RE: APPROVAL OF RECORDED EXEMPTION NO. 381 - ELVIRA IHNEN, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on December 11, 1978 , the Board of County Commis-
sioners of Weld County, Colorado approved as request by Elvira
Ihnen, et al. , for a lot size variance in order that said Elvira
Ihnen, et al. , could apply for a Recorded Exemption, and
WHEREAS, on January 22, 1979 , the Board of County Commis-
sioners denied the request of said applicants for a Recorded
Exemption, and
WHEREAS , on February 5, 1979 , the Board of County Commis-
sioners, after discussion, determined that said Board should
re-hear the request of Elvira Ihnen, et al. , for a Recorded
Exemption after proper notification of said hearing had been
given concerning said re-hearing, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 28th day of February, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 381, being the property of
Elvira Ihnen, et al. , described as part of the Northwest Quarter
of Section 6 , Township 4 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its

authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Elvira Ihnen, et al, be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended.
BE IT FURTHER RESOLVED by said Board that said approval is
contingent upon said applicant providing an additional 30 feet
of right-of-way on the South side of the centerline of Highway 60
by reservation or dedication as requested by the Colorado Division
of Highways.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
February, A.D. , 1979.

RE: Recorded Exemption #381
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a recorded exemption by Mrs. Elvira Ihnen, et al. The property is
described as Pt . NWl Section 6, T4N, R68W of the 6th P.M. , Weld County,
Colorado. This property is located at the southeast corner of the inter-
section of Weld County Road 1 and Colorado Highway 60. The property
contains approximately 70 acres of Class I and II irrigated soils. The
request is to split the property into parcels of 2. 5 and 67. 5 acres.
On December 11 , 1978, the Board of County Commissioners approved a re-
quest by Mrs. Elvira Ihnen for a lot size variance so that she could
make application for this recorded exemption. At the time they made
the decision on that request , the Department of Planning Services Staff
submitted a letter of recommendation for denial to the Board. A copy
of the letter for denial is included in the attached packet . Nothing
has been received by our office that would change our recommendation of
denial for this request as outlined in the letter to the Board of County
Commissioners dated December 11, 1978.
However, if the Board approves this request , it should be pointed out
that the Colorado Division of Highways has requested the applicant to
provide an additional 30 feet of right-of-way on the south side of the
centerline of Highway 60 by reservation or dedication as local regula-

We are requesting this exemption because we would like to sell a small parcel of the
south end of our property. We were severely limited on crop income last year because
of two hailstorms and, also, we received heavy damage to our home and farm buildings
from hail and flooding. The sale of this parcel would help us through this hard time.
We, also, feel the division, as shown on the attached survey, will actually improve
our farm because it will eliminate short rows for the farmer who leases our land.
This corner we are asking to have exempted has long been a headache to us and now to
our renter.

Dear Commissioners:
The attached letter and related materials are in reference to a re-
quest for a lot size variance from Mrs. Elvira Ihnen, etal. The pro-
perty on which this request has been made is described as Pt . NW} ,
Section 6, T4N, R68W of the 6th P. M. , Weld County, Colorado. This
property is located at the southeast corner ofthe intersection of
Weld County Road 1 and Colorado Highway 60. The property contains
approximately 72 -acres of Class I and II irrigated soils. The re-
quest is to obtain a variance from the minimum lot size requirement,
Section 9-4 A. (6) , so that shemay make application to apply for a
recorded exemption.
If this lot size variance is granted, Mrs. Ihnen will proceed with
her application to divide :the property into two parcels. Mrs. Ihnen
wishes to sell approximately 2-1/2 acres more or less, which includes
no improvements . The balance of the property will be retained by Mrs.
Ihnen. She has indicated in an letter dated November 3, 1978, that
the reason for wanting to sell a small part of her property is for
economical reasons. The applicants where severly limited on crop in-
come this year due to two hail storms and hail and water damage to
the existing house and other existing farm buildings.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be denied for the following reasons:

1. The proposed request does not comply with the Weld County Compre-
hensive Plan because it would promote non-agricultural use of
agricultural land and it would encourage urban encroachment on
rural land use.
2. This request is not in conformance with the intent clause of the
Agricultural Zone District (Section 3. 3 A of the Weld County Zoning
Resolution) which states:
"Intent - The intent in establishing the A-Agricultural
Zone District is to allow all agricultural and related
uses in those areas in which agriculture is and should
continue to be the predominant land use. This district
is intended to discourage encroachment of imcompatible
uses upon the agricultural land in the district, to
encourage agricultural uses as the highest and best use
of the land in the district as compared with other uses. ..
in conflict therewith, and to provide for the orderly
expansion of urban growth in conformance with the Weld
County Comprehensive Plan"
The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be promoting the division
of prime agricultural land into smaller, less economic parcel sizes.
3. This request is not- in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) . Said clause states :
"The intent in establishing the Recorded Exemption pro-
cedure is to provide, in accordance with the Weld County
Comprehensive Plan, a means whereby non-productive agri-
cultural lands may be developed for higher or more pro-
ductive uses, in-so-far as such uses are compatible with
surrounding agricultural uses in areas where such land
divisions are proposes. (Rev. 4/17/74)"
The parcel contains only one set of improvements and is considered
to be prime agricultural land. The split would allow an extra set
of improvements to be built on the 72 acre parcel and therefore,
create an urban encroachment which would be noncompatible with the
Agricultural District .

4 . The minimum lot size in the irrigated Agricultural District is 80
acres. The intent is to maintain large enough tracts for farm
purposes and to assist in the encouragement of agricultural uses
as the highest and best use of the land. This request is in vio-
lation of that intent. It is the opinion of the Department of
Planning Services Staff that the County should not encourage
further division of this property but work towards preserving the
best use of the land, which is agriculture and agricultural
related uses.
The Department of Planning Services Staff concurs that a financial hard-
ship does exist , however, it is unproven that the granting of this re-
ques ill relieve the present financial burdens.

COMMENTS:
The existing improvements are located in the northwest corner
of this property. The improvements .include a . residence -and
several out buildings . Accesses to the property are existing .
The majority of the property has been in agricultural production
(corn ) . The south boundary line of this property is a ditch .
The proposed request is to split approximately 2i acres off the
southwest corner of this property . Natural drainage to the
property appears to be to the north on the northern 3/4 of the
property and the southern part of the property drains to the
south into the ditch . The property to the south across the
ditch contains at least three residences .

Dear Mr. Cunliffe:
We have reviewed the application from Mrs. Elvira Ihnen, et al . ,
for a lot size variance. Our records show that the existing right
of way on State Highway 60 is 60 feet, 30 feet each side of the center-
line. To meet projected needs, a total of 120 feet will be needed,
and we ask that half of this need be protected on the south side of
the highway centerline by reservation, setback, or dedication (preferably
the latter) as local zoning laws and regulations permit.
