This includes Fair Market Values, and Utility, Drainage and Ditch Agreements. This authority is not to be further delegated. The RTD and South PE retain the authority to determine if any action for which authority is delegated,requires them to act personally and to obtain records for review and subsequent actions deemed necessary and appropriate. Harris, Chief Engineer of the Colorado Department of Transportation (CDOT), hereby state the following: 1. Pursuant to CRS §43-I-111 and CRS 43-1-114(3)which confer duties to the Chief Engineer to enter into contracts or agreements to acquire or convey real or personal property interests on behalf of the Colorado Department of Transportation, I hereby delegate this authority to the Regional Transportation Directors, who may choose to subsequently delegate this power to their respective Region Right of Way Manager. 2. Further, delegation of authority to approve any and all legal and administrative settlements may be delegated by the Regional Transportation Directors to Region staff at a rank no lower than their respective Region Right of Way Manager up to $150,000 over Fair Market Value (FMV). For any settlements that are over$150,000 and up to $500,000 over FMV, the RTD's written approval would be necessary and written notification(but not a requirement for approval) would be sent to the Chief Engineer. For any administrative or legal settlements over $500,000 over FMV, written approval of both the RTD and the Chief Engineer is required. 3. The Colorado Department of Transportation regularly enters into contracts and agreements for the acquisition of property interests to facilitate construction of transportation improvements. Such contracts and agreements entered into by the Colorado Department of Transportation are subject to terms and conditions of the Uniform Relocation Assistance and Real Property Acquisition For Federally-Assisted Programs(Uniform Act), Code of Federal Regulations, Colorado State law and CDOT Right of Way Manual(§4.7.8). 4. The facts and circumstances surrounding the valuation and acquisition of real and personal property interests are best known to the various Regional Transportation Directors and their respective Right of Way Managers. 5. It is in the best interests of the Colorado Department of Transportation to delegate signature authority to enter into contracts or agreements to acquire or convey real or personal property interests on behalf of the Colorado Department of Transportation to the various Regional Transportation Directors. 6. If a question does not pertain to your use, please respond with "not applicable", with an explanation as to why the question is not applicable. 1. Explain, in detail, the proposed use of the property. Expansion of existing shooting range for Colorado Stale Patrol to include a 30 loot berm on the south side and a 90% berm enclosure. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. l his proposal is for a shooting range that does not hays anything to do kith agriculture use of the property. This shooting range w ill oak be accessible by Colorado State Patrol Troopers and utilized by lacy enforcement personnel only. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. C. Recreational Iacilitics and (1SES including: 4. Shooting ranges, subject to the provisions of Section 23--I-370. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). All trash \\ill he placed in a dumpster located 200 feet west of the shooting range and picked up hy Waste Management when full. CDOT LEAD MITIGATION Colorado Department of Transportation is concerned about the stewardship of the environment and has taken the EPA's Best Management Practices for lead into account throughout the designing and operation of the shooting range. The EPA states that there are several range characteristics that lead to water contamination or prevention. Colorado Department of Transportation intrinsically prevents lead propagation in the following ways: 1. The soil characteristic of Colorado Department of Transportation is a fine sandy loam, which is a soil that allows good lead reclamation. Underneath the top soil is bentonite clay which bonds with free lead ions and prevents further migration. 2. The annual precipitation at Colorado Department of Transportation is around 12 inches per year which nearly classifies the area as a desert (10 inches per year). Low precipitation provides little means for lead migration. 3. Colorado Department of Transportation will HydroSeed the berms so that the range is covered by grass which absorbs rainwater reducing the time that lead is in contact with rainwater. The vegetation also slows and prevents runoff. The previous factors are a huge part of Colorado Department of Transportation' lead management. The intrinsic properties of the range leave the lead basically inert. Colorado Department of Transportation uses the following techniques to make the removal and recycling of lead possible: 1. Colorado Department of Transportation contains the lead into as small of an area as possible by overlapping shortfall zones and using backstops. This allows the removal of the lead to be less difficult. 2. If any lead is to be stored at Colorado Department of Transportation after reclamation, it will be stored in sealed steel containers. Dust Abatement Plan All accesses are covered with recycled asphalt, including the range floor. Colorado Department of Transportation has access to many water trucks and can utilize many dust suppression methods for high traffic or dry days. Dear Commissioner Kirkmeyer, This letter serves us an uflieial«yucst from the Colorado Department ransportation (COOT)to Weld County,asking that Weld County waive the S2,500 tikditgfet^associated with the proposed MOT survey shooting range to be located on SI 1263,in the interest of intergovernmenwl cooperation. COOT has agreed to provide traffic control for Weld County projects at 7 different locations, which are listed on the enclosed spreadsheet. Since CDOT is a fellow governmental agency and not a for-pm fit company,it has the unique ability to perform these traffic control operations in a more cost-efficient manner than what Weld County could contract them out to a third-party private company. CDOT will pafonn the 7 traffic control operations on behalf of Weld County at an estimated cost to CDOT of$5.120. This amount will come out of CDOT's budget. Had Weld County contracted with a private traffic control firm for the work,it is estimated to have cost the County 57,000 based on bids from two prominent local traffic control companies. Based on the savings to the County and impact on CDOT's operating budget,consideration is requested of Weld County to waive the$2,500 building fix,es a fair return gesture of intergovernmental cooperation. Shooting ranges shall, when possible, be located to take advantage of natural terrain barriers. The entire range (including danger area if range is not of the "Safety Range" type) shall be fenced and warning signs posted every two hundred (200) feet. How is this being addressed? Line of fire shall be as nearly horizontal as is practicable and never below horizontal. Ranges may be constructed so that the firing point is below the target, provided that the gradient between the firing point and target does not exceed two percent (2%). How is this being addressed? The perimeter of the range shall be landscaped to provide natural noise barriers. The remainder of the range shall be planted and maintained with grass or other suitable ground cover. How is this being addressed? In addition to firing lines or fields, adequate space for danger areas, parking, equipment, storage building, clubhouse and latrines shall be provided. How is this being addressed? Please note if the application is approved the applicant will need to adhere to the following; therefore please address how these will be incorporated into the application: Provisions for pistol, small-bore and high caliber rifle ranges: 1. "Safety Range" requirement. If the range is constructed in an urbanized area, when area is developed, or when natural terrain does not offer adequate protection, overhead safety baffles may be required. 2. Firing points shall be four (4) to five (5) feet apart for shooting distances up to two hundred (200) yards. 3. Rifle or pistol ranges shall not be permitted without bullet stops. Natural or artificial bullet stops shall be provided. a Natural bullet stops. Only slopes of hills shall be used for natural bullet stops. The crest of the hill used for a bullet stop shall be at least thirty (30) feet above the level of the firing point for a one- hundred-yard range. An additional ten (10) feet of hill shall be provided for each additional one hundred (100) yards of range. The slope of the hill shall not be less than two (2) to one (1). A vertical cut shall be taken out of the face of the hillside used for a backstop to provide a nearly perpendicular face to catch bullets and prevent ricochets. b. Artificial bullet stops. For up to a three-hundred-yard range, an earth embankment at least twenty- five (25) feet in height, well sodded to retain a slope of thirty-five (35) degrees from perpendicular and topped by an earth-filled timber barricade at least fifteen (15) feet high, shall be provided. Stones shall be removed from the face of the embankment to a depth of eighteen (18) inches. For each additional one hundred (100) yards of range, ten (10) feet in overall height of the bullet stop shall be added. The bullet stop shall extend approximately one hundred sixty (160) feet beyond the ends of the target. 5. The questionnaire needs to go into further detail regarding the CDOT activities on site and please clarify the number of employees employed on site are they for the shooting range or CDOT. The range point of fire is horizontal with a 30 foot berm. A discharge would have to be greater than 10% gradient to leave the range area. The perimeter of the . . . The range is located in a wooded area, enclosed in a dirt berm that will be hydro seeded to provide a grass cover. In addition to . . . There is minimal storage and parking of vehicles is 15-20 yards behind the firing line. There is no equipment or clubhouses on sight. The latrines are located 600 feet outside of berm and behind the firing line. The questionnaire needs . . . As per the questionnaire, regarding CDOT activities on site and are as follows: o There are 8 full time CDOT employees who are not allowed to use the range at any time. The range is only used by State Troopers. The Troopers have their own Range Commander. CDOT is only the property owner. The CDOT lead worker is notified when the Troopers are utilizing the facility. CDOT employees are authorized to ask for credentials of anyone present at the range at any time. Hello
