RE: APPROVAL OF THREE-LOT RECORDED EXEMPTION #5089-JACK ZIMBELMAN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Three-Lot Recorded Exemption#5089 was submitted by Jack
Zimbelman, 8510 County Road 69, Keenesburg, Colorado 80643, c/o Kirk Goble, The Bell 5 Land
Company, 710 11th Avenue, Suite 107, Greeley, Colorado 80631, for property which is located on
the following described real estate, to-wit:
Part of the NW1/4 of Section 23, Township 2 North,
Range 63 West of the 6th P.M., Weld County,
Colorado
being more particularly described in the plat which shall be provided by the applicant and known as
Exhibit "A," said plat to be recorded, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the
Board, that a certain parcel of land, to be divided into three parcels, as shown on the plat known as
Recorded Exemption #5089, does not come within the purview of the definition of the terms
"subdivision" and "subdivided land," and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
135 acres, 20.5 acres, and 4.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is,exempt from the
definition of the terms "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that the application of Jack Zimbelman, do Kirk
Goble, the Bell 5 Land Company, for Three-Lot Recorded Exemption #5089, be, and hereby is,
approved subject to the following conditions:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(I.S.D.S.) Regulations.
2. The applicant has proposed a well as the source of adequate water for Lots B and C.
Property owners are advised that the quantity of water available for usage may be
limited to specific uses, i.e., "Domestic Use Only,"etcetera. Because each situation
is unique, the Department of Planning Services encourages property owner(s) to
contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to
discuss each individual situation.

3. Topographic or physical features of the proposed lots, such as ravines, ditches,
streams, etcetera, may limit the area available for a new or replacement septic
system. Prior to recording the plat, the Weld County Department of Public Health
and Environment recommends that the applicant review the Weld County Code
pertaining to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code. In the event the proposed lot is not
of sufficient size to allow the installation of a septic system the lot may need to be
enlarged.
4. Prior to recording the plat:
A. The applicant shall submit a joint ownership, access and/or operation
maintenance agreement for the irrigation well. This agreement shall be
recorded and delineated on the plat.
B. The applicant shall address the requirements of Weld County School District
RE-3J, as stated in the referral response dated March 17,2011. Evidence of
the applicant addressing such requirements shall be submitted, in writing,to
the Weld County Department of Planning Services. Such evidence may
include, but is not limited to, a note on the plat saying that such requirements
shall be the responsibility of the lot owner(s) at the time of building permit
application.
C. Lot B shall comply with the less than thirty-five (35) acre maximum lot size
required by Section 24-8-10.B of the Weld County Code. Net acreage
calculations should not include reserved road right-of-way.
D. Lot A shall comply with the two and one-half (2-1/2) acre net minimum lot
size required by Section 24-8-40.L of the Weld County Code. Net acreage
calculations should not include reserved road right-of-way.
E. Lot C shall comply with the one-hundred twenty (120) acre net minimum lot
size required by Section 24-8-20.C.2 of the Weld County Code. Net acreage
calculations should not include reserved road right-of-way.
F. The applicant shall provide the Weld County Department of Planning
Services with a Statement of Taxes from the Weld County Treasurer
showing no delinquent taxes exist for the original parcel.
G. The applicant shall complete the Non Conforming Use of a Structure
application for the house at 8504 County Road 69 for submittal to the Weld
County Department of Planning Services.
H. The applicant shall complete a Nonexclusive License Agreement for the
Upgrade and Maintenance of County Road 20 right-of-way. There is a$150
fee for the fabrication and installation of blue and white cross road signs
identifying the section line road intersection for the use of addressing and
emergency response. The blue and white signs identify a non-maintained
County right-of-way. Distance and location from the nearest county road

may require additional information signs. The fee for the sign designating
the access as a non-maintained County right-of-way shall be paid to the
Department of Public Works and the sign shall be installed prior to recording
the plat. If existing signs are in place,the fee and installation may be waived
by the Department of Public Works. Evidence of such shall be submitted to
the Department of Planning Services.
5. The following items shall be included on the plat:
A. The plat shall be titled: Recorded Exemption No. 1303-23-2 RE-5089.
B. Lot A shall use the existing residential access, as no additional accesses
shall be granted.
C. Lot C shall use the existing agricultural/oil and gas/ditch road access points
necessary for agricultural operations, as no additional accesses shall be
granted.
D. Lot B shall use the approved nonexclusive license agreement access.
E. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Department of Public Works to determine if a
culvert is necessary at any approved road access point. If a drainage culvert
is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's
minimum size. If the applicant chooses to place a larger culvert, they shall
contact the Weld County Department of Public Works to adequately size the
culvert.
F. County Road 69 is designated on the Weld County Road Classification Plan
as a local gravel road, which requires 60 feet of right-of-way at full buildout.
The applicant shall verify the existing right-of-way and the documents
creating the right-of-way and this information shall be noted on the plat. All
setbacks shall be measured from the edge of future right-of-way. If the
right-of-way cannot be verified, it shall be dedicated. This road is maintained
by Weld County.
G. County Road 20 is designated on the Weld County Road Classification Plan
as a Section Line road,which requires 60 feet of right-of-way at full buildout.
The applicant shall verify the existing right-of-way and the documents
creating the right-of-way and this information shall be noted on the plat. All
setbacks shall be measured from the edge of future right-of-way. If the
right-of-way cannot be verified, it shall be dedicated. This road is not
maintained by Weld County.
H. Setback radiuses for existing oil and gas tank batteries and wellheads shall
be indicated on the plat, per the setback requirements of 23-3-50.E of the
Weld County Code.

The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property is
located. Pursuant to the definition of setback in the Weld County
Code, the required setback is measured from the future right-of-way
line. No building or structure, as defined and limited to those
occupancies listed as Groups A, B, E, F,H, I, M, and R in
Section 302.1 of the 2006 International Building Code, shall be
constructed within a 200-foot radius of any tank battery, or within a
150-foot radius of any wellhead. Any construction within a 200-foot
radius of any tank battery, or 150-foot radius of any wellhead, shall
require a variance from the terms of the Section 23-3-10 of the Weld
County Code.
2) Any future structures or uses on the site must obtain the appropriate
zoning and building permits.
3) Lots A and B are not eligible for a future land exemption, in
accordance with Section 24-8-20.C.2 of the Weld County Code.
4) Prior to the release of building permits, the applicant shall submit a
recorded deed describing the lot upon which the building permit is
requested with the building permit applications. The legal description
on such deed shall include the lot designation and Recorded
Exemption number.
5) Prior to the release of building permits, the applicant shall submit
evidence to the Department of Planning Services that Lots B
and/or C has an adequate water supply of sufficient quality, quantity,
and dependability.
6) Prior to the release of building permit, the applicant shall submit
evidence of approval from the Southeast Fire Protection District to
the Weld County Department of Building Inspection.
7) Potential purchasers should be aware that Lots B and/or C may not
be eligible for a domestic well permit which allows for outside
irrigation and/or the watering of stock animals. The Colorado
Division of Water Resources issues all well permits.
8) Potential purchasers should be aware that groundwater may not
meet all drinking water standards, as defined by the Colorado
Department of Public Health and Environment. The Weld County
Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and
periodically thereafter.

9) Potential purchasers should be aware that approval of this Recorded
Exemption does not guarantee that well permits will be issued for the
lots. Any lot may be deemed non-buildable if the lot owner is unable
to obtain a well permit. The Colorado Division of Water Resources
issues all well permits.
10) Should noxious weeds exist on the property, or become established
as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds, pursuant to
Chapter 15, Articles I and II, of the Weld County Code.
11) Building permits shall be obtained prior to the construction of any
building. Buildings that meet the definition of an Agricultural Exempt
Building, per the requirements of Sections 29-1-20 and 29-3-20.6.13
of the Weld County Code, do not need building permits; however, a
Certificate of Compliance must be filed with the Department of
Planning Services and an electrical and/or plumbing permit is
required for any electrical service to the building or water for watering
or washing of livestock or poultry.
12) Effective January 1, 2003, building permits issued on the proposed
lots will be required to adhere to the fee structure of the County-Wide
Road Impact Fee Program.
13) Effective August 1, 2005, building permits issued on the subject site
will be required to adhere to the fee structure of the Capital
Expansion Impact Fee and the Stormwater/Drainage Impact Fee.
14) Potential purchasers are hereby notified that a Confined Animal
Feeding Operation (USR-1092 for a poultry facility) is located directly
northwest of the intersection of County Roads 20 and 73. Off-site
impacts that may be encountered include noise from trucks,tractors
and equipment; dust from animal pens; and odors from animal
confinement, silage, and manure.
15) Prior to the release of building permits, the lot owner shall verify with
the nearest Town/City or Sanitation District to determine the location
of the nearest sanitary sewer line. In accordance with the Weld
County Code, if a sewer line exists within four hundred (400) feet of
the property line and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld
County Department of Public Health and Environment. Evidence of
such shall be submitted, in writing,to the Weld County Department of
Planning Services.
16) The existing home located at 8504 County Road 69 is considered to
be a nonconforming use. Case NCU-535 has been established for
the house. The house is required to maintain compliance with
Chapter 23, Article VII, of the Weld County Code.

17) The Weld County Right to Farm Statement, as it appears in
Section 22-2-20.J.2 of the Weld County Code, shall be placed on the
plat.
6. The applicant shall submit two(2) paper copies of the plat for preliminary approval to
the Weld County Department of Planning Services. Upon approval of the paper
copies, the applicant shall submit a Mylar plat, along with all other documentation
required as Conditions of Approval. The Mylar plat shall be recorded in the office of
the Weld County Clerk and Recorder by the Department of Planning Services. The
plat shall be prepared in accordance with the requirements of Section 24-8-60 of the
Weld County Code. The Mylar plat and additional requirements shall be submitted
within sixty (60) days from the date of the Weld County Board of Commissioners
Resolution. The applicant shall be responsible for paying the recording fee.
7. In accordance with Weld County Code Ordinance#2005-7, approved June 1,2005,
should the plat not be recorded within the required sixty (60) days from the date of
the Weld County Board of Commissioners Resolution, a $50.00 recording
continuance charge may be added for each additional three (3) month period.
8. The Department of Planning Services respectfully requests a digital copy of this Use
by Special Review, as appropriate. Acceptable CAD formats are.dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are ArcView shapefiles or ArcGIS Personal
GeoDataBase(MDB). The preferred format for Images is .tif(Group 4). (Group 6 is
not acceptable). This digital file may be sent to maps@co.weld.co.us.

13) Effective August 1, 2005, Building permits issued on the subject site will be required
to adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)

13) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in
the country in total market value of agricultural products sold. The rural areas of
Weld County may be open and spacious, but they are intensively used for
agriculture. Persons moving into a rural area must recognize and accept there are
drawbacks, including conflicts with long-standing agricultural practices and a lower
level of services than in town. Along with the drawbacks come the incentives which
attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well-run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens, field work, harvest and gravel roads; odor from animal confinement, silage and
manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides
and fertilizers in the fields, including the use of aerial spraying. It is common practice
for agricultural producers to utilize an accumulation of agricultural machinery and
supplies to assist in their agricultural operations. A concentration of miscellaneous
agricultural materials often produces a visual disparity between rural and urban areas
of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation
shall not be found to be a public or private nuisance if the agricultural operation
alleged to be a nuisance employs methods or practices that are commonly or
reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the
way" of residential development. When moving to the County, property owners and
residents must realize they cannot take water from irrigation ditches, lakes, or other
structures, unless they have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles
in size (twice the size of the State of Delaware) with more than three thousand seven
hundred (3,700) miles of state and County roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement
a •
is based on responses to complaints more than on patrols of the County, and the
distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers
who must leave their jobs and families to respond to emergencies. County gravel
roads, no matter how often they are bladed, will not provide the same kind of surface
expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,
electrical power for pumps and center pivot operations, high speed traffic, sand burs,
puncture vines, territorial farm dogs and livestock, and open burning present real
threats. Controlling children's activities is important, not only for their safety, but also
for the protection of the farmer's livelihood.
7. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copies the applicant shall
submit a Mylar plat along with all other documentation required as conditions of approval. The
Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of
Planning Services' Staff. The plat shall be prepared in accordance with the requirements of
Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be
submitted within sixty (60) days from the date the Administrative Review was signed. The applicant
shall be responsible for paying the recording fee.
8. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required sixty (60) days from the date the Administrative Review was
signed a $50.00 recording continuance charge may be added for each additional 3 month period.
9. The Department of Planning Services respectfully requests the surveyor provide a digital copy of
this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format
type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This

10. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to
the Weld County Board of County Commissioners with a staff recommendation for denial.

There is 60'of right of way along the north line of Section 23-2-63. Both Section 23 and the section to the north, Section
14, have 30' of right of way on either side of the section line.This is as a result of the 1889 Resolution found in Book 86
at page 273 in the office of the Clerk and Recorder.The only exceptions to this 1889 Resolution would be if the two
sections were railroad sections, which they are not.The railroad map found in the public works web site shows that the
railroad did not claim sections in this part of the township.Another exception would be if they were school sections.
Again, they are not since school sections are Sections 16 and 36.The final exception would be if the land had been
homesteaded and patented prior to 1889. A search of the BLM web site indicates the land in both sections were
patented after 1889.Those three exceptions are the only exceptions available and since they are not valid in this case,
the 1889 Resolution applies.There is 60'of right of way along the section line between sections 14 and 23. A review of
the right of way map found on the public works web site indicates the same.The legend to that map shows that lines
with a yellow color indicate right of way resulting from the 1889 Resolution. From this, I believe the comments from the
Public Works Department should remain.

Pm writing to address the Weld Coy Department of Public Works referraithe application for Recorded
Exemption for Jack Zimbelman, RE-5089.
I have attached a summary of the referral, the Department of Planning Services condition (requirement), and a
map of WC ROW obtained from WC Public Works own website.
The referral requires the applicant to enter into a non-exclusive licensing agreement for use of WCR 20 ROW,
described as 30 south of the north section line.
There is not a county constructed or maintained road in that location.
I have reviewed the WC ROW map on the WC Public Works website, visited the offices of WC GIS, and
reviewed all appropriate electronic and hard copy files.
It appears from my research that no WC ROW exists in this portion of NW4 23-2N-63W, thus I contend that no
licensing agreement or signage, and associated fees for same, are necessary. Please refer to the attached
summary to confirm these findings.
A flagpole lot configuration as suggested in the referral is acceptable to insure Lot B direct access to WCR
20/69 at that intersection.
Please reply at your earliest convenience or with any questions. We are in the process of completing a survey
and will need to confirm this status.

I have attached a map of the proposed division for your reference.
The stated intent of this application was to separate existing improvements (Lot A) to accommodate an in-

Lot B has served as a natural gas processing and compressing site for several decades and is currently the

RECORDED EXEMPTION QUESTIONAIRE
1. Water Supply Statement:
a. Domestic Use:. Proposed Lot "A" is served by a domestic well permitted
under#044250 (copy attached). The applicant proposes that as a
condition of approval the placement of a note on the final plat that states
no residential building permits will be issued on Lots "B" or"C"without an
adequate domestic water supply.
b. Irrigation: Proposed Lot "B" is mostly irrigated farmland typical to the
area. The parcel is served by an irrigation well registered under permit
#31529 (copy attached). Applicant's farming practices provide adequate
vegetative cover to prevent undue erosion.
2. Statement regarding sewage disposal/septic:The dwellings on proposed
Lot "A" are served by existing septic systems. Statements of Existing System
have been approved by Weld County Health Department under numbers
ISDS1100009 and ISDS1100010, respectively. (copies attached). Proposed
Lots "B" and "C" are of sufficient size to be eligible for future septic systems if
needed.
3. Description of current use of the property:The current use of the property
in total is as an irrigated farm, rural residence, and former oil/gas facility.
4. Reason for the Recorded Exemption and proposed use of the property:
The applicants seek approval of a Recorded Exemption to separate the
existing homes and improvements from the farmland in order to transfer
ownership of the improvements to the applicant's daughter who lives in one of
the dwellings, and to separate a 20 acre +/- site in the northeast comer of the
parcel that has been historically used as an oil/gas processing facility by
Phillips Petroleum Company. Proposed Lot "C" is 135 acres +/- is well
defined by existence of roads, fences, ditches, and pipelines and will continue
to be used for irrigated farm production.
5. Description of location, size, use of new lots: Proposed Lot"A is located in
the southwest corner of the parcel and will be used as a rural residential site.
There are 2 residences on the lot, served by a shared domestic well and each
with it's own septic system. Other improvements include a shop, garage,
shed, and corrals. The site is bordered by WCR 69, concrete irrigation ditch,
irrigation pipeline, and by an established tree line. Applicant understands that
the existence of 2 dwellings on this site may constitute a non-conforming use
and agrees to designate the smaller dwelling (8504 WCR 69) as the non-
conforming dwelling. Proposed Lot"B" is located in the northeast corner of
the parcel, consists of 20 acres +/- and has been used for decades as an
oil/gas processing facility by Phillips Petroleum Company. Phillip's long-term
lease is soon to expire and they intend to leave the site. There has been
some contamination at the site and Phillips is fully responsible for any
environmental clean up and is currently working with all appropriate agencies
to effect proper site remediation. The site may be eligible for a single family
dwelling at some point or could have other uses such as pipe or equipment
storage (with appropriate use permits). The proposed use of Lot "C" is for

continued agricultural production and would be a legal building site for one
single-family dwelling.
6. Statement regarding unique physical properties:There are no unique
physical properties of the parcel that affect the consideration of a Recorded
Exemption.
7. Statement regarding structure setback requirements:All structures
currently meet or will meet all setback requirements.
8. Statement regarding conservation easement:The applicant does not have
need to establish a conservation easement at this time and has no plan to do
so.
9. Statement regarding building envelope:The applicant prefers not to
designate a building envelope as a part of this application.
10.Statement of consistency with Weld County Comprehensive Plan: This
application is consistent with the provisions of the Weld County
Comprehensive Plan. Particular attention has been given to preservation of
prime agricultural lands wherever possible.
11.Statement of compatibility with surrounding land uses:The proposed
uses of production agriculture and rural residence are consistent with the
similar uses of all surrounding properties.
12.Statement of consistency with intent of the zoning district:All proposed
and current uses are consistent with the intent and allowed uses in the A—
Agricultural zoning district.
13.Statement of consistency with efficient and orderly development:
a. assist orderly and efficient development: This proposal assists in
orderly and efficient development by preserving agricultural lands, utilizing
existing accesses, and maintaining consistency of use with surrounding
properties.
b. health, safety, and welfare:The proposed creation of an additional lot
should have minimal effect regarding health, safety, and welfare in that
provisions are available for adequate water and septic. Only one new road
access is proposed. Impact to sheriff's patrols and fire protection is
minimal. The property is located in the xxx Fire District.
c. conformation with municipal or county plans:To the best knowledge
of the applicant, this proposal should be consistent with existing county or
municipal plans. The parcel size, water supply, and access should all be
consistent with the existing municipal plans.
d. preservation of agricultural land:All attempts have been made to
preserve as much prime irrigated agricultural land as possible.
e. retention of irrigation water No irrigation waters are impacted or
restricted by the application. No intent is evident to remove irrigation
waters or to remove lands from irrigation.
f. preserve natural vegetation & control erosion:This application makes
no changes that would contribute to an increase in erosion hazards.
There is adequate natural vegetation in place on Lot"A"to control erosion
and an adequate supply of water to support the existing vegetation.

Current and anticipated farming practices and water supply on Lot "B"
should also adequately control erosion.
g. access:Access to Lot"A" is via an existing driveway from WCR 69.
Access to Lot "B" is via an existing road along the north boundary.
Applicant has not determined if WCR 20 ROW may exist in the location,
as it aligns with existing WCR 20 to the west. Lot "C" existing access is
via the same road at the northwest corner of the property. Appropriate
easements can be put in place to assure Lot "B" access if necessary. Lot
"C" also utilizes a seasonal access that would wind up in the northwest
corner of proposed Lot "A" (see map). This access is seasonal, has long-
term use, and is necessary for proper operation of the farm. It does not
constitute a circular drive on Lot"A" and appropriate easements can be
put in place to assure Lot"C" seasonal access if necessary.

The Weld County Public Works Department has reviewed this proposal. Staff comments made during this phase of the
process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues
of concern must be resolved with the Public Works Department. Our comments and requirements are as follows:
COMMENTS:
WCR 69 & WCR 20 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County
Zoning (23-1-90), the required setback is measured from the future right-of-way line.
There is 60 feet of unmaintained County Right-of-Way along the WCR 20 Section Line (30 feet on either side). Please
show and label this right-of-way on the Plat. Please contact Leon Sievers, County Surveyor, with any questions
concerning researching the right-of-way(970-304-6496 x3750).
If the access for Lots B and C will be within the 30 feet of right-of-way south of the section line, the applicant will need to
enter into a nonexclusive license agreement with the County. The nonexclusive license agreement will allow the applicant
to use the right-of-way for access with the understanding that their use is not exclusive and other property owners or
utilities may also use the right-of-way and that the County will not be responsible for maintenance of the access.
With the proposed configuration, Lot B will be a landlocked parcel. Frontage on the County roadway would be preferable.
The County does not normally recommend a flagpole configuration for lots but, because the facility is existing, a flagpole
configuration would allow for frontage on the County roadway. The minimum width of a flagpole is 30 feet. Lots B and C
could still share the existing access by placing an access easement on the flagpole. Please consider reconfiguring the lots
to allow all lots to have frontage on the County roadway.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency
(FEMA).
REQUIREMENTS:
1. Please consider reconfiguring the lots to allow all lots to have frontage on the County road. A 30-foot wide
flagpole to Lot B could be used to accomplish this.
2. The minimum width of an access easement shall be 30 feet.
3. The applicant shall utilize the existing accesses. No additional accesses will be granted.
4. Show and label the unmaintained County Right-of-Way along the WCR 20 Section Line on the plat.
5. The applicant shall complete a Nonexclusive License Agreement for the Upgrade and Maintenance of Weld
County Right-of-Way.
6. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height
of 12 inches until the area is completely developed.

Environmental Health Services has reviewed this proposal to exempt 2 lots off of a 160
acre parcel. Proposed Lot A will be 4.5 acres, proposed lot B will be 20.5 acres and
proposed Lot C will be 135 acres in size. There are two existing residence on proposed
lot A which are served by a shared individual well (permit 044250) and two individual
sewage disposal system ( 8510 CR 69 is permit SE-1100009 and 8504 CR 69 is permit
SE-1100010).
Proposed Lots B and C are vacant and a new sewage disposal system and individual
well will be installed on each lot when a residence is constructed.
The following conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed homes septic systems
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. Please note, the lot owners shall verify with the nearest Town/City
or Sanitation District to determine the location of the nearest sewer line. In
accordance with the Weld County Code, if a sewer line exists within 400 feet of
the property and the sewer provider is willing to serve the proposed structure, a
septic permit cannot be granted by the Weld County Department of Public Health
and Environment.
Additionally, please note the following:
1. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

2. Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicants
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may need to be enlarged.

Dear Planning Department Official:
This project provides for a recorded exemption within the rural area of Weld County School
District Re-3J, Although recorded exemptions, individually,represent a small increment of the
total housing stock,the cumulative effect of several such approvals is exerting a considerable
negative effect upon the school district's ability to provide adequate educational opportunities for
the resulting students. Additionally,the substantial separation of these units from other more
densely populated areas increases school transportation costs, further eroding the amount of
funds that can be applied in the classroom toward educating the students. The school district's
Board of Education is opposed to approval of additional new housing without adequate
mitigation of land costs, However, in the event that the County Commissioners decide to
approve this application, Weld County School District Re-3J respectfully requests that these
exemptions be required to mitigate the costs of providing land for school sites as explained
below.
Site Issues
Based upon the district's school capacities and site size standards,the proposed exemption would
generate the need for Less than one acre of land;the cash equivalent would approximate
$1,232.00 per single-family housing unit (see Table 1). If approved,it is requested that this
amount be paid to the school district as a cash-in-lieu of land dedication for each new unit
allowed .
Recommendations
The Board of Education remains very concerned about the recent trend toward accelerated
residential activity throughout the district and the ensuing enrollment that will follow, as welt as
the district's physical and financial ability to serve that growth. Approval of additional
residential development without a ready and identified means of providing appropriate
infrastructure would not demonstrate good stewardship of the public trust.
As stated before, cash-in-lieu of land of S1,232,00 is requested for each single-family housing
unit. Therefore,the total due to Weld County School District RE-3J is$2,464.00. Without such
mitigation,the district will recommend that the application be denied.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide informal comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided herein
cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a
well permit, or physical availability of water.
According to the submitted information, the proposal is to divide the current parcel
into three lots to be used for rural residential sites and also for irrigated farmland on Lot C.
Proposed Lot A, consisting of 4.5 acres, is currently serviced by well permit no. 44250F.
The annual appropriation is 5.5 acre-feet from the Laramie-Fox Hills aquifer for 4 single
family dwellings, 2 acres of lawn and garden and for watering of livestock. The current
water uses on Lot A appear consistent will the allowed beneficial uses under permit no.
44250F.
Proposed Lot B consists of 20.5 acres and per the submittal there are no existing
wells. Proposed Lot C consists of 135 acres and is currently supplied by well permit no.
31529FP for irrigated farm production. Per the submittal, domestic well permits will be
applied for as needed for Lots B and C. These well permit applications will be evaluated
pursuant to the applicable statutes and rules at the time they are submitted to this office.

COMMONS OF APPROVAL
1) This well shall be used in such a way as to cause no materiel injury to existing water rights. The issuance of the
permit does not MUM the applicant that no Injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil Down action.
2) The construction of this well shall be In compliance wth the Water Well Construction and Pump Installation Rules
2 CCR 402.2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to Sections 37-90-107 and 37-90-111(5), C.R.S., and the feedings of the Ground Water
Commission dated November 1, 1994
4) The maximum pumping rate shall not exceed 15 GPM.
5) The annual appropriation shall not exceed 5,5 acre-feet.

7) The well must be constructed to withdraw water from only the Laramie-Fat Hills Aquifer. The top of the Laramie-
Fox Hills Aquifer Is located approximately 940 feet below the ground surface. The bottom of the Laramie-Fox Hills
Aquifer is located approximately 830 feet below the ground surface. Plain casing must be installed and seated
to prevent diversion of water from other aquifers and the movement of water between aquifers.
8) This well shall be constructed within 200 feet of the location specified on this permit but shall not be located within
sou feet of another large-capacity well completed in the Laramie-Fox Hills Aquifer.
9) The entire length of the hole shall be geophyaicay logged according to the attached Instructions prior to installing
the casing.
10) A totalizing flow meta must be installed on the well and maintained in good working order. Permanent records
or all diversions must be maintained by the well owner(collected at least annually) and submitted to the Upper
Black Squirrel Ground Water Management District and the Division of Water Resources upon request
11) The owner shall mark this well in a conspicuous place with the permit number and the name of the aquifer. He
shall take necessary means and precautions to preserve these markings.

On March 9,2011,an evaluation of the existing individual sewage disposal system at:
8510 County Road 69,Keenesburg,Colorado;
Section 23,Township 02 North.Range 63 West,
was conducted by Lauren Light,an Environmental Health Specialist of this department.
The existing individual sewage disposal system is of sufficient size and capacity to adequately handle the
proposed load.This evaluation is based on a final treatment capacity for a 3 bedroom residence.
Be advised,neither the County of Weld nor any of its agents or employees undertake or assume any liability
to the owner of the above property, to any purchaser of the above property or to any lending agency making a
loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and for
detecting health hazards observable at the time of inspection. This does not constitute a warranty that the
system is without flaw or that it will continue to function in the future. Inspections requested during periods
of snow cover and high soil saturation may be of questionable value to potential buyers due to adverse
conditions. Evaluations based on Statements of Existing(S.O.E.)relies on information the property owner
provides,under oath,indicating current status of the system and representing to the best of his/her knowledge
the system is not failing to function properly.

5504 County Road 69. Kceneshurg. Colorado,
Section 2?. Township 02 North. Range 61 West,
was conducted by Lauren Light. an Environmental Health Specialist of this department.
The existing individual sewage disposal system is not of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 2 bedroom residence.
The system is not constructed in accordance with current regulations, as the tank is undersized by 500 gallons.
Because the system was installed prior to the adoption of statewide guidelines by the Colorado Board of
Health, the County considers this system to he"grandfathered"and will not require that the system be brought
into compliance with cub rent ISDS Regulations so long as the system functions in accordance with current
regulations. The Depal Invent I ecommends that the tank size be increased by 500 giillons Please be advise d
that should you decide to repair your system, a permit is required from this Depart Mein prior to any
