Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Don Carroll Health Department representative, Mary Evett The following business was transacted: El I hereby certify that pursuant to a notice dated November 27, 2012, and duly published November 30, 2012, in the Greeley Tribune, a public hearing was conducted to consider the request of Leonard and Tammy Ball, c/o Noble Energy, Inc., c/o Wattenberg Holding, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0056, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (crude oil truck unloading and oil polishing facility, compressor facility, central processing facility, tank and pipeline storage, and future water recycling facility) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. le Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He referred to a Partial Assignment of Surface Lease, marked Exhibit D, which addresses Condition of Approval #1.J. He also discussed a letter of concern received from a surrounding property owner, reviewed the referral responses, and displayed an aerial map and photographs of the site and surrounding area, which he reviewed for the record. e Don Carroll, Department of Public Works, provided a brief overview of the phased access, road right-of-way, internal circulation, transportation plans, stormwater drainage provisions, and permitting and improvements requirements. PL2191 HEARING CERTIFICATION - LEONARD AND TAMMIE BALL, C/O NOBLE ENERGY, INC. /WATTENBERG HOLDING, LLC (USR12-0056) PAGE 2 El Mary Evett, Department of Public Health and Environment, reviewed the water and sewer provisions (commercial well and septic system), and the requirement of a Dust Abatement Plan, Waste Handling Plan, Spill Prevention Control and Countermeasure Plan, and APEN. She also noted that Condition of Approval #1.F has been met. e Julie Cozad, Tetra Tech, represented the applicant and introduced various representatives and consultants for the joint venture. She displayed a PowerPoint presentation, marked Exhibit E, which she reviewed for the record. She requested moving Conditions of Approval #1.C and #1.D to become new Conditions of Approval #7.6 and #7.C, to be completed "Prior to the issuance of the Certificate of Occupancy", rather than "Prior to recording the plat." Ms. Evett suggested the more appropriate location should be under Condition of Approval #6 to be completed "Prior to Construction." e Lance King, SemGroup/Wattenberg Holding, LLC, clarified the APEN application was submitted in July, 2012; therefore, Condition of Approval #1.C has been met. Ms. Cozad stated a Grading Permit has been issued and the applicant intends to commence with construction soon, and although they have submitted the ap lication, it does take considerable time to receive permit approval back from State. IN Greg Pickerel, Noble Energy, explained the timing of the project should be tied to the steel foundation of the tank. Commissioner Kirkmeyer proposed leaving Condition of Approval #1.C where it is, since it only requires evidence of submittal, not approval. Ms. Cozad also requested Condition of Approval #1.E be moved to#7.C No public testimony was offered concerning this matter. In response to Chair Conway, Ms. Cozad stated she and the applicant have no further requests. In response to Commissioner Rademacher, Ms. Cozad stated the applicant(s) are in agreement with the number of employees identified in Development Standard #3. The Board also agreed to modify Development Standard #26 to change the word "will" to "may", and refine the applicant name from "SemGroup" to reflect "Wattenberg Holding, LLC" throughout the Resolution. In response to Chair Conway, Ms. Cozad stated she and the applicants have reviewed, and agree to abide b , the Conditions of Approval and Development Standards, as proposed and modified. I PA Chair Conway reviewed the changes for the record. El Commissioner Garcia moved to approve the request of Leonard and Tammy Ball, c/o Noble Energy, Inc., c/o Wattenberg Holding, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0056, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (crude oil truck unloading and oil polishing facility, compressor facility, central processing facility, tank and pipeline storage, and future water recycling facility) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included revising the applicant name throughout to reflect "Wattenberg Holding, LLC", moving Conditions of Approval #1.D and #1.E to become new Conditions of Approval #7.6 and #7.C, respectively, and amending Development Standard #26 to change the word "will" to "may". The motion was seconded by Commissioner Rademacher. The Board expressed its support of the project.
