Dear Mr. Conway:
We have received your letter dated July 2nd. Our system represents
several water rights that will be affected by use of wells in Weld County
without replacement water to offset the depletion caused. We hope this
letter addresses questions posed by your Commission.
Your letter stated the hope of having senior water rights
subordinate to the use of water in Weld County. This will not be fair to any
water rights below the point of diversion you propose. All water rights
below the point of diversion, both senior rights and junior rights will suffer if
water is removed by the wells without a full replacement supply to offset
the use. Our system is one of the last on the South Platte, therefore will
suffer the most from this proposed taking of water, as the hole in the
aquifer is passed down river.
This domino affect will make water short to all ditch rights to
finish this crop season, as well as slow the reservoir fills this fall. Since the
reservoirs will take longer to fill, this withdrawal will ultimately affect our
own decreed augmentation plans with water shortages to replace the
legal diversions we will have from our own well pumping.
Our producers are already experiencing a shortage of water to
irrigate their crops, we have just enough to provide a limited amount to
our farms, and we cannot and will not stand by and watch a diversion of
any water without full replacement to offset the depletion. We will not be
a party to any taking of water by your producers or any others. Not only
our producers will be damaged, but the State of Nebraska will likely weigh
in on this use, as it will be a clear violation of the Interstate Compact with
them.

We would hope you would see the potential affect upon us,and
every other water right below the proposed point off diversion and please
stop asking tor the permission for this taking of these rights.Let the priority
system that is already on place in Colorado serve the water rights.
