RESOLUTION
WHEREAS, a public hearing was held on January 26, 1976, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing a petition of Computerized Farming Services, Inc, ,
310 North 8th Avenue, Greeley, Colorado, requesting a change of zone from
"A" Agricultural District to "C" Commercial District, Planned Unit Develop-
ment, and
WHEREAS, the petitioner was present, being represented by Mr.
Kent Sanford, District Manager for said petitioner, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Computerized Farming Services, Inc. ,
310 North 8th Avenue, Greeley, Colorado, for a change of zone from "A"
Agricultural District to "C" Commercial District, Planned Unit Development,
said area being more particularly described as follows:
All that part of the North Half of the Southwest Quarter (NZSW;)
of Section Six (6), Township Four (4) North, Range Sixty-Five
(65) West of the 6th P. M. , lying South of the right-of-way of
the Union Pacific Railroad (Dent Branch) and West of the State
Highway, containing 12 acres more or less, being in the South-
west corner of the North Half of the Southwest Quarter (NfSW*-)
of Section 6, Township 4 North, Range 65 West of the 6th P. M. ,
Weld County, Colorado, and
is hereby granted under the conditions following:
1 . That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2, All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning regulations
of Weld County, Colorado.
3. That said change of zone herein granted is conditional only for a
period of twelve (12) months from date hereof, on condition that developer
proceed with due diligence to begin development of the area rezoned and
submit plans for such development for the approval of the Weld County Plan-
ning Commission and subsequent recording of said plans in the office of the
County Clerk and Recorder of Weld County, Colorado.

This agreement, made and entered into this day of 19 ' b

and between Computerized Farming Services, Inc. , in the State of Colorado,
and the Town of LaSalle, a Municipal Corporation, in the State of Colorado.
WITNESSETH:
WHEREAS: Computerized Farming Services , Inc. is the owner of a 11 . 95
acre tract of land located close to the sourthern boundary of the Town of
LaSalle, said tract of land being more specifically described as follows:
All that part of the North Half of the Southwest Quarter
(N'SW'a) of Section Six (6) , Township Four (4) North, Range
Sixty-five (65) West of the -6th P.M. , lying South of the
Right-of-way of the Union Pacific Railroad (Dent Branch)
and Nest of the State Highway, being more particularly de-
scribed as follows :
Commencing at the SW Corner of said Section 6 and consider-
ing the West line of Section 6 to bear North 00°00' 00" East
and all other bearings contained herein relative thereto:
Thence North 00°00' East along the West line of said Section

Thence continuing North along the West line of said Section
6 a distance of 695.86 feet to a point on the Southerly Right-
of-way of the U.P.R.R. Dent Branch;

WHEREAS: Computerized Farming Services, Inc. has requested the Weld County
Planning Commission _and the Board of County Commissioners -of Weld County. to
rezone the 11 .95 acres from Agricultural to Commercial Unit Development.
Now THEREFORE, Computerized Farming Services, Inc. is willing to abide by
the following Agreement to be followed after the Petition of Rezoning is
acted upon favorably by the Planning Commission and Board of County Commis-
sioners of Weld County, said agreement as follows.
A. Computerized Farming Services, Inc. agrees not to object to
annexation by the Town of LaSalle at any time the Town of
LaSalle desires annexation.
B. Computerized Farming Services, Inc. will install its own
completely enclosed sanitary sewer disposal system.
C. Computerized Farming Services, Inc. will use water available
from a pump located on the property for its source of domes-
tic water.
D. Computerized Farming Services, Inc. agrees to terminate the use
of on-site water and sewer and connect to the Town of LaSalle
water and sanitary sewer system 90 days after such services
are available and to pay all proportional costs.
E. Computerized Farming Services, Inc. agrees that at such time as
the Town of LaSalle annexes Computerized Farming Services , Inc.
will deed to the Town of LaSalle approximately .95 acres of land
along the westerly property line, in the form of a 60' wide North
and South strip for the construction of a future road.
F. Computerized Farming Services, Inc. agrees to, at such time as
the Town of LaSalle annexes, comply with all restrictions and
conditions of annexation.
G. Computerized Farming Services,• Inc. agrees that before the sale of
the property described above or any portion thereof is deeded, the
perspective purchaser will agree to all terms and conditions of this
Agreement and so state in writing.

permission to expand to an additional 10,000 square feet if it becomes
necessary. The office area will be used strictly for a company personnel
center. Along the South and East side of the new structure we will be
providing approximately 10 to 15 parking spaces for parking personnel
vehicles and company owned trucks.
The State Division of Water Resources have informed us that the .cell
presently on the property may be used for domestic-commercial type uses
only without the requirement of any permits. Their definition of
domestic type uses would be for the use of restrooms, kitchen faciiities ,
dtc. This would mean that no more than 15 gallons per minute could be

Time schedule for completion of the development is six months from the
time zoning has been approved. As you will notice in our development
criteria we plan to keep all open areas either in a native grass .:Jr farm
:rops• We want to assure you that this open area will be maintained and
kept free of weeds or other debris that might normally collect in this area.
We feel the zoning we are applying for will be compatible with the surrounding
area. To the South and West is agricultural ground and to the North is a
proposed new industrial area which at this time is under cultivation and
to the last is U. S. Highway 85 and rail service. We have chosen this
particular area becuase it is a central location of our service area and
also because it does provide highway access. We find the access to the
highway quite adequate for our purposes because only our company personnel

will be using said access. In planning, we understand that there is
a proposed North-South road which will run adjacent to our westerly
boundaries which we shall use for highway access in lieu of the present
state highway service mad.

The particular soil in this parcel is not conducive to fdrmi;c;. The
rail and highway adjacent on two sides , and proposed on a third, makes
residential zoning undesirable. For these reasons we feel this
commercial unit development would be quite compatible with the
surroundings. •

I . We feel it is impractical as well as undesirable to maintain an
agricultural zone in this area. Firstly, the soils are not con-
ducive to farming; and there is not enough water with the property
for farming.
2. The zoning use we are requesting will benefit the county in as
much as it is a farm related business which is needed. The loca
•
tion of this farm related company could locate in several parts
of the county; however, this site was chosen because of its close
proximity to Highway 85 as well as being a central location of
our service area. Also, it was chosen because it ' s a nonproduc-
tive, lower priced property.
3. This zone will not necessarily benefit the lands adjoining, but
it also should not devalue but enhance the area because of the
development cleanup we will be doing.
1+. The property to the north is being zoned by the City of LaSalle
quite similarly, however, shall be an I zone. This property
meets our needs and as I have mentioned before, is nonproductive
to be used in any other fashion.
5. We have served other areas in the county and have been unable to
locate property which is already zoned for our use which is priced
in a range which we could afford.
6. We can answer this question only by saying again that this property
is not conducive to an A zone, and that because of the I zone adjacent
on the north, we are not changing the area to any degree.
7. The City of LaSalle has been interested recently in acquiring addi •

tional commercial and business groups.
8. Computerized Farming Services , Inc. is the only business at this
time which will be located on the property. At the time zoning is
approved, we will occupy a building which is presently under construc-
tion, and this building will satisfy any needs for expansion for quite
some time.

Dear Mr. Honn:
This is to acknowledge receipt of material pertaining to the above
referenced rezoning application. The water for the office and warehouse
complex is to be provided by an existing unregistered domestic well. In
order to use this well for the exempt commercial classification, an appli-
cation for a well permit for this proposed use should be submitted to the
Ground Water Section of this office. If the proposed use is within the
definition of the law for exempt commercial use, the permit will be issued.

Dear Mr. Honn: RE: COMPUTERIZED FARMING SERVICES/REZONING
We have reviewed the request for rezoning from Computerized Farming Services
and the supporting information by J & M Engineering. Based on our knowledge
of the area and the proposed land use, we see no geologic reason why this
rezoning should not be approved. As the SCS report points out, the soil on
this site may be subject to caving when excavations are made.
As a geologic report, the J & M Engineering report is not adequate. The
geologic conditions of the site are not adequately described nor are the
effects of those geologic conditions on the proposed land use. Additionally
the report is not signed by a professional geologist, as required by
Colorado law. From reading the report, it appears that it was not intended
as a geologic report but more as a preliminary engineering report. In this
case, we would expect a geologic report to discuss the potential aggregate
resources, the groundwater conditions, the foundation conditions, the excavation
conditions, and any other pertinent comments relating the geology to the
proposed land use. Given the proposed land use and the geologic conditions, in
this case it does not appear that further investigation needs to be clone until
the actual design of the foundation for the structure. High groundwater conditions
will undoubtedly be a factor.

Air Pollution Evaluation
If Computerized Farming Services Inc. uses the proposed structure
as stated for strictly warehousing of bagged chemicals, no air
pollution control regulations are applicable. However, if chemicals
are to be formulated and bagging operations are to commence on this
site, appropriate applications for the evaluation and installation
of control devices must be made to the Weld County Health Department.
Also, a planning meeting prior to actual submissions of applications
is requested. In addition, any boiler installed for space heating
is exempt under air pollution regulations. If used for reasons other
than space heating, application would have to be made as noted above.
