HomeMy WebLinkAbout20123171.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 7, 2012 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 7, 2012, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther Gesick Director of Finance and Administration, Monica Mika El MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners meeting of November 5, 2012, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. READ ORDINANCE BY TAPE: Commissioner Garcia moved to read Code Ordinance #2012-12 by tape. Commissioner Rademacher seconded the motion, which carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Rademacher moved to approve the November 5, 2012, Board of Health: Finding of Fact for Abatement of Nuisance Condition on Property for which M. Shapiro Development Company is the Appointed Receiver; and Show Cause Hearing conducted on November 5, 2012: 1) PCSC-0001, re: USR #1431 - Marlin Ness. Commissioner Kirkmeyer seconded the motion, which carried unanimously. IR AMENDMENTS TO AGENDA: Monica Mika, Director of Finance and Administration, proposed to add item #12 under Bids. Commissioner Rademacher moved to approve the addition. Commissioner Garcia seconded the motion, which carried unanimously. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. Commissioner Rademacher reported he sat on an Oil and Gas Industry panel to discuss fracking and they received a lot of public input. BIDS: Fl 1) APPROVE BID #61200140, MOTORGRADER - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Barbara Connolly, Controller, reviewed staff's recommendation to approve the second low bid from Colorado Machinery, which meets specifications. David Bauer, Director, Department of Public Works, provided a brief explanation of the selection and responded to questions from the Board. Commissioner Rademacher moved to approve the second low bid, as recommended by staff. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. El 2) APPROVE BID #81200141, TANDEM AXLE TANK TRAILER WITH DUST PALLATIVE SPRAY SYSTEM - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Ms. Connolly reviewed staff's recommendation to approve the low bid from Transwest Trailers. Mr. Bauer reviewed the equipment specifications. Commissioner Long moved to approve the low bid, as recommended by staff. Commissioner Kirkmeyer seconded the motion, which carried unanimously. ID 3) APPROVE BID #61200142, TANDEM AXLE TANK TRAILER WITH WATER SPRAY SYSTEM - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Ms. Connolly reviewed staff's recommendation to approve the low bid from Transwest Trailers. Mr. Bauer reviewed the equipment specifications. Commissioner Rademacher moved to approve the low bid, as recommended by staff. Seconded by Commissioner Garcia, the motion carried unanimously. ID 4) APPROVE BID #B1200143, QUAD AXLE TANK TRAILER WITH DUST PALLATIVE SPRAY SYSTEM - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Ms. Connolly reviewed staff's recommendation to approve the low bid from Transwest Trailers. Mr. Bauer reviewed the equipment specifications. Commissioner Rademacher moved to approve the low bid, as recommended by staff. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. In 5) APPROVE BID #81200144, 3 AXLE TRUCK TRACTOR (450HP) - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Ms. Connolly reviewed staffs recommendation to approve the low bid from Transwest Trailers. Mr. Bauer reviewed the equipment specifications. Commissioner Kirkmeyer moved to approve the low bid, as recommended by staff. The motion, which was seconded by Commissioner Rademacher, carried unanimously. ID 6) APPROVE #B1200145, 3 AXLE TRUCK TRACTOR (500HP) - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Ms. Connolly reviewed staffs recommendation to approve the low bid from Transwest Trailers. Mr. Bauer reviewed the equipment specifications. Commissioner Kirkmeyer moved to approve the low bid, as recommended by staff. Commissioner Long seconded the motion, which carried unanimously. EI 7) APPROVE BID #61200146, 3/4 TON 4X4 FULL SIZE PICKUP, LONG BED, EXTENDED CAB - DEPARTMENT OF PUBLIC WORKS/GRADER DIVISION: Ms. Connolly reviewed staff's recommendation to approve the second bid from Weld County Garage. Mr. Bauer reviewed the equipment specifications. Commissioner Rademacher moved to approve the second low bid, as recommended by staff. Mr. Bauer reviewed the equipment specifications. Commissioner Garcia moved to approve the low bid, as recommended by staff. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. F 9) APPROVE BID #61200148, TRACTOR LOADER WITH BOX BLADE - DEPARTMENT OF PUBLIC WORKS/PAVEMENT MANAGEMENT DIVISION: Ms. Connolly reviewed staff's recommendation to approve the low bid from B&G Equipment, Inc. Mr. Bauer reviewed the equipment specifications. Commissioner Kirkmeyer moved to approve the low bid, as recommended by staff. Commissioner Rademacher seconded the motion, and it carried unanimously. F 10) APPROVE BID #61200149, 1 TON CREW CAB 4X4 FULL SIZE PICKUP WITH UTILITY BOX AND SNOW PLOW - DEPARTMENT OF PUBLIC WORKS/PAVEMENT MANAGEMENT DIVISION: Ms. Connolly reviewed staff's recommendation to approve the low bid from Weld County Garage. Mr. Bauer reviewed the equipment specifications. Commissioner Kirkmeyer moved to approve the low bid, as recommended by staff. The motion, which was seconded by Commissioner Garcia, carried unanimously. IR 11) APPROVE BID #61200150, BANKING SERVICES - TREASURER'S OFFICE: Ms. Mika recommended this matter be continued for one week. Commissioner Rademacher moved to continue the matter to Wednesday, November 14, 2012, to allow for additional review. Commissioner Long seconded the motion, which carried unanimously. F 12) APPROVE BID #B1200131 INMATE MEDICAL SERVICES FOR JAIL - SHERIFF'S OFFICE/JAIL: Ms. Mika stated the current vendor will no longer be providing services and she referenced the attachments for discussion. Sterling Geesaman, Sheriff's Office, confirmed the proposed vendor is available to assume responsibility earlier than anticipated. Commissioner Rademacher moved to approve the sole bid from Correct Care Solutions on an emergency basis. Commissioner Kirkmeyer seconded the motion. Commissioner Long commented regarding the need for improved medical services at the jail. There being no further discussion, the motion carried unanimously. OLD BUSINESS: F 1) CONSIDER COURT SECURITY GRANT CONTRACT AND AUTHORIZE THE CHAIR TO SIGN ELECTRONICALLY - COLORADO SECURITY COMMISSION, C/O COLORADO COURT ADMINISTRATOR'S OFFICE (CON'T FROM 11/05/2012): Commissioner Garcia commented upon the prioritized list. Toby Taylor, Director, Department of Buildings and Grounds, addressed questions from the Board regarding the need for the equipment, its intended use in the Courts Plaza West, the process for establishing the prioritized list, and the subsequent granting of funds for designated uses. Ms. Mika confirmed the need to specifically apply for the control board next year. Commissioner Garcia commented the grant funding for the control panel has been rejected for the past several years and it is unclear as to why. Commissioner Garcia moved to approve the contract and authorized the Clerk to the Board to electronically submit approval on behalf of the Chair. Commissioner Rademacher seconded the motion, which carried unanimously. Minutes, November 7, 2012 2012-3171 Page 3 BC0016 NEW BUSINESS: El 1) CONSIDER TEMPORARY CLOSURE OF F STREET BETWEEN 35TH AND 59TH AVENUES: Janet Carter, Department of Public Works, reviewed the provisions of the closure and addressed questions from the Board regarding the timing of other closures in relation to this project. Commissioner Rademacher moved to approve said temporary closure. Commissioner Kirkmeyer seconded the motion, which carried unanimously. 2) FIRST READING OF CODE ORDINANCE #2012-12, IN THE MATTER OF REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE: Brad Yatabe, Assistant County Attorney, reviewed the proposed Code revision for the record, which is in response to a recent MS4 audit conducted by the State. He stated it also addresses the issue of enforcement, exemptions, inspections for compliance, and the notification process. No public testimony was offered concerning this matter. Mr. Bauer confirmed there was a preliminary work session; however, a review of the language would be appropriate. Commissioner Kirkmeyer moved to approve Code Ordinance #2012-12 on first reading. Seconded by Commissioner Rademacher, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance#2012-12 was approved on first reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
