RESOLUTION
WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land, being the
property of Marylynn Inc. , (Mike Lehan, President), Weld County, Colorado,
and more particularly described as follows:
Replat of Lots 2 and 3, Block 10, Highland Hills, a subdivision
of a part of the Southeast Quarter (SE+) of Section 15, Township
5 North, Range 66 West of the 6th P. M. , Weld County, Colorado,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in 1973 C. R. S. 30-28-101 (10) (d), as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado has studied the request of the petitioner and studied
the recommendations of the Weld County Planning Commission, and having
been fully informed, now desires to exempt this particular division of land
pursuant to its authority under 1973 C. R. S. 30-28-101 (10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Marylynn Inc. , (Mike Lehan, President),
Weld County, Colorado, be exempted from the definition of the terms "sub-
division" and "subdivided land" as provided for in the new Weld County
Subdivision Regulations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 26thday of April, A.D. , 1976.

BEFORE THE WELD COUNTY PLANNING COMMISSION
RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by John Weigand that the following resolution be intro-
duced for passage by the Weld County Planning Commission:
Be it therefore resolved by the Weld County Planning Commission
that the following be recommended to the Board of County Commissioners:
the request of Marlynn, Inc. (Mike Lehan, President) for a replat of
Lots 2 and 3, Block 10 of Highland Hills Subdivision to maintain set-
back requirements be approved for the following reasons: 1 ) The re-
platted lots do not conflict with the Weld County Zoning Resolution re-
quirements for minimum lot area or lot width; 2) no new lots are being
created; only one lot line is being changed; 3) drainage easements
or rights-of-way reserved for drainage are not being changed; 4) street
locations and street rights-of-way are not being changed; 5) this replat
will not adversely affect the character of the plat filed and recorded;
and 6) letters from all the pertinent utility companies have been sub-
mitted and none of them have any objection to this request.

Dear Mr. Dickson:
The purpose of this letter is to verify that we did receive you letter
dated March 18, 1976 in which you stated a replat of Lots 2 and 3, Block
10 of Highland Hills Subdivision would be completed prior to April 2,
1976. It is correct that construction on the residence being built on
Lot 2 can continue with the provision that our office receives the replat
by April 2, 1976. As part of the replat, our office needs a letter
submitted from each of the utility companies (water, sewer, telephone,
electric, and gas) associated with that develpment stating whether or
not they have any conflicts with changing the lot line between Lot 2 and
Lot 3.

Dear Ken :
In reference to our telephone conversation this date this
letter is to formally advised you that as attorney for the Weld
County Lumber Company my clients are prepared to take the following
action as regard Lots 2 and 3 , Block 10, Highland Hills, a subdivision
of a part of the Southeast Quarter (SW*) of Section 15, Township 5
North, Range 66 West of the 6th P.M. , Weld County, Colorado.
The facts which gave rise to the present problem is as follows :
A foundation for a home on Lot 2 was laid by my clients at a point some
7i feet from the boundary line between Lots 2 and 3 . The home was
placed in this position due to the fact that high ground on the left
of Lot 2 in Lot 1 indicated that there could be a drainage problem off
of Lot 1 and onto Lot 2. To minimize the drainage problem the founda-
tion on the home on Lot 2 was placed at the position previously described.
At the time the foundation was laid, my clients, the contractors and
the owners of both Lots 2 and 3 were unaware of the counties side lot
set-off minimum requirement of ten feet in the Highland Hills Subdivision.
While we recognize this is our mistake we have asked you to
consent to trying to help us work out our problem. Pursuant to our
telephone conversation today I have been advised that we will need to
refile the plat for our two properties so as to provide the mandatory
twenty feet between the homes located on Lots 2 and 3. This is to
advise you that such action will be taken and that I did today direct
Jaspar Freese, our surveyor who prepared the original plat and legal
description to prepare a new plat ceding a portion of Lot 3 to Lot 2
so as to provide for the mandatory side yard set-off . This action will
be completed prior to April 2 of this year. It is my understanding
that by virtue of this letter my clients will be allowed to continue
construction on the home being built on Lot 2 .

Regulations an the Uniform Budding Code governing location.construction and erection of the hereinabove proposed structure for which the permit
is granted. Violation of any of the rules or regulations applicable may result in the revocation of this permit. The Building Inspector or his agents Cr.
