I SUBJECT: USR11-0001, Dan Odell A Use by Special Review permit for a sawmill and retail sales of lumber and furniture. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 23 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant will use the existing accesses to the property. No additional accesses will be granted. The business shall use the main, direct access to the property. The easement on the neighboring property does not meet our distance criteria for a commercial access on a collector roadway. The minimum distance allowed between a driveway and intersection on a collector roadway is 350 feet, the easement access is less than 300 feet. The main access to the property can be used for access to the business as it meets the spacing criteria. Questions concerning access should be directed to Janet Carter at 970-304-6496 x3750. Please show the existing accesses on the Plat and label them with the approved Access Permit number (will be provided). The business area will be graded to direct flows to an existing onsite pond that will be used for Water Quality Purposes. Please label this area on your site plan. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show the existing access points on the Plat and label them with the Access Permit number (will be provided). 2. Please label the Water Quality Area and show flow arrows directing the flow from the business area to the pond 3. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. MEMORANDUM ITO: Michelle Martin, Planning Services IIO FROM: Lauren Light, Environmental Health ', • SUBJECT: USR11-0001 Odell COLORADO DATE: 8/30/2011 Environmental Health Services has reviewed this proposal for a commercial sawmill and retail sales. An individual well (permit 85665) provides water to the property. The well allows for domestic use and will require a change in use to allow for the commercial business. There are two septic systems located on the property. The system located adjacent to the proposed office was originally issued for a mobile home (G19770233) and was sized for 2 people. The applicant has indicated he would prefer to utilize a composting toilet, which is allowed. As this is a commercial facility an engineer design is required as well as approval by the Board of Health. The business must provide for hand iswashing and if the sink in the mobile home is utilized it must drain into the septic system. The use of hand sanitizer is not recommended as it is not as effective as hot water and soap to prevent the transmission of microorganisms. The septic system for the house was sized for 4 bedrooms which corresponds to 8 people (G-19722104). The waste handling plan indicates Gator Services provides trash pickup. All chemicals utilized in the business will be stored according to manufactures standards. The dust abatement plan includes utilizing road base on parking and driving surfaces and watering, as necessary. An air filtration system will be used in the processing buildings. An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit may be required for wood cutting operations that produce air emissions. In addition wood finishing products such as polyurethane must be included in the APEN application. Information regarding the permit can be obtained from the Air Pollution Control Division at the Colorado Department of Health and Environment. A noise plan was submitted. The chainsaw operation will be located approximately 400 op feet from the property line. The submitted study states that sound levels will drop 42 db at the 400 foot distance which would bring the level down to 73 db assuming the noise level is a maximum of 115 db. There will also be saws and equipment located in the two buildings which will mitigate noise. The applicant is planning on putting up a sound barrier fence on the north property line to alleviate sound from the neighboring property. The industrial noise level of 80 db from 7 a.m. to 9 p.m. and 75 db from 9 p.m. to 7 a.m. shall be adhered to. The industrial noise level is consistent with gravel operation levels. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In the event the applicant intends to utilize the existing septic system at the office or the residence, for employees and/or customers, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current regulations. ` 2. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment for any use that will cause air emissions. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 3. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of the Certificate of Occupancy for the office: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. A composting toilet is an acceptable sewage disposal system. a 2 We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality 41111 Control Commission, and the Environmental Protection Agency. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event noise levels detected off site of the facility exceed the industrial level, or in the judgment of the Weld County Environmental Health Director, there exists a noise condition requiring abatement. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 3 11.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 12. In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). 13.This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. Dan Odell Odell USR - Response to referrals Fort Lupton Fire Protection District: I have spoken with Greg McGinn and will resolve all concerns before occupancy. State of Colorado Division of Water Resources: We have applied for the re-permitting of our well permit # 856665 for commercial use, and corrected our well location. Weld County, Environmental Health: We will use the restroom facilities in the house, making the main floor bathroom ADA accessible. Our Septic is recently pumped and inspected (May, 2011) and adequate for 8 person use. [We have 3 residents and would add 2 FT employees and customers (we hope) will resume at our present avg of 4-6/day @ avg. 30 minute visit. If we double our expected customers and double the duration of visit to allow for any immediately foreseeable increase in facility usage - we are still only adding 1.5 FT (12 x 1hr) person to the load. IE- 3 people, 7 days/wk + 3.5 people 6 days/wk = well under permitted load on our septic and permitted water usage] . We have applied for the APEN, even though we are well below any triggering level for monitoring. The Noise, Waste, and Dust abatement plans already submitted shall remain in place. All documentation required before the plat is to be recorded will be available by that time. 2 All listed requirements to be incorporated into the permit will be met. 0o ld County Public Works: would like to use the existing business access thru the Pehr property r these reasons: There is a 46' distance from the N. side of our house and the N. property line. We have 3 rows of trees planted along the N. property line, as part of our Noise abatement plan (this is for noise relief for us, from the Heavy machinery and Construction equipment running on the neighboring C-3 property at all hours of the day and night) . The second row of trees is 16' out, the 3rd 24' . Even if you ask us to build a road 10' from our house, that leaves maybe 10' for a road width? The road we would have to build would be 100' long and go thru 2 existing metal fences that bound our back yard. Additionally, our 1000 gallon propane tank is also between the N property line and the house and would either have to be moved or the gas line dug up and reset to allow a road over the top of it. In all cases the additional cost of having to build a new road (instead of utilizing an already existing road) will not allow us to go forward with our proposed home-based business at this time. The easement agreement to utilize the Pehr property is attached to this letter. All other requirements listed shall be met. General updates: The trash dumpster currently located on the Pehr access will be moved inside the property line. The Mobile home is not utilized as a residence, but will serve as an Jfice for the business. do not intend to re-permit that septic field, but if in the future our septic load increases past the house capacity, we would likely build an approved composting toilet facility. Comments: We met with Mr. Odell concerning the potential of annexation and how the property is designated by our Comprehensive plan. The property is located outside of our current IGA with Weld County but does lie within our Comprehensive Plan Land Use Plan Map area. The property is currently designated as mixed use and agricultural uses for future zoning. CR 23 is designated as an Arterial roadway with a future ROW of 120'. There is also a trail designated on the eastern portion of the property. Fort Lupton is not apposed to the proposed commercial venture but would like to continue the discussions of potential annexation and development of the property through the Fort Lupton process. Should this proposal be approved we request that the future ROW on CR 23 and the future trail corridor be taken into account and be conditions of any approvals made by the Planning Commission and County Commissioners. Water Division 1, Water District 2 Dear Ms. Martin: We have reviewed the above referenced proposal. This referral does not appear to qualify as a "subdivision'. as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application is to use a 17-acre lot for a sawmill as well as a private residence. The business would include processing wood for lumber or furniture and selling of the products. There would be 3-4 residents living on the property and 2-4 employees as well as customers visiting the site. The applicant plans to keep 4-6 horses. 10-12 chickens & ducks and 2-3 dogs. There are several existing buildings on the property including an office and residence. and the applicant proposes additional pole sheds and barns The water supply information summary proposes using the existing exempt well with permit no. 85665 for household water uses as well as the irrigation of 1 acre of lawn & garden and the watering of 5 head of livestock, but does not include commercial uses. Permit no. 85665 allows for domestic and lawn and garden uses. If the well will be used to serve all of the uses proposed: commercial, household, stock watering, and lawn irrigation, a new well permit must be obtained which allows for all of the uses. The uses do not appear to qualify as commercial exempt under § 37-92-602(1)(c) and therefore. a non-exempt permit covering all of the proposed uses is likely required. Information available in the State Engineer's Office shows that this well is constructed to a depth of 680 feet and likely withdraws water from the nontributary Laramie-Fox Hills aquifer. The applicant could apply for the correct well location when applying for a new well permit for the proposed uses. The applicant noted the ownership of Brantner Ditch water rights that can be used for agriculture on the lot. Permit no. 85665 also notes the ownership of// share of the Brantner Ditch. Use of Brantner Ditch water rights on the property must be in accordance with court decrees governing the Brantner Ditch.
