HomeMy WebLinkAbout20121117.tiff HEARING CERTIFICATION DOCKET NO. 2012-26 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR11-0012, TO EXTEND THE HEIGHT OF A TELECOMMUNICATION ANTENNA TOWER FROM 65 FEET TO 100 FEET, FUTURE CARRIER EQUIPMENT, AND INCLUDING AN EXISTING FIBER OPTIC SWITCH FACILITY, IN THE A (AGRICULTURAL) ZONE DISTRICT- LEVEL (3) COMMUNICATIONS, LLC IR A public hearing was conducted on April 25, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated March 16, 2012, and duly published March 21, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Level (3) Communications, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0012, to extend the height of a Telecommunication Antenna Tower from 65 feet to 100 feet, future carrier equipment, and including an existing Fiber Optic Switch Facility, in the A (Agricultural) Zone District. a Brad Yatabe, Assistant County Attorney, made this a matter of record. ID Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, gave a brief description of the location of the property, reviewed the surrounding land uses, and stated staff has received no communications from surrounding property owners. He stated eight referral agencies reviewed the proposal, five responded favorably or offered comments which have been incorporated into the Conditions of Approval and Development Standards, and the site is within the three-mile referral area for the Town of Platteville. He reviewed the communications between the applicant and the Town, which addressed their questions, and he entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman displayed an aerial map, indicated the tower location and access, and reviewed photographs of the site and surrounding area. He noted Lauren Light, Department of Public Health and Environment, was unable to attend; however, she indicated no concerns with the application. Pt. PIA) ( C 2012-1117 5 a3 a PL2157 HEARING CERTIFICATION - LEVEL (3) COMMUNICATIONS, LLC (USR11-0012) PAGE 2 In Heidi Hansen, Department of Public Works, stated the site is accessed from County Road (CR) 28, which has an average daily traffic count of 175 vehicles. She stated the applicant will be using an existing access, and staff has no concerns with this proposal. In Jim Loukatos, 5280, a partner company, represented the applicant and stated they plan to extend the height of the tower by 35 feet to allow additional co-location opportunities. Responding to Commissioner Kirkmeyer, Mr. Loukatos confirmed it is a wireless tower, which will not interfere with public safety communications in the area. In No public testimony was offered concerning this matter. Responding to Chair Conway, Mr. Loukatos stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed. Commissioner Garcia moved to approve the request of Level (3) Communications, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0012, to extend the height of a Telecommunication Antenna Tower from 65 feet to 100 feet, future carrier equipment, and including an existing Fiber Optic Switch Facility, in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Rademacher, and it carried unanimously. There being no further discussion, the hearing was completed at 10:21 a.m. This Certification was approved on the 30th day of April, 2012.
