The maximum number of employees expected on site will be 3. Work shifts shall be from 7am to 5pm, Monday through Friday, May ft through October 31s` c. The operation is not expected to encounter groundwater and shall be considered a dry pit. d. The facility access shall be located off of a two-track ranch road, running along County Road 99,just north of County Road 112. Haul routes are expected to utilize County Road 112 westerly to County Road 390.There are no bridges along this route. e. The size of area to be worked at any time is approximately 6 to 7 acres per season, May through October, with the pit expected to be operational for about 7 to 8 years. f. Only one mining area will be worked at a time. In the beginning of the season, the topsoil will be removed and stockpiled for replacement during the reclamation phase. Dozers and excavators will first remove overburden and stockpile nearby, then begin excavating suitable material. Off-highway dump trucks will transport the material to the processing unit where it will be crushed, screened and sorted into various stockpiles. Excavation, hauling and processing will occur throughout the entire season. g. The estimated thickness of the suitable aggregate material is 1 to 25 feet, located beneath a very thin to no topsoil layer, including topsoil and loess. h. After mining operations are complete, the land will be regraded, using spoil material leftover from the processing operation and overburden soil. Topography will be smoothed to resemble a 'natural' pre-mining condition.Topsoil that was scraped from the site will be replaced and a native seed mix spread to stabilize the soil. Once the soils and slopes have been stabilized and a healthy vegetative cover has grown, the site is expected to be used once again as pasture for grazing cattle. i. Explain how this proposal is consistent with the intent of the Weld County Comprehensive Plan. This proposal is consistent with the following goals and policies in the Weld County Comprehensive Plan: . G. A.Goal 7. County land use regulations should protect the individual property owner's right to request a land use change. . A.Policy 7.1. County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable. . A.Policy 2.2. Allow commercial and industrial uses, which are directly related to or dependent upon agriculture, to locate within agricultural areas when the impact to surrounding properties is minimal or mitigated and where adequate services and infrastructure are currently available or reasonably obtainable. These commercial and industrial uses should be encouraged to locate in areas that minimize the removal of agricultural land from production. The proposed aggregate mining facility will provide a valuable service to Weld County, for replenishment of road fill material, as well as to ranchers and to oil and gas companies for road and pad construction.This pit is located in an area where the farmer's gravel recourses have been virtually exhausted.This new source will reduce truck traffic on Weld County Roads. 3. Explain how this proposal is consistent with the intent of the district (zone) in which the use is located. The intent of the ! (!gricultural) Zone District is "to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land uses [andVto provide areas for the conduct of uses by Special Review which have been determined to be more intense or to have a potentially greater impact than uses !flowed by Right." The proposed use is consistent with agriculture in that the land area will be restored to grazing. 4. Explain what efforts have been made to conserve productive agricultural land in this district. Dietzler has livestock watering lines to remote corners of the land he acquired and has improved fences and carrels. He also took 960 acres that he bought out at Conservation Reserve Program and fenced of so it could be grazed for agricultural production. 5. Explain that there is adequate provision for the protection of health,safety and welfare of the inhabitants of the neighborhood and the County. There are no nearby residents. Dust will be controlled with water owned by Dietzler. 12 PATRICK Dietzler Water Resources I Use by Special Review Questionnaire Explain how the proposed use is consistent and compatible with surrounding land uses. The proposed use is consistent and compatible with the surrounding land uses, which are primarily agricultural in nature. The applicant currently utilizes his property for ranching operations. Existing oil and gas facilities are also characteristic of the surrounding area. In addition, future oil and gas production sites which have been identified in the surrounding area will have the ability to benefit from the new source of aggregate, reducing travel impacts on the County Road system. 6. Describe the existing land use. The existing land is used as pasture for grazing cattle. 7. Describe, in detail,the following: a. Number of people who will use this site The estimated number of people to use the site is based on anticipated production rates as well as on-site employees. The crusher will likely average 150-200 tons per hour and the production is estimated at: . 150 tons/hour X 9.5 hours/day X 20 days/month X 4 months X 88%efficiency= 100,320 tons/year This works out to a daily crusher production of approximately 1250 tons/day. Daily haul volume from the quarry is variable, as demand is driven by weather and market conditions. If the fall season is dry, road management agencies and private customers may continue to purchase aggregate for construction activities. Assuming that the total annual production will be delivered over an eight month period, the annual daily truck traffic is calculated as follows: . 100,000/(8 mo. X 21 days/mo.) = 595 tons/day removed from quarry. Most aggregate will be hauled with belly dump trucks. The average belly dump has a capacity of 22 tons. Truck volume calculations are as follows: . 595 tons x 1 load/22 tons = 20 loads/day or approx. 2 loads/hr. The following vehicles will access the site: Daily: . Who will provide fire protection to the site The Pawnee Fire Protection District serves this property. f. Water source on the property(both domestic and irrigation) Since the mining operation is seasonal and the duration of operation is less than 10 years, there isn't sufficient need to install a well or provide a permanent water source. A water sprayer truck will be on site to provide dust abatement, filled at the groundwater loadout facility just north of the site. Potable, bottled water will be provided by the operator for pit employees and shall be located in the temporary office trailer. There is no need for irrigation, even during reclamation seeding activities, as it was suggested by the Weld County Seed Specialist that irrigating native seed mix may actually prevent substantial growth. g. Sewage disposal system on the property(existing and proposed) Portable toilets will be located on-site during seasonal mining operations.Toilet holding tanks will be pumped weekly or as needed, and their contents will be fully disposed of at proper municipal treatment facility(s). h. If storage or warehousing is proposed,what type of items will be stored A diesel fuel storage tank of less than 660 gallons will be provided on site for refueling of on-site haul trucks, excavation and processing equipment. The tank will be enclosed in a secondary containment system. Other petroleum products used on machinery and equipment will be stored in the temporary office trailer or a separate temporary weather- proof construction trailer. 14 PATRICK Dietzler Water Resources I Use by Special Review Questionnaire i. Explain where storage and/or stockpile of wastes will occur on the site Waste material if any, produced after the aggregate processing stage will initially be stockpiled at the processing site, then transported back up to the pit and stockpiled for later use in reclamation activities. All stockpiles shall be protected from erosion by enclosing in silt fence or using a gravel berm at the toe. j. Explain the proposed landscaping/screening for the site. There is no landscaping or screening proposed for the site. k. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. The access drive, processing site and haul roads will be constructed in the first month of construction. Construction is anticipated to begin in June as soon as the permit is granted. I. Explain any proposed reclamation procedures when termination of the USR activity occurs. Please refer to Item 1.h. above. m. Explain how the storm water drainage will be handled on site. No runoff is expected as the site consists of pervious soils (standard gravel). Storm drainage will be collected from the aggregate processing site and haul road and will be directed to a water quality swale, 150 feet long by 2 feet wide to allow for sedimentation and settling. Water will evaporate or position overtop the swale via a broad-crested weir and continue to flow northward as sheet flow, maintaining the existing drainage pattern. Refer to the attached Water Quality Memo for more details. n. Method and time schedule of removal or disposal of debris,junk and other wastes associated with the proposed use. Portable toilets will be emptied weekly, or as needed. A covered dumpster for household- type trash will be emptied monthly, or as needed. o. Provide a statement delineating the need for the proposed use. Originally, Weld County Public Works Department approached the landowner suggesting that aggregate material be mined from the land, thus indicating there is a need for fill material nearby. Also, the increasing permitting and construction of oil and gas facilities in the vicinity suggests that the need for imported aggregate material may be increasing as well. 8. Provide a statement which explains the Use by Special Review area is not located in a flood plain,geologic hazard and Weld County Airport overlay district area.The application complies with Chapter 23,Article V, Overlay District Regulations as outlined in the Weld County Code.
