hearings-but even at that if the property were finished prior to the hearing -the hearing would cancel. I explained if she explained her situation to the Board, they would probably also grant her some additional time. She said I have been working. I told her that I could see that, but unfortunately, the case is not to a point where I can close the violation yet, so my next step is this Violation Hearing.
