E . , Public Works Department SUBJECT: USR12-0038, Wells Ranch A Use by Special Review permit for an oil and gas roustabout business. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard , Weld County Code, Chapter 23, Article II , Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 64 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23- 1 -90) , the required setback is measured from the future right-of-way line. The access is from unmaintained CR 64 section line right-of-way. The applicant states that the access is from where CR 64 is a private roadway, this is incorrect. It is beyond the County maintenance but the access is still onto County Right-of-Way. The roadway vacation resolution (rec # 3441938) states that CR 64 was vacated from CR 631/2 eastwards and the access is west of CR 631/2. The applicant will need to show and label the County Road Right-of-Way along the CR 64 section line and enter into a Nonexclusive License Agreement with the County. The Nonexclusive License Agreement states that the applicant is aware that the County will not maintain or upgrade the right-of-way and that their use of the right-of-way is not exclusive. Tracking control is required to prevent tracking from the site onto the County Roadway. Standard tracking control for accesses onto gravel roads includes double cattle guards at the access point. An improvements and road maintenance agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. Much of the heavy truck traffic will travel into Wells Ranch on privately maintained roadways but the traffic memo projects up to 501 vehicle trips per day on CR 64 and CR 61 . A haul route will be determined and maintenance on the haul route will be required . Dust control and damage repair will be required on the haul route. The County's standard triggers for paving and turn lanes will also be included. A Drainage Letter was included with the application and discussed the water quality design. The letter references attached drainage calculations which do not appear to have been included . Please provide the drainage calculations for the water quality feature and swale for review. REQUIREMENTS: 1 . Add the following conditions of approval to the plat: a. Show and label the 30 feet of unmaintained CR 64 section line right-of-way. b. A Nonexclusive License Agreement is required for use of the unmaintained County Right- of-Way along the CR 64 section line. c. An Improvements and Road Maintenance agreement is required. Access improvements shall include double cattle guards. A haul route will be determined and maintenance on the haul route will be required. Add the following development standards to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. Weld County is not responsible for the maintenance of drainage related features. The facility will utilize the existing shop building for office, mechanical repairs and vehicle/equipment storage . Outside storage for vehicles and equipment is also provided . There will be 6 full-time employees on site for office and repair shop operations , and 99 truck drivers and roustabout employees who will access the property. There is a proposed recorded exemption associated with this proposal (RECX12-0066). Water for the business will come from 4 existing water wells located on adjacent property owned by Wells Ranch . These water wells feed into a holding tank for a cattle operation (Permit Nos. 26343 for domestic purposes , 13565 for domestic purposes, 248266 for watering of livestock, and 248282 for watering of livestock) . Since these wells are proposed to be used for the commercial business operations , including employee drinking and sanitary purposes , the wells must be appropriately permitted through the Colorado Division of Water Resources . A shared well agreement is also be required and is a condition of approval of RECX12-0066 . The applicant is proposing to install an engineered septic system for the office/shop building . The applicant will be required to apply for a septic permit and the permit will need Weld County Board of Health approval . A Class V Injection Well Permit from the Environmental Protection Agency (EPA) will also be required for the large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day) . The proposed septic system area shall be designated on the plat. No vehicle access drives , vehicle parking or equipment storage shall be located in the area of the septic system . The septic system must be protected from vehicle traffic. There is an existing fueling island on the property. No information was provided in the application on the types of fuels and capacity of the fuel tanks . Depending on the capacity of the fuel tanks , a Spill Prevention , Control and Countermeasure Plan may be required and the tanks may require registration with the Colorado Department of Labor and Employment, Oil Inspection Section . The applicant submitted a dust abatement plan which states that access drives will be covered in gravel and water truck will be utilized to control dust. The applicant will need to submit a revised dust abatement plan to include the proposed water source. A waste handling plan will be required and shall include the names , addresses and phone numbers of the waste haulers and disposal or recycling sites. It shall include the quantities and types of wastes generated from vehicle and equipment repairs performed in the shop building , including waste oils , antifreeze , scrap parts , tires, batteries etc. Any floor drains in the shop must discharge to a watertight vault and contents removed for proper off-site disposal . We have no objections to the proposal ; however, we do recommend that the following conditions be pad of any approval : We recommend that the following requirements be met prior to allowing the plat to be recorded : 1 . The applicant shall revise the dust abatement plan indicating the proposed water source for mitigating dust, for submittal to the Environmental Health Services , Weld County Department of Public Health & Environment. 2 . In the event washing of vehicles and equipment will occur on site the applicant shall ensure that any vehicle and equipment washing area(s ) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission , and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 3 . An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations . 4 . The applicant shall designate the location of the proposed septic system on the plat. No vehicle access drives , vehicle parking or equipment storage shall be located in the area of the septic system . The septic system must be protected from vehicle traffic. 5 . The applicant shall submit evidence of an Underground Injection Control (UIC ) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 7 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 6 . In accordance with the Underground and Above Ground Storage Tank Regulations (7 CCR 1101 - 14) a spillage retention berm shall be constructed around the aboveground fuel tanks . The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm . Alternative protective measures may be allowed provided they comply with the Above Ground Storage Tank Regulations . 7 . The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL& E) , Oil Inspection Section for any aboveground storage tanks located on the site . Alternately, the applicant can provide evidence from the (CDL& E), Oil Inspection Section that they are not subject to these requirements. 8 . A signed copy of the Spill Prevention , Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. In accordance with Section 3-6- 1 of the Colorado Department of Labor and Employment Division of Oil and Public Safety Storage Tank Regulations (7 C . C . R. 1101 - 14) as well as EPA regulations (40 CFR Part 112 ). 9 . The applicant shall submit written evidence from the Colorado Division of Water Resources , demonstrating that the well(s ) are/is appropriately permitted for the commercial use . 10. The applicant shall submit documentation of a shared well agreement as required in Environmental Health Services' referral dated July 5, 2012 for RECX12-0066. 11 . In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003- 1 ). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 12. The applicant shall submit documentation that floor drain wastes from any vehicle maintenance facility is captured in a watertight vault and hauled off for proper disposal , or is approved by the sewer district to discharge to the municipal sewer. 13. The applicant shall submit a waste handling plan , for approval , to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum , the following : 1 ) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated ). 2) A list of the type and volume of chemicals expected to be stored on site . 3) The waste handler and facility where the waste will be disposed (including the facility name, address , and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100. 5, C . R.S . , as amended ) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination . 2 . No permanent disposal of wastes shall be permitted at this site . This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100 .5 , C . R.S . , as amended . 3. Waste materials shall be handled , stored , and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan " , at all times . 5. The applicant shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 6. Any vehicle and equipment washing area (s ) shall capture all effluent and prevent discharges from the washing of vehicles and equipment in accordance with the Rules and Regulations of the Water Quality Control Commission , and the Environmental Protection Agency. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan" , at all times . 8. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 9. Adequate drinking , hand washing and toilet facilities shall be provided for 4 employees and patrons of the facility, at all times . 10 . Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems . 11 . In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003- 1 ) . Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations . 12 . All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface , and in accordance with manufacturer's recommendations. 13 . Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal . Records of installation , maintenance, and proper disposal shall be retained . 14 . The Spill Prevention , Control and Countermeasure Plan shall be available on site , at all times . 15 . The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code . Additionally, please note the following : 1 . This application is proposing a well(s ) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses , i .e. domestic use only, etc. Also , the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. Water Division 1, Water District 1 Dear Mr. Gathman: The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The Applicant is seeking a site specific development plan and use by special review permit for a 22.60-acre parcel. Three businesses (All Around Roustabout, LLC, All Around Trucking, LLC, and Reliable Field Services, Inc.) will operate a general roustabout service business supporting oil and gas production on site. The site includes an office building with restrooms and a concrete wash bay that is proposed to be used for washing of rigs and tanks. The site is proposed to be served by an existing water well system, consisting of four wells which pool water to a holding tank. The four existing wells are identified and described as follows: • Permit no. 26343, issued on February 4, 1966 for domestic purposes. • Permit no. 136565, issued on August 16, 1984 as the only well on a parcel of 40 acres described as the NW 1/4 NW 1/4 Sec. 29, T6N, R63W, 6th P.M. Permitted for ordinary household purposes inside one single family dwelling, the irrigation of up to one acre of home gardens and lawns, and the watering of domestic animals. • Permit no. 248266-A, issued on March 6, 2003 as a replacement for a late-registered well. Permitted for the withdrawal of up to 3 acre-feet per year for the watering of livestock (feedlot comprised of 500 head or less) on a farm or ranch. • Permit no. 248282-A, issued on March 7, 2003 as a replacement for a late-registered well. Permitted for the withdrawal of up to 3 acre-feet per year for the watering of livestock (feedlot comprised of 500 head or less) on a farm or ranch. None of these wells are permitted for commercial or industrial use. The Applicant must obtain new permits for the wells prior to the use of the wells for any commercial or industrial purpose. Depending on the proposed use, a substitute water supply plan or decreed plan for augmentation may be required prior to the issuance of new permits for these wells. This complaint was initiated due to the operation of an oil&gas roustabout operation without first obtaining the necessary Weld County Zoning Permits. This case has not yet proceeded to our County Court phase. Since this case has not progressed to the Violation status, no investigation fee is required. This complaint was from a private citizen. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied, all commercial vehicles, employee parking, material storage and operations shall be removed from the property. Additionally, if denied by the Board of County Commissioners please request this violation case be referred to the County Attorney's Office with a delay of legal action for the 30 (thirty) days mentioned above.
