Mary Ann f•cuersiein, Roc^r'or RESOLUTION WHEREAS, a public hearing was held on January 26, 1976, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing a petition of Computerized Farming Services, Inc, , 310 North 8th Avenue, Greeley, Colorado, requesting a change of zone from "A" Agricultural District to "C" Commercial District, Planned Unit Develop- ment, and WHEREAS, the petitioner was present, being represented by Mr. Kent Sanford, District Manager for said petitioner, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of petitioner and studied the recommendations of the Weld County Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Computerized Farming Services, Inc. , 310 North 8th Avenue, Greeley, Colorado, for a change of zone from "A" Agricultural District to "C" Commercial District, Planned Unit Development, said area being more particularly described as follows: All that part of the North Half of the Southwest Quarter (NZSW;) of Section Six (6), Township Four (4) North, Range Sixty-Five (65) West of the 6th P. M. , lying South of the right-of-way of the Union Pacific Railroad (Dent Branch) and West of the State Highway, containing 12 acres more or less, being in the South- west corner of the North Half of the Southwest Quarter (NfSW*-) of Section 6, Township 4 North, Range 65 West of the 6th P. M. , Weld County, Colorado, and is hereby granted under the conditions following: 1 . That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2, All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning regulations of Weld County, Colorado. 3. That said change of zone herein granted is conditional only for a period of twelve (12) months from date hereof, on condition that developer proceed with due diligence to begin development of the area rezoned and submit plans for such development for the approval of the Weld County Plan- ning Commission and subsequent recording of said plans in the office of the County Clerk and Recorder of Weld County, Colorado. f' / t,�( &-c" 760013 ) 4 � _ 2 Dated this 28th day of January, A. We feel it is impractical as well as undesirable to maintain an agricultural zone in this area. Firstly, the soils are not con- ducive to farming; and there is not enough water with the property for farming. 2. The zoning use we are requesting will benefit the county in as much as it is a farm related business which is needed. The loca • tion of this farm related company could locate in several parts of the county; however, this site was chosen because of its close proximity to Highway 85 as well as being a central location of our service area. Also, it was chosen because it ' s a nonproduc- tive, lower priced property. 3. This zone will not necessarily benefit the lands adjoining, but it also should not devalue but enhance the area because of the development cleanup we will be doing. 1+. The property to the north is being zoned by the City of LaSalle quite similarly, however, shall be an I zone. This property meets our needs and as I have mentioned before, is nonproductive to be used in any other fashion. 5. We have served other areas in the county and have been unable to locate property which is already zoned for our use which is priced in a range which we could afford. 6. We can answer this question only by saying again that this property is not conducive to an A zone, and that because of the I zone adjacent on the north, we are not changing the area to any degree. 7. The City of LaSalle has been interested recently in acquiring addi • - • tional commercial and business groups. 8. Based on our knowledge of the area and the proposed land use, we see no geologic reason why this rezoning should not be approved. As the SCS report points out, the soil on this site may be subject to caving when excavations are made. As a geologic report, the J & M Engineering report is not adequate. The geologic conditions of the site are not adequately described nor are the effects of those geologic conditions on the proposed land use. Additionally the report is not signed by a professional geologist, as required by Colorado law. From reading the report, it appears that it was not intended as a geologic report but more as a preliminary engineering report. In this case, we would expect a geologic report to discuss the potential aggregate resources, the groundwater conditions, the foundation conditions, the excavation conditions, and any other pertinent comments relating the geology to the proposed land use. Given the proposed land use and the geologic conditions, in this case it does not appear that further investigation needs to be clone until the actual design of the foundation for the structure.
