BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MAY 7, 2012
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, May 7, 2012, at the hour of 9:00 a.m.
ID ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Sean P. Conway, Chair
Commissioner William F. Garcia, Pro-Tem
Commissioner Barbara Kirkmeyer
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:
County Attorney, Bruce T. Barker

Director of Finance and Administration, Monica Mika
In MINUTES: Commissioner Long moved to approve the minutes of the Board of County
Commissioners meeting of May 2, 2012, as printed. Commissioner Kirkmeyer seconded the motion,
and it carried unanimously.
e CERTIFICATION OF HEARINGS: Commissioner Garcia moved to approve the Certification of
Hearings conducted on May 2, 2012, as follows: 1) Show Cause Hearing, PCSC-0001, re: USR#1431
— Marlin Ness. Commissioner Rademacher seconded the motion, which carried unanimously.
e AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: No public input was given.
▪ CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as
printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
BIDS:
IR PRESENT BID #81200075, CRACKFILLER MATERIAL - DEPARTMENT OF PUBLIC WORKS:
Monica Mika, Director, Department of Finance and Administration, stated this is for a three-year bid,
and staff will make a recommendation on May 21, 2012.
▪ PRESENT BID #B1200083, SURFACE GRAVEL SUPPLY - DEPARTMENT OF PUBLIC
WORKS: Ms. Mika stated this is for a one-year bid and staff will make a recommendation on May 21,

2012. Commissioner Rademacher commented it is unusual to only have one local vendor with all of
the gravel pits in Weld County.
NEW BUSINESS:
• CONSIDER CHILD PROTECTION AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO
SIGN - LEAHY NEUROFEEDBACK CENTER, LLC: Judy Griego, Director, Department of Human
Services, reviewed the terms of the agreement. Commissioner Rademacher moved to approve said
agreement and authorize the Chair to sign. The motion was seconded by Commissioner Garcia, and it
carried unanimously.
CONSIDER PURCHASE OF SERVICES AGREEMENT AND AUTHORIZE CHAIR TO SIGN -
NORTHEAST HEALTH DEPARTMENT: Tanya Geiser, Department of Public Health and Environment,
reviewed the terms of the agreement. Commissioner Long moved to approve said agreement and
authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried
unanimously.
IR CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - OIRE COLORADO C,
LLC, C/O MARVIN F. POER AND COMPANY: Christopher Woodruff, Assessor, reviewed the petition
request and staff recommendation. Neither the petitioner, nor a representative, was present to speak
to the matter. Commissioner Garcia moved to approve the petition, as recommended by staff.
Commissioner Rademacher seconded the motion, which carried unanimously.
• CONSIDER NONEXCLUSIVE LICENSE AGREEMENT CONCERNING INSTALLATION OF
IRRIGATION LINE BENEATH CR 37 AND AUTHORIZE CHAIR TO SIGN - CITY OF THORNTON:
Janet Carter, Department of Public Works, reviewed the terms of the agreement. Commissioner
Rademacher moved to approve said agreement and authorize the Chair to sign. Commissioner
Kirkmeyer seconded the motion, which carried unanimously.
El CONSIDER NONEXCLUSIVE LICENSE AGREEMENT CONCERNING INSTALLATION OF
ELECTRICAL CONDUIT BENEATH CR 43 AND AUTHORIZE CHAIR TO SIGN — PERRY
WIEDEMAN: Ms. Carter reviewed the terms of the agreement. Commissioner Garcia moved to
approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner
Kirkmeyer, and it carried unanimously.
El CONSIDER NONEXCLUSIVE LICENSE AGREEMENT CONCERNING INSTALLATION OF
CULVERT BENEATH CR 68 AND AUTHORIZE CHAIR TO SIGN - WELLS RANCH: Ms. Carter
reviewed the terms of the agreement and noted the installation will eliminate 23,250 truck trips from
CR 68, and she also introduced Amy Burry, Right-of-Way Agent, and commended her for all of her hard
work. Commissioner Rademacher moved to approve said agreement and authorize the Chair to sign.
The motion, which was seconded by Commissioner Long, carried unanimously.
e CONSIDER RENEWAL APPLICATION FOR RETAIL LIQUOR STORE LICENSE AND
AUTHORIZE CHAIR TO SIGN — DOROTHY M. ZITEK, DBA HEREFORD PACKAGE LIQUOR: Brad
Yatabe, Assistant County Attorney, indicated he reviewed the application and found the materials to be
in order, and the standard referral agencies indicated no concerns with the renewal. Commissioner
Long moved to approve said application and authorize the Chair to sign. Seconded by Commissioner
Garcia, the motion carried unanimously.
ID CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO
SIGN - CHRISTOPHER JEWKES: Commissioner Rademacher moved to approve the appointment of

Christopher Jewkes as Deputy District Attorney and authorize the Chair to sign. Commissioner
Kirkmeyer seconded the motion, which carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:21 a.m.
