RE: APPROVAL OF RECORDED EXEMPTION NO. 335 - EAST GREELEY LAND
COMPANY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 11th day of September, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 335, being the property of
East Greeley Land Company, described as part of the Southwest
Quarter of Section 3, Township 5 North, Range 66 West of the
6th P.M. , Weld County, Colorado, being more particularly described
as follows:
A tract of land located in the Southwest Quarter
and a part of the Southeast Quarter of Section 3,
Township 5 North, Range 66 West of the Sixth
Principal Meridian, Weld County, Colorado and
being irore particularly described as follows:
Beginning at the Southwest Corner of said Section
3 and considering the West line of said Section 3

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by East Greeley Land Company, be and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973 , as amended, provided that 75 feet
be dedicated north of the highway centerline of Colorado Highway
34 as requested by the Colorado Division of Highways.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of
September, A.D. , 1978.

Dear Commissioners:
The attached application , plat and related items are in reference
to a request by the East Greeley Land Company and Mr. Tom Scheirman
for a recorded exemption. The parcel of land on which this request
has been made is described as Pt . SW/ Section 3 , T5N, R66W of the
6th P.M. Weld County, Colorado. This property is located 1 mile
west of the City of Greeley at the northeast corner of the inter-
section of 59th Avenue and Colorado Highway 34. This property is
also known as the Mosier Farm. The property contains 169. 644
acres of Class III and IV irrigated soils. The request is to
split the property into parcels of 6. 449 acres and 163 . 195 acres.
East Greeley Land Company has transferred the 6.449 acre parcel
to Mr. Scheirman. It is the applicant ' s feeling that the 6 acre
parcel is an excellent site for the possibility of commercial or
light industrial development with the balance of the property
having the potential for residential development . This property
is located in the City of Greeley' s Comprehensive Planning area.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1 . The proposed split conforms with the Recorded Exemption intent
clause and the Weld County Comprehensive Plan. The request is
consistent with the City of Greeley' s Comprehensive Plan which
identifies the property as future commercial and residential
land uses. The proposed uses of the property would be com-
patible with surrounding land uses.
2. The City of Greeley Planning Commission has set forth no
objections to this request .

3. The request complies with the provisions of Section 9-4 A.
of the Weld County Subdivision Regulations.
The Department of Planning Services Staff further recommends
that the recorded exemption plat be amended to reflect a 75 foot
reservation or dedication north of the highway centerline of
Colorado Highway 34 as requested by the Colorado Division of
Highways in its letter dated August 23 , 1978.

Gentlemen:
We are requesting a recorded exemption in order to break off
approximately seven (7) acres from the Mosier Farm owned by
East Greeley Land Company.
It is our feeling that the parcel in question is an excellent
site to be developed commercially and light industrial and the
remainder of the property will be used in the future for
residential development.
The aforementioned property is located within the Greeley
Comprehensive Plan.

Dear Mr. Cunliffe:
We have reviewed the application from East Greeley Land Company for a recorded
exemption, and we ask for your consideration of the following comments.
1 . Traffic projections for this portion of State Highway 34 indicate the need
for 150 feet of right of way, 75 feet each side of the highway centerline.
We ask that 75 feet be protected on the north side of the highway centerline
by setback, reservation, or dedication (preferably the latter) as local zoning
laws and regulations permit.
2. We feel that access to Lot A should be obtained from 59th Avenue rather than
from the highway. To better accommodate vehicles entering 59th Avenue from
the east, we also ask that a deceleration lane be provided. This lane will
allow right-turning vehicles to move out of the through lane and thus avoid
potential rear-end accidents.
This lane would be constructed at the developer's expense and would require
a Driveway Permit. Application for this permit should be made upon final
approval of the site development plan to: Mr. David N. Fraser, District IV
Maintenance Superintendent, P. 0. Box 850, Greeley, Colorado 80632. The
attached sheets provide specifications to which this lane should be built.
Any potential access to Lot B from the highway will be viewed by the Division
as a major access requiring extensive highway improvements such as those being
provided by Webhan Corporation at 50th Avenue and 48th Avenue. It is important
to anticipate at this time how access to this development will be coordinated
with other subdivisions and other access points along the highway.
3. The impact of highway noise on this property should be addressed by the
developer in future site planning. The generally recommended setback for
commercial development is 100-150 feet from the centerline and 150-200 feet
for residential uses. These distances assume no other abatement mead
such as walls, earth berms, or noise-insulated construction. e b21 8r 1'o
