RE: APPROVAL OF FINAL PLAT - ALTHEN/BOYER, SECOND FILING
(SUBDIVISION 131) .
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering
the affairs of Weld County, Colorado, and
WHEREAS, on the 16th day of May, 1977 , Fred Althen, Sr. , and
John St. A. Boyer, submitted a proposed final plat on Althen/Boyer
Second Filing (Subdivision 131) , for Lots 6 through 9 therein, to
the Board of County Commissioners for approval in accordance with
the Subdivision Regulations of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request and studied the recommendations of the Weld County
Planning Commission, as submitted, and having been fully in-
formed and satisfied that the submitted Final Plat conforms in
all respects with the requirements of the Weld County Subdivision
Regulations, and that approval of said Final Plat would be in
the best interests of the County, and
WHEREAS, the Board of County Commissioners finds that the
Final Plat conforms in all major respects to the Preliminary
Plat as previously reviewed and approved by the Board of County
Commissioners , and
WHEREAS, the Board of County Commissioners further finds
that the applicant has complied with the Final Plat submission
requirements as set forth in the Weld County Subdivision Regu-
lations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Final Plat for
Althen/Boyer Second Filing (Subdivision 131) for Lots 6 through
9 , all located on the following described real estate, to-wit:

Township 1 North, Range 68 West of the 6th P.M. ,

3. The Weld County Engineering Dept. has indicated they could not identify
any engineering problems.
4. The Dacono Area Fire Protection District has indicated they have coordinated
fire protection measures with the applicant and they have no objections to
the granting of this request.
COMMENT:
1. The Park Fee for the first and second filings of the Althen/Boyer Commer-
cial Subdivision was computed to be $684.00.

4. Release or -Liability: tlitibitivitiar shall in:ic'll illy and save
harmless the County from any and ail suit':, acticna. or claims of
every nature and description caused by arising from, or on account

of said construction, and pay any and all judgments rendered against
the County on account of airy' such suit, :etion, or claim, together with
all reasonable expenses and attorney's y's fees, incurred by County in
defending such suit, action, or claim. All contractors and other
employees engaged in construction of the improvements shall maintain
adequate workmen's comr,ensatio" i'l5ur'nnce and public liability in-
surance coverage. And shall operate in strict accordance with
"Occupational Safety and Health Act, " and."o.r any regulations imposed
by the Industrial Commission of the State of Colorado.
5. Aceentance: Ripon completion of said construction according
to the terms of this agreement, the improvements shall be accepted by
the County after written approv=al is received by it from its duly authorized
inspecting agent. Upon such acceptance of subdivision, all assignable
improvements shall automatically become public facilities and the property
of the County.
5. 1 If desired by he County, portions of the improvements
may be placed in service when completed, but such use and
operation shall not constitute.: an acceptance of said portions.
.5. 2 The County may, at its option, issue building permits
• for construction on lots For which the subdivision improvements
detailed herein have been started but not completed, and may
continue to issue building permits so long as the progress of
work on the subdivision improvements throughout the develop-
mc'nt is satisfactory t.o the County; :end all terms of this agree-
• mcnt have been faithfully kept by Subdivider.
6. Maintenance: During a period of one year from and after the
filial acceptance of the subdivision•improvements, the Subdivider shall, at
its own expense, make all needer.' --pairs or replacements due to de-
fective materials or workmanship which, in the opinion of the County,
shall become necessary. If, within ten days after Subdivider's receipt
of written notice from the County requesting such repairs or replace-
ments, the Subdivider shall not have undertaken with due diligence
to snake the same, the County may make such repairs or replacements
et the Subdivider's expense. in the 'case of any emergency, such written
notice may he waived.
7.. Su:divider shall furnish to the Board of County Commissioners
as a guarantee of compliance with this agreement: 1) Cash escrow deposit,
or 2) Bank letter of credit, or 3) "Sub Division Bond" issued by surety
company authorized to do business in the State of Colorado, or 4) Demand
Note signed by qualified obligors acceptable to the Board of County Com-
missioners. Amount of any of the above guarantees shall be. set by the
Board of' County Commissioners and amount of guarantee may be adjusted
as portions of work are completed and accepted.
8. Successors and Assigns: This agreement shall be binding
upon the heirs, (executors, personal r'epresent.atiVe., successors, and
assigns of the Subdivider and upon recording by the County shall be
deemed a covenant running with the land herein described, and shall he
binding upon the successors in ownership of said land.

UTILITY INSTALLATION AGREEMENT
THE Mountain Bell Telephone, Union REA and the
Public Service Company
hereinafter collectively called "Utility Companies", and
Althen-Boyer CUD , hereinafter called "Developer",
enter into the following agreement this 31st day of March
19 77 .
WITNESSET H:
1. The Developer is the owner or builder of a certain subdivision,
planned unit development, planned building group or other commercial,
residential or industrial real estate development (hereinafter
called "Development") known as Althen-Boyer CUD
2. Developer desires to have telephone, electric, gas,
and services available to the future purchasers
or tenants of his development as soon as practically possible.
3. Developer desires to have the utility cables, wires, pipe, conduits,
etc. , underground.
4. In order to provide telephone, electric, gas,
, and , service at the
earliest practical date, it is necessary for the Utility Companies to
commence installation of underground facilities during the con-
struction of the development.

veloper and/or other Utility Companies for costs incurred in accom-
modating such changes; as well as, relocating service facilities with
all reasonable dispatch. Signatories of this contract may unilateral-
ly or mutually agree in writing to relieve the other of this liability
in specific or general cases.
C) This Agieement shall be binding upon and inure to the benefit of the
signatories, their successors, assigns and legally appointed repre-
sentatives.

Due to lack of sales in the area of above mentioned development ,
I used sale price in 1968 and added eight percent per year
appreciation to come to the following value.
Documentary Fee in 1968 showed said property selling for
$275. 00 per acre , by adding 8% per year for 9 years
today ' s value would be S 473 . 00 rounded to $475 . 00 per acre .
Therefore , in my opinion , raw land in the Althen Boyer
Commercial Unit Development area would be $475. 00 per acre .
