it was RESOLVED, That Clay R. Apple be employed as County Attorney at the salary of
$1080.00 per year, together with legal fees, of lunacy cases, hearing of cases, and depend-
ent and neglected children in the County Court, compensation for litigation and trips (Alt
of town on County business to be additional.
On vote, unanimously carried and so ordered.
IN THE MATTER OF APPOINTMENT OF CHAIRMAN OF THE BOARD
OF COUNTY COMMISSIONERS TO SIGN ALL LEGAL BUSINESS
BROUGHT BEFORE THE BOARD
WHEREAS, on motion made by Commissioner J. S. Ogilvie, and seconded by Commissioner
Chas . 0. Plumb, put to vote and unanimously carried, Commissioner S. K. Clark is hereby
appointed, authors ed and directed to sign all legal business brought before the Board of
County Commissioners, including alcohol free tax, report of alcohol application, ,vouchers,
warrantR, tax resolutions, and any County Legitimate business.
Above resolution was put to vote and unanimously carried.
IN THE MATTER -OF ROAD OVERSEERS FOR
COMMISSIONERS' ' bISTRICTS AND SHOP FOREMAN
Commissioner G`h#$ ;: 0. Plumb moved that the same Road Overseers be appointed at
a salary of $160.00 per month as follows; to serve at the pleasure of the Board:
Road District No. 1, E. C . Knight; Road District No. 2, C . D. Edwards; and
Road District No. 3, H. F. Warren; County Shops, Foreman, Ed Seela .
The above motion was seconded by Commissioner J. S. Ogilvie, and put to vote and
unanimously carried and so ordered.
IN THE MATTER OF COUNTY
PAUPER INVESTIGATOR
Commissioner J. S . Ogilvie nominated Dwight O. Cline for Pauper Investigator at a
salary of $150.00 per month, for a term at the pleasure of the Board. Motion was
seconded by Commissioner Chas. 0. Plumb, and upon vote was unanimously passed.
IN THE MATTER OF PAUPER BURIALS
The matter of pauper burials coming up for consideration by the Board of County
Commissioners and the Board having considered the cost of Pauper burials as well as the
finances of the County, after full discussion, it was moved by Commissioner Ogilvie and
seconded by Commissioner Plumb as follows; to-wit:
The County appoint D. M. Huskey to conduct pauper burials on behalf of the County
at a salary of $60.00 per month, and that the County furnish the casket, head board,
cemetery, and that a record of the death shall be kept on file and the cost of the
burial paid by the County, such salary to cover other services, and continue at the
pleasure of the Board.
Upon vote taken, motion was parsed.
RESOLUTION REGARDING REQUISITION FOR SUPPLIES
OF ALL KINDS PURCHASED BY THE COUNTY, AND
DEFINING REGULATIONS THEREFOR
BE IT RESOLVED:
FIRST: That on or before ten o 'clock. a.m. , on the second andfourth Mondays of each
month, hereafter, the BOARD OF COUNTY COMMISSIONERS will receive and consider requisitions
from all officers, agents and/or employees of the County for any and all books, stationery,
records, printing, lithographing or other supplies and for any and all materials, equiprent
and supplies of every kind or nature proposed to be purchased for and on behalf of Weld
County, and it shall be the duty of every County Officer, agent, and employee to submit
said requisitions therefor on or Pefore ten o'clock, a.m. , of said day.
SECOND: That on each Tuesday morning, following the submission of such requisitions,
as aforesaid, the Board of County Commissioners will authorize the issuance of said requisi-
tions as are deemed necessary, and duly approved by the Board of County Commissioners .
THIRD: That no liability by contract, purchase or agreement shall be create: by any
officer, agent and/or employee of the County for any books, stationery, records, printing,
lithographing, or other supplies, or for any materials, equipment or supplies of any kind
or nature or any other liability of any nature whatsoever, unless there shall be first
presented to the Board ofCounty Commissioners a requisition therefor issued by such officer,
agent, or employee and such requisition has been approved by the Board of County Commis-
sioners, except fot the regular supply of groceries and provisions for the Greeley Hospital
and County Hospital, which may be purchased by the Superintendent thereof, upon requisition
issued by the Chairman of the hoard of County Commissioners, and, further, except that in
case of an emergency for necessary repairs at the County Shops, the Superintendent of the
County Shops may, on a requisition issued by the Chairman of the Board of County Commission-
ers, purchase such emergency repairs to the amount needed for immediate use or repair of
equipment or machinery, but such emergency purchase shall be limited to the immediate need
for repairs, and shall not include any supplies for future use or future emergencies.
FOURTH: Any purchases made other than as in this resolution provided by any officer,
agent or employee of Weld County, shall be deemed without authority of the Board of County
Commissioners and payment therefor shall be refused by the Board of County Commissioners,
and, in the event any officer, agent or employee of Weld County shall exceed his authority,
as herein provided, all purchases made in excess of such authority shall be charged against

the salary or other emoluments due such officer, agent, or employee .

IN THE MATTER OF LICENSES
OF AUCTIONEERS IN COUNTY
( y It was moved by Commissioner J. S. Ogilvie and seconded by Commissioner Chas. 0. Plumb
that the annual fee for Auctioneers License be fixed at the sum of p5.00, and that such
licenses be issued by the Clerk of the Board of County Commissioners upon payment therefor.
The Clerk of the Board of County Commissioners shall notify each Auctioneer that such
license fee is now due and said Clerk is authorized to take all necessary action to enforce
the statutes concerning the issuance of such licenses.
On vote, unanimously carried and ordered.
IN THE MATTER OF APPOINTMENT OF SUPERINTENDENT
OF COUNTY HOSPITAL, ISLAND GROVE PARK
It was moved by Commissioner Chas . O. Plumb and seconded by Commissioner J. S. Ogilvie
that Mrs . S. Elizabeth Fuqua be appointed Superintendent of the County Hospital at Island
Grove Park, at a salary of $100.00 per month.
On vote, unanimously carried and so ordered.

Commissioner J. S. Ogilvie moved the adoption of the following resolution:
BE IT RESOLVED, That the McVey Printery, Inc. , a corporation, be given the contract for
the county printing of supplies for the various Weld County officials for the year 1936 at
the prices contained in the bid made by said corporation t the Board of County Commissionrs,
with the understanding and agreement between the Board of bounty Commissioners andsaid
corporation that the said corporation will divide the printing with other printers of Weld
County when this can be done without sacrifice of quality and workmanship. That, before
ordering any type set or any printing done outside of Weld County, The McVey Printery, Inc.
shall first have the approval, by resolution, of the Board of County Commissioners . The
Board of County Commissioners shall have the right to terminate the above designation and
agreement upon written notice to the McVey Printery, Inc .

BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado, that a '
The Greeley Booster be designated as the official newspaper for publication of proceedings
of the Board of County Commissioners upon the following terms;
Publication of the proceedings of The Board of County Commissioners, solid Nonpareil,
single column measure, on insertion, price per inch, sixty-five (65) cents, to be published
in The Greeley Booster and circulated through newspapers belonging to the Weld County
Publishers ' Association, namely:
The Erie Herald The Johnstown Breeze The Windsor Poudre Valley
The New Raymer Enterprise The Hudson News The La Salle Record
The Ault Progress The Eaton Herald The Nunn News
The Briggsdale Banner The Milliken Mail The Fort Lupton Press
The Platteville Herald
in order that the widest possible publicity be given the proceedings .
The compensation is to be divided as follows: For publication in the Greeley Booster,
forty (40) cents per inch; for circulation in the other papers, as above provided, twenty-
five (25) cents per inch; the county to pay The Greeley Booster, and The Greeley Booster
to pay the other papers, when and as paid by theCounty . The Greeley Booster shall furnish,
free of cost, to the other said newspapers, the type used in such publications .
The Board of County Commissioners shall have the right to terminate the above designa-
tion and arrangements upon written notice to The G reeley Booster .
Before ordering any type set or any printing done outside of WeldCounty, The Greeley
Booster shall first have the approval, by resolution of the. Board ofCounty Commissioners .

OF LEGAL NOTICES
Commissioner Chas . 0. Plumb moved the adoption of the following resolution in the 257
matter of publication of all necessary advertising, such as delinquent tax list, County
Clerk' s semi-annual statement, and all other notices required, by law, to be published by
the various Weld County officials except such notices as are required to be published in a
daily newspaper:
BE IT RESOLVED, by the Board of County Commissioners ofWeld County, Colorado, that The
Greeley Booster be disignated as the official newspaper for publication of legal notices as
set forth in the first paragraph above , upon the following terms:
Publication of the Delinquent Tax List, County Clerk's Semi-annual Statement, and all
other notices required by law to be published by the various Weld County Officials, to be
run in The Greeley Booster at the rate of 40 cents per single column inch for the first
insertion, and 30 cents per single column inch e_.ch subsequent insertion. All notices to
be set in solid nonpareil.
Before ordering any type set or any printing done outside of Weld County, The Greeley
Booster shall first have the approval, by resolution, of the Board of County Commissioners.
The Board of County Commissioners shall have the right to terminate the above designa-

Beer only, and the said applicant, having paid to the County Treasurer of Weld County the
sum of Fifty Dollars (y50 .00) therefor, and having produced a state retail license for sale
of 3.2/ Beer only, outside the corporate limits of any town or city in the County of Weld,
at the location described as follows: LUNCH ROOM AT BRIGGSDALE, COLORADO,
and the County Commissioners, having examined the said application and the other
qualifications of the applicaht do hereby grant a license to said applicant to sell 3.2%

IN THE MATTER OF LOST TAX SALE
CERTIFICATE NO. 614/1931
CERTIFICATE
We hereby certify that on this 13th day of January, A.D. , 1936, W. E. Freeman c ,
appeared before the Board of County Commissioners of Weld County, Colorado, and filed his
affidavit showing that at the sale of real estate heretofore, by the Treasurer of Weld
County, Colorado, held on December, 12, 1931 for the delinquent taxes of the year 1930,
he became the purchaser of the West half (Wi) of Section Two (2) , Township Seven (7)
North, Range Sixty-One (61) West of the 6th P.M. , Weld County, Colorado , and said County
Treasurer issued to him a Certificate of Purchase therefor, which said certificate was
numbered 614 of the Sales of the year 1931, on which the tax for the year 1931 was there-
after endorsed; thatsaid certificate was by him sold and assigned on or about January 10,
1932 to C. B. Parsons and H. R. Parsons; that the said C. B. Parsons and H. R. Parsons
have filed an affidavit showing the purchase from said W. E. Freeman and the assignment to
them of said Certificate of Purchase and that said Certificate of Purchase has been lost
and that said C. B. Parsons and H. R. Parsons, after diligent search, have been and still
are unable to find the same; that they are now the owners of said real estate and that said
tax sale standing upon the records of said county unredeemed is a cloud upon their title
thereto.
We further certify that we have received and considered evidence supporting said
affidavits and evidence constitute satisfactory proof of the facts stated and we do hereby
find and certify that said Certificate of Purchase given by said Treasurer for said lands
sold for said taxes as aforesaid has been lost and has not been sold nor assigned by said
C . B. Parsons and H. R. Parsons; that said lands have not been redeemed from said tax sale .
IT IS THEREFORE ORDERED That this certificate of such proof and findings be properly
attested by the County Clerk of Weld County, Colorado, under the seal of said Weld County,
Colorado, and delivered to said C . B. Parsons and H. R. Parsons as the rightful claimant
of said certificate and that a record hereof shall be duly made by said Clerk in the recorded
proceedings of this Board.
And said C. B. Parsons and 11. R. Parsors, having filed their personal bond in the sum
of One Hundred Sixty and 46/100 Dollars (4160. 46) to indemnify, save and keep harmless the
County of Weld and State of Colorado and all of its officers from all damages, suits and
claims of whatsoever nature occasioned by the redemption of said land from said tax sale
without the surrender of skid original Certificate of Purchase, IT IS FURTHER ORDERED That
said County Treasurer of Weld County, Colorado, is hereby authorized, upon presentation and
surrender of this certificate, attested by said Clerk under the seal of said county, and
the payment of redemption fees only, to issue his certificate of redemption of said lands
from said tax sale to said C . B: Parsons and H. R. Parsons, without the surrencer of said
original Certificate of Purchase .

ment dated January 18th, 1936, and that the Chairman of the Board of County Commissioners
is hereby authori,ed and directed to sign said agreement on behalf of Weld County, Colorado.

IN THE MATTER OF AGREEMENT BETWEEN WELD COUNTY
AND THE JOHNSTOWN MOTOR COMPANY FOR THE PURCHASE
OF THREE TRUCKS AGREEMENT
THIS AGREEMENT made at Greeley, Colorado, this 18th day of January, 1936, by and between
THE COUNTY OF WELD, a quasi municipal corporation, hereinafter called First Party, and
THE JOHNSTOWN MOTOR COMPANY, a Colorado corporation, hereinafter called Sedond Party,
WITNESSETH:
WHEREAS, second party has entered into an agreement with the United States Treasury
Department, State Procurement Office, to furnish to Works Progress Administration three Ford
Trucks, Model Number 1936, 131" Dual, one and one-half ton capacity, and is to receive
seventy-five cents (75fi) per hour as rental price for each of said trucks to be used upon
Weld County Roads W. P. A. Project No. 85, and
WHEREAS, first party desires to acquire title to said trucks,
NOW, THEREFORE, IT IS AGREED by and between the parties hereto that first party will
at all times furnish a driver for each of said trucks; that second party is making a charge
aainst and for said trucks in the total amount of Nine ,-undyed Thirty and 65/100 Dollars _
(930.65) each, representing the following items, to-wit:

That first party will furnish and deliver for use in said trucks all necessary oil,
gas, and repairs, and will c'_.arge second party regular retail price less the gas tax there-
for; first party shall bill second party at the end of each calendar month for all oil, gas
and repairs furnished during the month preceding and second party shall pay the same at such
time, and shall keep an account, thereof and add to the total price of the truck. Rentals
received each month shall be applied first to the payment for oil, gas and repairs and the
excess shall be applied upon the purchase price of the truck. When second party has received
as rental from the Treasury Department and has applied the total sum of Nine Hundred Thirty
and 65/100 Dollars ($930.65) for each truck and has paid first party for all oil, gas, and
repairs furnished, then second party agrees to deliver to first party good and sufficient
transfer of title and certificates of title for said trucks and thereafter the said trucks
shall be the property of first Party.
IT IS FURTHER STIPULATEL AITL% AGREED that should Works Progress Administration cease to
pay the rental of seventy-five cents (75¢) per hour to second party before the total sums
hereinabove indicated have been paid or if this contract shall not be completed within ten
months time , first party agrees to pay the unpaid portion of the original purchase price,
to-wit, Nine Hundred Thirty and 65/100 Dollars ($930.66) , and cancel such sums as shall
remain unpaid to first party for the gas, oil and repairs theretofore furnished and title
shall then be transferred to first party.

THIS AGREEMENT made at Greeley, Colorado, this 18th day of January, 1936, by and be-
tween THE COUNTY OF WELD, a quasi municipal corporation, hereinafter called First Party, and
GALLAND CHEVROLET, INC. , a Colorado corporation, hereinafter called Second Party, WITNESSETH:
WHEREAS, second party has entered into an agreement with the United States Treasury
Department , State Procurement Office, to furnish to Works Progress Administration three
Chevrolet Trucks, Model Number 1936, 131" dual, one and one-half ton capacity, and is to
receive seventy-five cents (75¢) per hour as rental rice for each of said trucks to be used
upon Weld County Roads W. P. A. Project. No. 85, and
WHEREAS, first party desires to acquire title to said trucks,
NOW, THEREFORE, IT IS AGREED BY and between the parties hereto that first party will
at all times furnish a driver for each of said trucks ; that second party is making a charge
against and for said trucks in the total amount of Nine Hundred Six and 40/100 Dollars
(4p906.40) each, representing the following items, to-wit:

That first party will furnish and deliver for use in said trucks all necessary oil,
gas and repairs and will charge second party regular retail price less the gas tax there-
for; first party shall bill second party at the end of each calendar month; for all oil, gas
and repairs furnished during the month preceding and second party shall pay the same at
such time and shall keep an account thereof and add to the total price of the truck.
Rentals received each month shall be applied first to the payment for oil, gas and repairs
and the excess shall be applied upon the purchase price of the truck. When second party has
received as rental from the Treasury Department and has applied the total sum of Nine
Hundred Six and 40/100 Dollars ($906.40) for each truck and has paid first party for all
oil, gas and repairs furnished, then second party agrees to deliver to first party good and
sufficient transfer of title and certificates of title for said trucks and thereafter the
said trucks shall be the property of first party.
IT IS FURTHER STIPULATED AND AGREED that should Wprks Progress Administration cease
to pay the rental of seventy-five cents (75w) per hour to second party before the total sums
hereinabove indicated have been paid or if this contract shall not be completed within ten
months time, first party agrees to pay the unpaid portion of tho original purchase price,
to-wit: Nine Hundred Six and 40/100 Dollars (.906.40) and cancel such sums as shall remain
unpaid to first party for the gas, oil and repairs theretofore furnished and title shallthen
be transferred to first party.
IT IS FURTHER STIPULATED AND AGREED that first party agrees to remiburse second party
for any and all taxes assessed against second party by reason of ownership of said three
trucks.

of five years beginning March 1st, 1931, and ending March 1st, 1936, a portion of its right
of way in said County for storage or road and bridge material, gasoline and oil for use in
connection with road construction and maintenance on the part of the lessee, said lease
being identified as Union Pacific Railroad Company' s Audit Lease No . 39943; and
WHEREAS, the Railroad Company has tendered to the County an agreement extending the
term of said lease dated April 3rd, 1931, for a period of five years beginning March 1st,
1936; and
WHEREAS, the Board of County Commissioners of the said County of Weld, Colorado, has
said proposed agreement before it and has given it careful review and consideration; and
WHEREAS, it is considered that the best interest of the .said County of Weld, Colorado,
will be subserved by an acceptance of said agreement;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD,
COLORADO:
That the terms of the agreement submitted by the Union Pacific Railroad Company as

approved and the Clerk ordered to draw a warrant payable to S . D. Griffith in the amount of
w287.50 in full payment of salary as claimed.
Commissioner Chas . 0. Plumb stated, "I find no evidence that 1r. Griffithb employment
was outhorized for the past year, other than a Court Order subject to approval by the
previous Board. There is no evidence that the previous Board approved this order. r:r.
Griffith was given notice by the present Board of County Commissioners that his services
would not be needed after January 15, 1935, and his pay was stopped at that time . There
was no money provided in any Court Budget to pay a Librarian. The Librarian was not
carried on either the County Court or the District Court payroll, but on the Court House
Custodian' s payroll, which has been under the jurisdiction of the Board of County
Commissioners. It is my opinion that the County Commissioners had the authority to dis-
charge Mr. Griffith and, since he was discharged, cannot see that he is entitled to pay
since the time of discharge ."

WHEREAS, second party has entered into an agreement with the United States Treasury
Department, State Procurement Office, to furnish to Works Progress Administration three
Ford Trucks, Model N:mber 1936, 131" Dual, one and one-half ton capacity, and is to receive
seventy-five cents (75¢x) per hour as rental price for each of said trucks to be used upon
Weld County goads W.P.A. Project No. 1076, and
WHEREAS, first party desires to acquire title to said trucks,

at all times furnish a driver for each of said trucks; that second party is making a charge

and repairs and will charge second party regular retail. price less the gas tax therefor;
first party shall bill second party at the end of each calendar month for all oil, gas and
repairs furnished during the month preceding and second party shall nay the same at such
time and shall keep an account thereof and add to the total pr4ceof the truck. Rentals
received each month shall be applied first to the payment for oil, gas and repairs and the
excess shall be applied upon the purchase price of the truck. When second party has received
as rental from the Treasury Department and has applied the total sum of Twelve Hundred
Seventy-five and 44/100 Dollars 01,275.44) for each truck and has paid first party for all
oil, gas and repairs furnished, then second party agrees to deliver to first party good and
sufficient transfer of title and certificates of title for said trucks and thereafter the
said trucks shall be the property of first party.
IT IS FURTHER STIPULATED AND AGREED THAT should Works Progress Administration cease to
pay the rental of seventy-five cents (750') per hour to second party before the total sums
hereinabove indicated have been paid or if this contract shall not be completed within ten
months time, first party agrees to nay the unpaid portion of the original purchase Price,
to-wit, Twelve Hundred. S venty-five and 44/100 Dollars 01,275.44) and cancel such sums as
shall remain unpaid to firstparty for the gas, oil and repairs theretofore furnished and
title shall then be transferred to first party.
IT IS FURTHER STIPULATED AND AGREE- that first party agrees to reimburse second party
for any and all taxes assessed against second party by reason of ownership of said three
trucks.

running North and South between Sections 21 and 22, Township 6 North, Range 67 West of the
6th P.M. , in Weld County, Colorado, and
WHEREAS, it is necessary to establish a road eighty (80) feet in width along section
line between said sections and it is necessary for Weld County to acgi'ire strips of land
ten (10) feet wide on either side of portions of the highway running between said Sections
21 and 22.
NOW, THEREFORE, BE IT RESOLVED, By the Board of County Commissioners ofWeld County,
Colorado, that an eighty (80) foot right of way of the ublic highway extending North and
South along the Section line between Sections 21 and 22, Township 6 North, Range 67 West
of the 6th P.M. , in Weld County, Colorado, is hereby declared to be necessary for the
improvement of said public highway and that proceedings shall be had as may be necessary
to acquire by condemnation, or other judicial proceedings , any part of the right of way
therefor, without further direction from the Board of County Commissioners of Weld County,

resolution:
WHEREAS, The State of Colorado, cooperating with the United States Bureau of Public
Roads, has established what is known as Project FAP 285-H, as a part of State highway No.
81, in Weld County, Colorado, and,
WHEREAS, In order to comply with the requirements of the United States Bureau of Public
Roads, it is necessary to establish a road One Hi'ndred (100) feet in width across the
following lands, described as parcels , as follows:
Parcel A: A strip of land extending from the South line to the North line of the South
Half of the South Half, Section 33, Township 3 North, Range Sixty Two (62) West of the 6th
P.M. , in Weld County, Colorado, 180 feet in width, and lying 50 feet right and 50 feet left
at right angles to the following described line. Beginning at a point on the South line of
said South Half of Section 33, 1735 feet East of the Southwest corner of said Section 33:
Thence N 65° 391 E 2688 feet, more or less, to a point on the forth line of said South Half
South Half of Section 33. Said parcel contains 6.18 acres, more or less .

NOW, on this 13th day of February, A.D. , 1936, it appearing to this Board of County
Commissioners that the Treasurer of Meld County has heretofore at a regular Tax Sale sold
to one C. Emerson Tax Sale Certificate No. 202 of the year 1875 affecting: The SE4NE4
24-4N-Rge 62W of the 6th P.M. , which Tax Sale Certificate was never presented by C .
Emerson or anyone claiming under him for issuance of a Treasurer' s Deed thereon;
It further appearing that subsequent to the issuance of said Tax SaleCertificate the
said C . Emerson paid taxes for one year and that thereafter taxes against the SE4NEY of
Section 24 aforesaid have been paid by the owner of the fee title to said land; and
It further appearing that on or about the 27th day of December, A.D. 1935 John
Wallace Mackey, owner of the fee title to the real estate involved in said Tax Sale
Certificate paid into the Treasurer of Weld County for the redemption of said Tax Sale
Certificate the sun of $114.70 being the total amount of principal, interest and penalties
due thereon; and
It further appearing that John Wallace Mackey has now obtained an assignment of the
aforesaid tax Sale Certificate from all of the heirs-at-law of C . Emerson, deceased, who
are now living and that said John Wallace Mackey has made, executed and delivered to the
Treasurer of Weld County his bond in the sum of $230 to protect the Treasurer of Weld
County against anyone claiming to be the owner of said Tax Sale Certificate No. 202 of the
year 1875, which is alleged to have been lost or destroyed.
NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners in regular session
duly assembled that the Treasurer of Weld County, Colorado, be, and he hereby is authorized,
empowered and directed to accept the Assignment of said Tax Sale Certificate No . 202 of the
year 1875 as tendered by said John Wallace Mackey, together with Bond running; to the people
of the State of Colorado as provided by law to protect the Treasurer of Weld County against
anyone claiming to be entitled to the proceeds of the redemption money paid for said Tax
Sale Certificate and to forthwith pay to John Wallace Mackey the amount paid for the
redemption of said Tax Sale Certificate less the fees and expense in the issuance of
redemption Certific :te therefor .

THIS AGREEMENT made at Greeley, Colorado, this 21st day of February, 1936, by and , ' `
between THE COUNTY OF WELD, a quasi municipal corporation, hereinafter called First Party,
the ELLIOTT CHEVROLET, hereinafter called Second Party, WITNESSETH:
WHEREAS, second party has entered into an agreement with the United States Treasury
Department, State Procurement Office, to furnish to Works Progress Administration two
Chevrolet Trucks, Model Number 1936, 131 " Dual, one and one-half ton capacity, and is to
receive seventy-five cents (75 ) per hour as rental price for each of said trucks to be used
upon Weld County Roads W.P.A. Project No. 402 and
WHEREAS, first party desires to acquire title to said trucks,
NOW, THEREFORE, IT IS AGREED by and between the parties hereto that first party will
at all times furnish a driver for each of said trucks; that second party is making a charge
against and for said trucks in the total amount of Nine Hundred Twenty-four and 95/100
Dollars ($924.95) each, representing the following items, to-wit:

That first party will furnish and deliver for use in said trucks all necessary oil, gas
and repairs and will charge second party regular retail price less the gas tax therefor;
first party shall bill second party at the end of each calendar month for all oil, gas and
repairs furnished during the month preceding and second ;, arty shall pay the same at such
time and shall keep an account thereof and add to the total price of the truck. Rentals
received each month shall be applied first to the payment for oil, gas and repairs and the
excess shall be applied Upon the purchase price of the truck. When second party has received
as rental from the Treasury 1.)erartment and has applied the total sum of Nine hundred Twenty-
four and 95/100 Dollars ($924.95) for each truck and has paid first party for all oil, gas
and repairs furnished, then second party agrees to deliver to first party good and sufficient
transfer of title and certificates of title for said trucks and thereafter the said trucks
shall be the property of first party.
IT IS FURTHER STIPULATED AND AGREED that should Works Progress Administration cease
to pay the rental of seventy-five cents (75�) per hour to second party before the total
sums hereinabove indicated have been paid or if this contract shall not be completed within
ten months time, first party agrees to pay the unsaid portion of the original purchase
price, to-Wit, Nine hundred Twenty-four and 95/100 Dollars ($924.95) and cancel such sums
as shall remain unpaid to first party for the gas, oil, and repairs theretofore furnished
and title shall then be trnasferred to first party.
IT IS FURTHER STIPULATED AND AGREED that first party agrees to reim i rse second party
for aria and all taxes assessed against second party by reason of ownership of said Two
trucks.
IN WITNESS whereof first party has caused this agreement to be signed pursuant to
resolution of Board of County commissioners, and second party has caused its corporate name

Trucks, Model Number 1936, 131" Dual, one and one-half ton capacity, and is to receive seventy-
five cents (75w) per hour as rental price for each of said trucks to be used upon Weld County
Roads, being Highway No. 52, W, P. A. Project No. 87, and highway No. 60, W. P. A. Project
No. 402, and
WHEREAS, first party desires to acquire title to said trucks,

title shall then be transferred to first party. Time is of the essence of this contract .
IT IS FURTHER STIPULATED AND AGREED that first party agrees to reimburse second party
for any and all taxes assessed against second party by reason of ownership of said two
trucks.

And the County Commissioners, having examined the said application and the other

COMPANY OF DENVER, COLORADO
WHEREAS, THE CAPITOL LIFE INSURNCE COMPANY, of Denver, Colorado, has offered to sell
to Weld County a group insurance policy on the employees of said Weld County, to insure
against loss of life to such employees on the terms and conditions as set forty in the
specimen policy submitted, and
WHEREAS, The Board of County Commissioners of Weld County now deems it advisable to
buy said policy and to pay the premium thereon.
IT IS, THEREFORE, ORDERED By the Board of County Commissioners of Weld County that the
said Capitol Life Insurance Company be, and is hereby authorized to issue said policy and
the County agrees to pay the premiums thereon, as provided in the specimen policy, when and
if said insurance policy is written, issued and delivered untothe possession of Weld County.

Colorado, containing five (5) acres, more or less, together with one (1) share of the

line of the Chicago, Burlington & Quincy Railroad and the South right ofway line of State
Road No. 81, as constructed, in WeldCounty, Colorado, and,
WHEREAS, Same was acquired as exchange land for the The Great Western Sugar Company,
in exchange for land for right of way for N.R.H. (USPW) Project No. 285-E, extending
Northeasterly from Judson to Keenesburg, in Weld County, Colorado, and
WHEREAS, Resolution has heretofore been made and entered in these records in Book 21,
Page 272, dated February 18, 1935, recording deed heretofore acquired, conveying to The
Great Western Sugar Company, a corporation, a strip of land improperly described, and
WHEREAS, The aforesaid deed has not been delivered to The Great Western Sugar Company,
and has not been recorded by the County Clerk and Recorder of Weld County, Colorado, and,
WHEREAS, This deed, dated March 25, 1936 is to be made to correct the errors in the
aforesaid deed dated February 18, 1935, and is a proper description of the lands intended
to be conveyed to The Great Western Sugar Company.
NOW, THEREFORE, BE IT RESOLVED, That the County sell to said The Great Western Sugar
Company, a corporation, in exchange for said land for right of way for N.R.H. (USPW)
Project No . 285-E, extending N rtheasterly from Hudson to Keenesburg, in Weld County,
Colorado, the following described lands, to-wit:

Commencing at the West Quarter corner of Section 28, Twonship 2 North, of Range 64,
West of the Sixth P.M. ; Thence Easterly along the half-section line for a distance of 30
feet; thence Northerly along the East boundary of the l'Iorth and South County road for 70
feet to the point of beginning. Thence Southeasterly along the N rth boundary of the Chicago,
Burlington & Quincy Railroad right of way, which lies parallel with and 100 feet distant
Northerly from center line of said Chicago,Burlington & Quincy Railroad right of way, for
a distance of 820 feet; thence Northerly and at right angles to the half-section line for
160 feet; thence 1'y rwesterly along the Southboundary of the State highway right of way as

County the sum of Fifty Dollars ( 50.00) therefor, and having produced a state retail
license for sale of 3.2% beer only, outside the corporate limits of any town or city in

THIS AGREEMENT, made and entered into this 20th day of April, 1936, by and between
U:ION PACIFIC RAILROAD COMPANY, a corporation of the State of Utah (hereinafter called
"Lessor" ) , party of the first part, and COUNTY OF WELD, STATE OF COLORADO (hereinafter
called "Lessee" ) , party of the second part, WITNESSETH:
Section 1 . The Lessor hereby leases to the Lessee for a period commencing on the
18th day of April, 1936, and terminating twenty-five (25) years thereafter, unless sooner
terminated in accordance with the terms hereof, the following described strip or parcel of
land situate in the County of Weld, State of Colorado, to be used for highway purposes only:
/ A strip, piece or parcel of land situate in the N rthwest Quarter (NWj) of Section
Three (3) and in the East Half (E'-) of Section four (4), Township Three (3) North, Range
Sixty-seven (67) West of the Sixty Principal I,_eridian, in 'deldCounty, Colorado , described 4
as follows, to-wit:
Beginning at a point in the north line of said Section Three (3) that is one hundred

fifty (150) feet distant northwesterly, measured at right angles, from the center line of
the main track of the Lessor, which said center line of main track intersects the north
line of said section at a point thereon that is one thousand one hundred eighty-seven and
six-tenths (1187.6) feet, more or less, distant east of the northwest corner thereof;
thence east along said north line of Section Three (3) to a point that is seventy(70)
feet distant northwesterly, measured at right angles, from said center line of main track;
thence southwesterly along a straight line parallel with said center line of main
track to a point in a straight line intersecting said center line of main track at right
angles at Railroad Survey Station 2026 plus 00 thereof, which is a point thereon that is
nine hundred eighty-one and eight-tenths (981.8) feet, more or less, distant southwesterly,
measured along said center 1ne of main track, from said north line of Section Three (3) .
thence southwesterly along a straight line to a point that is one hundred ten (110)
feet distant northwesterly from said center line of main track when measured along a
straight line intersecting said center 1'ne of main track at right angles at Railroad
Survey Station 2024 plus 00 thereof;
thence southwesterly along a line parallel with and one hundred ten (110) feet
distant northwesterly, measured at right angles and/or radially, from said center line of
main track to a point in a straight line that is parallel with and sixty (60) feet distant
southerly, measured at right angles, from the east and west center line of said Section
Four (4) ;
thence westerly along said straight line that is parallel with and sixty (60) feet
distant southerly, meeaured at right angles, from said east and west center line of
Section Four (4) , to a point that is one hundred fifty (150) feet distant northwesterly,
measured radially, from said center line of main track;
thence northeasterly along a line that is parallel with and one hundred fifty (150)
feet distant northwesterly, measured radially and/or at right angles from said center line
of main track, to the point of beginning .
EXCEPTING from the above described strip of land any part thereof which is included
within those certain pieces or parcels of land leased by said Lessor to the Great Western
Sugar Company for use in connection with the maintenance and operation of a beet dump and
facilities appurtenant thereto, said parcels leased to The Great Western Sugar Company
being shown in green tint on C . E. Drawing 53009, dated March 12, 1936, marked "Exhibit A"
and hereby made a part hereof.
The premises hereby leased to the Lessee are shown outlined by yellow lines on said
Exhibit A.
Section 2. As a consideration for this lease the Lessee agrees to pay in advance to
the Lessor a rental of five dollars (5.00) per annum; tc assume all taxes and assessments
levied upon the leased premises during the continuance of this lease, not including taxes
or assessments levied against the leased premises as a component part of the railroad prop-
erty of the Lessor in the state as a whole; to construct and maintain the highway on the
leased premises in accordance with plans and profiles submitted to and approved by the
Chief Engineer of the Lessor before the work is commenced; to keep the leased premises free
from combustible material; to plant no trees or shrubbery. and to erect no structures thereon
except such as may be necessary for highway purposes ; to put nothing upon the leased premises
which might obstruct or interfere with the view; to provide, in locations and in accordance
with plans approved by the Lessor before the work is commenced, such ditches, culverts,
bridges and other str'Ictures as may be necessary properly to care for the drainage from said
premises and the adjoining right of way of the Lessor; and to hold the Lessor harmless from
any and all damages to any of such structures on said leased premises arising from fire
caused irectly or indirectly by sparks or fire emitted from the engines or trains of the
Lessor; and further to hold the Lessor harmless from any damages to the highway upon the
leased premises which may result from the construction or maintenance of drainage ditches
or waterways by the Lessor.

The Lessee shall, in the construction, maintenance and improvement of the highway on
the leased premises, take every precaution to prevent damage to, or the impairment of the
stability of, the poles in any pole line of the Lessor or of its tenants; and the Lessee
shall, at its own expense, reset or relocate, at and under the direction of the Lessor any
pole or poles that are, or are likely to be, damaged of weakened because of the construct-
ion of said highway or the maintenance or improvement of the same, or shall reimburse the
Lessor for the cost of resetting or relocating any such pole or poles if the Lessor elects
to do the work itself.
Section 3. In connection with the construction of the highway on the leased premises
the Lessee shall assume the cost of any necessary changes within the limits of the right of
way of the Lessor in the construction, grade or -drainage of highways or other roadways
crossing said right of way.
Section 4. The Lessor reserves the right to' take possession of all or any portion of
the leased premises whenever the use thereof may become necessary or expedient, in the
judgment of the Lessor, for railroad purposes, including the location of public or private
warehouses, elevators, or other structures with the design to facilitate and promote traffic,
or for, or in connection with, drilling for or mining of oil, gas, coal and other minerals
of whatsoever nature underlying the leased premises by the Lessor or by otilers with its
permission; PROVIDED, however, that in the event the Lessor elects to take possession of
all or any portion of the leased premises in accordance with this reservation, it shall
first serve upon the Lessee ninety (90) days written notice of such election.
Section 5. The Lessor reserves the right to cross the leased premises with such
railroad tracks as may be required for its convenience or purposes in such manner as not
unreasonably to interfere with their use as a public highway. In the event the Lessor
shall place tracks upon the leased premises in accordance with this reservation, it shall,
upon completion of such tracks, restore the highway across the same to its former state of
usefulness .
Section 6. The Lessee shall not use the leased premises or permit them to be used
except for the usual and ordinary purposes of a street or highway, and it is expressly
understood and agreed that such purposes shall not be deemed to include the use by the
Lessee, or by others, of the leased premises for railroad, street or interurban railway
or Other rail transportation purposes or for the construction or maintenance or electric
power tr. nsmission lines, gas, oil or gasoline pipe lines.
Section 7. This lease is subject to all outstanding superior rights (including those
infavor of telegraph and telephone companies, and leases to abutting property owners and
others) and to the right of the Lessor torenew and extend the same; and it is understood
that nothing in this lease contained shall be construed as a covenant to put the Lessee into
possession or to protect the Lessee in the peaceable possession of said premises.
Section 8. No special assessments for establishing or improving the highwa • located
upon the leased premises are to be made against the adjacent railroad right of way of the
Lessor, and the Lessee agrees to protect the Lessor against and same it harmless from such
special assessments .
Section 9. The Lessee agrees that, at points where the Lessor at the date hereof main-
tains a fence on its right of way between its track and the inner margin of the leased
premises, the Lessee will, at its own cost and expense, move such fence to the inner margin
of the leased premises, and that, at points where the Lessor does not maintain a fence in
such location, the Lessee will construct a fence on the inner margin of the leased premises
when and where requested in writing by the Lessor. The Lessee further agrees to assume the
responsibility of constructing or of making such arrangements as may be necessary with
owners or lessees or propSr#y abutting upon the right of way along the line ,of said highway
for constructing, maintaining and repair3tg,:fences on the outer margin of the Lessor's
right of way, and to relieve the Lessor of all obligation, if any there be, to establish or
maintain fences upon the outer margin of its right of way and of all expense incident to
the construction, maintenance and repair of such fences . In the relocatio r of existing fences
and in the construction of new fences in accordance with the provisions of this section, the
Lessee shall, at its own cost and expense, also relocate or construct such wing fences that
may be necessary and also any necessary connections with existing fences of the Lessor. All
fences shall be in accordance with the standards of the Lessor and all work of relocating
and constructing fences stall be done in a manner satisfactory to the Lessor .
Section 10. For the purpose of protecting the reversionary interests of the Lessor
against the assertion of adverse rights, the Lessee agrees to prevent encroachments upon
the leased premises, and to this end will, at its own expense, take all necessary action,
including as far as practicable the building of its ditches on and the borrowing of earth
from the outer margin of said leased premises.
Section 11. If the Lessee should breach or fail to keep any of the covenants or condi-
tions hereof, or fail to perform such covenants or con di tions,or to remedy the same for
thirty (30) days after written notice of such failure or breach on the part of the Lessee,
given by the Lessor to the Lessee, then this lease shall be null and void.
Section 12. Non-user by the Lessee of the leased premises for highway purposes con-
tinuing at any time during the term hereof for a period of eighteen (18) months shall, at
the option of the Lessor, work a termination of this lease and of allrights of the Lessee
hereunder, and non-user by the Lessee of a portion of said leased premises continuing for
a like period shall, at the option of the ]Lessor, work a termination of all rights and
interests of the Lessee with respect to such portion.
Section 13. This lease is not to be assigned, nor is any portion of the leased premises
to be bublet, without the written ,consent of the Lessor. The Lessee will surrender
peaceable possession of said premises at the expiration of this lease.
Section 14. All covenants and agreements herein recited are made by the parties hereto
for, and shall be binding upon, themselves and their successors and assigns .

WHEREAS, UNION PACIFIC RAILROAD COMPANY has tendered to the COUNTY OF WELD, STATE OF
COLORADO, an agreement covering the .leasing to the County of land described in said agree-
ment to be used for highway purposes, for a term of twenty-five years beginning April 18,
1936; said agreement being identified as Union Pacific Railroad Company' s Contract
Department No. 21556; and
WHEREAS, The Board of County Commissioners of Weld County has said proposed agreement
before it and has given it careful review and consideration; and
WHEREAS, it is considered that the best interests of said County of Weld will be sub-
served b the acceptance of said agreement;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD,
STATE OF COLORADO:
' That the terms of the agreement submitted by Union Pacific Railroad Company as afore-
said be, and the same are hereby, accepted in behalf of the County of Weld, State of
Colorado;
That the Chairman of the Board of County Commissioners of said County is hereby
authorized, empowered and directed to execute said agreement on behalf of said County, and
that the County Clerk is hereby authorized and directed to attest such agreement and to
. attach to each duplicate original of said agreement a certified copy of this resolution.

STATEt'ENT BY. MR. PLUMB:
I wish to go on record as not approving the increase in pay for the Clerk of the
District Court ordered by the judges subject to the approval of the Board of County Commiss-
ioners. The Budget allowed the first of the year was approved by all members of the Board
with the exception of items in connection with the Law Library and Law Books. The budget •
was passed after a serious attempt on the part of the commissioners to arrive at a general
agreement with the various office heads with respect to salaries throughout the Court House.
There has been a race to see which office in the Court H,suse could pay its help best.
There has been a general realization of this and we had hoped that by getting together the
first of the year this contest could be stopped before it got too costly to the public . I
can not see any emergency need of increasing pay beyond the amount budgeted and can not
approve pay rolls adking increases except where there is an emergency. A4]owing such
increases will merely create further dissatisfaction and demands for higher pay elsewhere .

THIS LEASE made and entered into this 22nd day of April, 1936, by and between NONA A.
BENNETT, hereinafter called "Lessor", and WELD COUNTY, COLORADO, a quasi municipal corpora-
tion, hereinafter called "Lessee", WITNESSETH:
That in consideration of the payment of the rent hereinafter provided and the keeping
and performing of each of the covenants of the said lessee hereinafter set forth, said
lessor has and does hereby lease unto the said lessee the following described premises
situate in the City of Greeley, Colorado, to-wit:
The ground floor of that building known as "The Harry Dowell Building" being No. 725
Tenth Street, City of Greeley, except that the garages in the rear are not included,
to have and to hold the same with all the appurtenances unto the said lessee from April
22, 1936, to and until twelve o 'clock noon on the first day of Janiary, A.D. 1937, at and
for a rental of Forty Dollars ($40.00) per month, payable at the end of each calendar
month.
IT IS UNDERSTOOD that for the remaining, portion of the month of April, 1936, lessee
will pay proportionately for the time said building is occupied.
IT IS FURTHER DISTRINTLY UNDERSTOOD ANL AGREED that should the National Reemployment
Service be discontinued prior to the expiration of this lease, then upon ten days notice,
this lease may be terminated by lessee at any time between now and the date of expiration.
Lessor agrees to furnish }eat and water but lessee shall furnish other janitor service

for the said premises.
Lessee agrees to keep the irprovements upon said premises in as good order and
condition as when the same were entered upon, loss by tire, inevitable accident and ordinary
wear excepted, to sublet no part of said premises nor to assign this lease no any interest
therein without the written consent of the lessor first being obtained, to use the said
premises for the purpose of an office for the National Reemployment Service .
IT IS MUTUALLY AGREED that if after the expiration of th; s lease the lessee shall
remian in possession of said premises and continue to pay rent without express agreement as
to such holding, then such holding over shall be deemed and taken to be a holding upon
a tenancy from month to mont' at a rental equivalent to the monthly installments herein-
above provided.
IT IS FURTHER AGREED that the terms of this lease shall be binding upon and apply to
the heirs, successors, assigns and legal representatives of both parties.
IN WITNESS Whereof first party has hereunto set her hand and second party has caused
this lease to be signed pursuant to resolution of the Board of County Commissioners as of

WHEREAS, E,: Mc Laughlin, of Weld County, Colorado, has presented to the Board of County
Commissioners of Weld County his application for a County Retail license for sale of 3.2%
Beer only, and the said applicant, having paid to the County Treasurer of Weld County the
sum of Fifty Dollars ($50.00) therefor, and having produced a state retail license for sale
of 3.2% Beer only, outside the corporate li mits of any town or city in the County of Weld,
at the location described asfollows: Lunch Room and Beer, Galeton, Colorado, and the
County Commissioners, having examined the sale application and the other qualifications of
the applicant do hereby grant a license to said applicant to sell 3.2% beer only at retail,
at said place, and do hereby authorize and diredt the issuance of said license by the
Chairman of the Board, attested by the County Clerk and Recorder of Weld County, good for
one year from the date of issue unless revoked, according to law, provided, however, that
said license shall be issued upon the express condition and agreement that the place where
licensee is authorized to sell beer under said license will be conducted in strict con-
formity to all laws of the State of Colorado and any violation thereof shall be cause for
revocation of the license .

IN THE MATTER OF APPLICATION FOR LICENSE TO
CONDUCT PUBLIC DANCE HALL , MRS . J. B. LANG
Mrs. J. B. Lang, Route 4, Longmont, Colorado, being desirous of complying with the
statute relating to the licensing of Dance Halls, petitioned the Board of County
Commissioners for issuance of the license to operate for one year, and deposited the
required fee of $25.00.
On motion made, seconded, and on vote carried, it was ordered that the license be
granted as petitioned for, subject to the compliance with the statute and resolution of
the Board previously adopted.
IN THE MATTER OF ESTABLISHING A "PUBLIC WELFARE
ADMINISTRATION FUND" AND TO TRANSFER FROM PAUPER TO
PUBLIC WELFARE ADMINISTRATION FUNDS $5,000.00
WHEREAS, Senate Bill No. One, Section Fourteen of the Second Extraordinary Session of
1936 provides that: "The Board of County Commissioners shall make appropriations where
necessary to maintain the necessary welfare services within the county and to defray the
cost of administration of the services, and for the payment of such expenses during the now
current county fiscal year may transfer, in their discretion, available funds from any
other existing county fund", and
WHEREAS, Colorado State Department of Public Welfare Bulletin No. 21 provides that
"There shall be established in each county of the state a fund known as the 'Public Welfare
Administration Fund", and that "all administrative expenses for welfare purposes, clerical
help, office supplies, etc., must be paid from this fund" .
NOW, THEREFORE, BE IT RESOLVED, That the County Treasurer be and he is hereby author-
ized and directed to establish a fund to be designated "Public Welfare Administration Fund"
and to transfer from and credit to said funds as follows, to-wit:

CLAIM OF WELD COUNTY TO UNITED STATES
FIDELITY & GUARANTY COMPANY (KOUNTZE
BROTHERS - PATTERSON)
WHEREAS, United States Fidelity and Guaranty Company, a Corporation of the State of
Maryland, on or about the 31 day of January, 1936, paid to Harvey E. Witwer, as Treasurer
of Weld County, Colorado, the sum of $20,737.61, in full settlement, satisfaction and
discharge of that certain judgment entered in the District Court of Weld County, Colorado,
on or about the 29th day of November, 1933, for the principal sum of $17,926.40, together
with interest thereon and court costs, in that certain action therein pending wherein the
people of the State of Colorado ex rel. The Board of County Commissioners of the County of
Weld were plaintiffs and Jesse R. Patterson and said United States Fidelity and Guaranty
Company, a Corporation, were defendants, the same being case number 8647 on the docket of
said court, and
WHEREAS, said action was brought to recover the sum of $16,708.52 against said Patter-
son, a former county Treasurer of said county, and said United States Fidelity and Guaranty
Company, as surety on his official bond as such County Treasurer, by reason of said Patterson
having from time to time during his tenure of office deposited with t he banking house of
Kountze Brothers', New York City, New York, certain sums of money to meet the payment of
interest upon certain schooldistrict bonds, as is more fully set forth in the complaint filed
in said action, and
WHEREAS, there was on deposit with said Kountze Brothers at the time of their becoming
insolvent and suspending business, and on or about October 13, 1931, the sum last specified,
to the credit of "Weld County", and
WHEREAS, said Kountze Brothers were thereafter adjudged bankrupts in the United States
District Court for the Southern District of New York, and
WHEREAS, thereafter and on or about the day of April, 1932, said Weld County filed
its certain claim against said bankrupts' estate for the sum last specified, and
WHEREAS, said claim was duly approved and allowed as a general claim against the assets
of said estate, and disallowed as a preferred claim, and

-WHIEREAS, nothing has been paid on account of said claim to said Weld County or to any
of said school districts or to any of the holders of said school district bonds, NOW,
TLEREFORE,
BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, for the
reasons aforesaid, and in consideration of the premises, that the said claim be, and the
same is, hereby transferred and set over absolutely to said United States Fidelity and
Guaranty Company, together with all the tight, title and interest of said Weld County,
which it now, or at any time heretofore, has had therein, and said Board is hereby authori-
zed and instructed to forthwith execute an assignment thereof to said company, in such
form as may be approved th eht County Attorney of said county, and this shall be their
sufficient warrant and authority for so doing.

The minutes of the tenth instant were read, and there being no corrections of
objections thereto, on motion same ordered approved as read.
IN THE MATTER OF RESOLUTION RE:
QUIT CLAIM DEED TO WM. J. KETLEY, O.A.P.
WHEREAS, on June 29, 1934, William J. Ketley and Etta L. M. Ketley of Greeley, Weld
\ County, Colorado, as joint tenants and not as tenants in common, by quit claim deed,
recorded in Book 973 at page 41, Weld County records, conveyed to Wm. A. Carlson, James S.
Ogilvie and S. K. Clark, the County Commissioners of said County, their successors or
successors in office and assigns, as Trustees, of the Old Age Pension Fund, in said County,
in trust, for the use of said fund, the following described property, situate in Weld County,
Colorado, towit:
The forth Ten (10) feet of Lot 17 and the West 140 feet of Lots 18 and 19, all in
Normal Way Subdivision, in the City of Greeley,
And Whereas, prior to the execution and delivery of said deed, aforesaid, Etta L. M.
Ketley, the then owner of said property, on October 23, 1929, made, executed and delivered
Charles H. Hallett and Francis A. Riley of Greeley, Weld County, olorado, her certain
warranty deed, conveying,
The east 50.05-feet of the forth 10 feet of Lot 17 and the Bast 50.05 feet of Lots
18 and 19, all in N rmal Way, a Subdivision of a part of Block 163, in the City of Greeley,
Weld County, Colorado,
And Whereas, in said deed tosaid Commissioners, as Trustees, aforesaid, there was
inadvertently conveyed and described, said East 50.05 feet of the north 10 feet of Lot 17,
above described, which had priorthereto been conveyed, by said Etta L. M. Ketley to said
Charles H. Hallett and Francis A. Riley,
And Whereas, said Etta L. M. Ketley departed this life in Greeley, Colorado, August
14th, 1935,
And Whereas, Chas. 0. Plumb, James S. Ogilvie and S. K. Clark are the duly elected,
qualified and acting County Commissioners of Weld County, Colorado,
And Whereas, said County Commissioners are the County Board of Public Welfare of Weld
County, Colorado, so constituted by Chapter 7 of the Session Laws of 1936 of the State of
Colorado, Second Extraofdinary Session, and as such Board have succeeded to all rights and
titles of said County Commissioners, as Trustees of the Old Age Pension Fund,
1OW, THEREFORE, Be it Resolved, in order to clear the title to the hereinafter des-
cribed property, that the Board of County Commissioners ofWeld. County, Colorado, as
Trustees of the Old Age Pension Fund, in said County, and as the County Board of Public
Welfareof Weld County, Colorado, be and it is hereby authorized to make, execute and deliver
to William J. Ketley, a oust claim deed, in and to:
The East 50.05 feet of the Borth 10 feet of Lot 17, in Normal Way Subdivision of Block
163, in the City of Greeley, Weld County, Colorado."
