RE: APPROVE VACATION OF CONDITIONAL USE PERMIT #45 - MICHAEL
HERGENREDER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 30, 1979, the Board approved Conditional Use
Permit #45, and later reconsidered the matter and affirmed their approval decision on May 21,
1979, for Radio Transmission Towers for W.R.E.N. Broadcasting Company on the following
described real estate, to-wit:
The SE1/4 of Section 18, Township 7 North,
Range 67 West of the 6th P.M., Weld County,
Colorado; being more particularly described as
follows:
Considering the south line of said southeast quarter
as bearing south 86°47'57" west and with all
bearings contained herein relative thereto is
contained within the boundary lines which begin at
the southeast corner of said Section 18, and run
thence south 86°47'57" west 2,411.60 feet to the
south quarter corner of said Section 18; thence
north 00°10'12" east 2,635.02 feet to the center
quarter corner of said Section 18; thence north
86°42'28" east 2,421.72 feet to the east quarter
corner of said Section 18; thence south 00°23'12"
west 2,639.48 feet to the point of beginning, and
WHEREAS, the Board has received a request from the current property owner, Michael
Hergenreder, 6691 County Road 80, Fort Collins, Colorado 80524-9021, to vacate said
Conditional Use Permit#45, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Conditional Use Permit#45 be, and hereby is, vacated.

WREN Broadcasting

CUP-45 was initially approved by the Board of County Commissioners in April 1979 and
reconsidered for approval in May 1979. Attached are the Resolutions and selected documents
for the case.
The W.R.E.N. Broadcasting Company, Inc. conveyed to Wilbur Miller and Marietta Miller on
December 2, 1983 and recorded on January 26, 1984 a Deed for the SE4 of Section 18,
Township 7 North, Range 67 West of the 6t" P.M., all lands associated with CUP-45. [Book
1019, Reception Number 01954169]
The current property owner, Michael Hergenreder, is requesting vacation of CUP-45 for WREN
Broadcasting as the radio broadcasting and transmission towers, associated support structures
and equipment are no longer present on site
Mr. Hergenreder's letter of February 10, 2012 is attached.
The Department of Planning Services is in support of this request as visual inspection of the
property determined there are no broadcast structures located on premises.

Re: Michael Hergenreder Property Conditional Request for Vacation of CUP-45
Mr. Ogle:
I, Michael Hergenreder, owner of the property located in the SE4 of Section 18,
Township 7 North Range 67 West of the 6th P.M., Weld County, specifically parcel
numbers 0705-18-4-00-060, 0705-18-4-00-059, 0705-18-4-00-045. I would like to
request vacation of the currently existing Conditional Use Permit No.45 (CUP). The CUP
was originally granted to W.R.E.N. Broadcasting and recorded as an encumbrance on my
property. I wish to vacate CUP 45 on behalf of W.R.E.N. Broadcasting, or KIIX, as
approved by the Board, thereby vacating the CUP form the records.
