Public Works has been aware of, and dealing with the drainage issues at the intersection of
WCRs 31 and 74 for over a year. Public Works have performed remedial work and met
multiple times with the landowners there. The history here includes disputes over
irrigation/farming practices and some neighbor disagreements over changes to drainage and
groundwater.
The lands north and east of the intersection are irrigated corn fields that release return flow water
to the roadside ditches (see attachment). Those roadside ditches require and have received
annual cleanout of excessive silt eroded from those moderately steep corn fields. There are
deeply buried (8-feet plus) clay seep "tiles" tying to the irrigated fields surrounding the
intersection; these tiles have been leaking for years and possibly were damaged by utility
installation more recently. Repair of these tiles will be difficult due to their depth and high
traffic on WCR 74 (2800+AADT). The County policy has been to only work on seep tiles if in
the ROW. Mr. Maxwell's concern has been silty surface runoff entering broken seep tiles which
flow to a pond on his property. Public Works requested neighbor cooperation for installation of
storm water detention ponds to attempt to collect the excess surface runoff and silt; no
cooperation has been found.
In early 2012, Public Works capped a broken seep tile to prevent entry of storm runoff and we
excavated silt filling the Maxwell pond. Two weeks ago we also cleaned out the intersection
culverts and silt from WCR 74 roadside ditch. Remaining work will be to cap the additional
broken seep tile referenced and photographed in Maxwell's letter, and we will plan to trench and
bury a west-draining storm drain pipe along the north property line of the Maxwell property.
That storm drain pipe will need to cross the neighbor's driveway to Maxwell's west; that project
may be contentious.
A design for the pipe and manholes, utility locates, a seep tile cap, and traffic control on our
busiest road are needed. We will alert the Board as to total cost. Given other current
construction projects, we anticipate not getting back to this project until this Fall —the delay will
likely not be well received by Mr. Maxwell.

Thank you and Brian Garcia for returning my call on 18 July concerning the matters of water at the
intersection of County Roads 74 and 31.The purpose of this letter is to review the matters which we
discussed. I have also spoken again with you on 19 July.
Actually we have been in contact with you over the past couple of years concerning the matters of seep,
runoff and flood waters. We appreciate your efforts to date in rerouting runoff waters from the north
side of Road 74 to the south side and in capping the seep tile on the north side of 74. Removing the silt
from one of our ponds is also appreciated. As you may recall the rerouting of runoff and capping the clay
seep tile on the north side of Road 74 was only a "Temporary fix."
As we have discussed before in some detail there remains serious problems with water at the
intersection. I have attached three sketches for your reference and make the following comments:
1) First I formally request that the county put a T and a riser on the opening of the clay seep
tile on the south side of Road 74. See Attachment 1 and the small circle D with the yellow
center.This T and riser will stop the silt from runoff and flood water from getting into the
seep tile system and ultimately to the ponds which were cleaned this Spring. For some
reason there has become an increase in the amount of"silty" runoff from the fields to the
north east of the intersection and the capacity of the clay tile drain is unable to handle all of
the runoff and the silt is again become partially diverted into our ponds which had been
cleaned. A picture of the clay seep tile opening on the south side of 74 is shown below.
I remember a discussion we had early in 2012 during which time you stated that the county
does not put runoff into clay tiles.The picture shows runoff being put into our clay tiles.
Of course putting a T and riser(the T and riser permits clean out of the clay tiles) on the clay
tile shown in the picture creates another problem.
Where does the runoff and flood water in the ditch on the south side of 74 go?A culvert of
suitable size needs to be installed on the south side of 74 from the point of the T and riser to
take the water on west. A culvert of suitable size needs also to be put in the same area on
the north side of Road 74.

2) Over the years a serious flooding problem (See attachment 2) at the intersection of Roads
74 and 31 has arisen . The relative elevation of the pavement of Road 74 about 600 feet west
of the intersection along with the virtual elimination of bar ditches in the same vicinity has
created a dam for flood water. At the present time there is only a 16" culvert under a
driveway (located about 600 feet west of the intersection) on the north side of 74 and the
16" clay seep tile ( pictured) on the south side of 74 to act a drain for the lake that forms at
the intersection during a heavy rain. I estimate the lake that occurs during flooding at the
intersection to be 5 acres and the water is 3 feet deep in some places. The watershed, the
farm land, to the north east and to the south east of the intersection, causing the flooding is
estimated to be 300 acres.
When the flooding occurs both the 16" culvert as well as the 16" clay tile plug up from
debris washed down from the watershed . Effectively the only exit for much of the flood
water is through the farm to the north west of the intersection. Much erosion and ruination
occurs to the crops planted there. Because of the extremely small size of the drain for this
flooding the standing water causes havoc for the traffic at the intersection for an extended
time. Because of the flooding there are numerous other problems which I can relate.
You have discussed the possibility of a holding pond on the farm to the north east but
considering the amount of water that converges to cause the flooding I cannot believe such
a pond can solve the problem . The water simply has to be directed to the west in an orderly
manner before it accumulates at the intersection . By the way, there is already a holding
pond for runoff on the farm at the south east corner.That holding pond is full much of the
time and it has little or no effect during times of flooding.
Lowering the elevation of Road in the area 600 feet west of the intersection would help but
would not be a complete solution to the problem.
Our intersection, CR 74 and CR 31, has grown to be one of the busiest in Weld County and
the flooding, when it occurs, can be extremely dangerous. During the past 15 years I have
rescued, on two separate occasions ladies from stranded cars in what looked like a
torrential river. Each time they were driving from the west along 74 to come up over the hill,
600 feet west of the intersection, only to meet an unexpected 3 feet torrent of water.
It is my belief that culverts of suitable size should be installed on both sides of Road 74
which would be capable of dissipating westerly(to the Montgomery ditch) the flood waters
in an orderly fashion.The culvert on the south side of Road 74 would allow all runoff and
flood water to be kept out of our seep water tiles. Consequently the ponds which are a vital
part of the water systems(of Eaton Grove Nursery, Lee Maxwell, and Mike Maxwell) would
remain silt free.
3) As we have already discussed there is another problem at the intersection of CR 74 and 31.
The seep tile coming for the Sullivan farm (northeast of the intersection) is broken and has
for years caused problems at the south west part of the intersection, see Attachment 3.
How the tiles became broken is unknown but they seem to be deteriorating with time and
more and more seep water comes to the surface.The tiles could have been broken during
installation of the fiber optic cable or perhaps broken by the continual heavy traffic on Road
74.The clay seep tile goes west from the intersection and is buried under the pavement of
Road 74. It is my belief that the clay tiles should be replaced as indicated on Attachment 3.
If putting a replacement tile under the bar ditch on the south side of 74 is too much of a
problem the tile could be buried along the north side of, and on, our property.
I would be pleased to give a tour of our intersection to any and all concerned individuals.Just give me a
call and a tour will happen. The problems have simply gone on much too long without adequate solution
and the immediate attention of Weld County Public Works is requested.
