RE: ACTION OF THE BOARD CONCERNING AGREEMENT CONCERNING PURCHASE
AND SALE OF RIGHT-OF-WAY AND DEED OF DEDICATION FOR CERTAIN
IMPROVEMENTS TO COUNTY ROAD 49 - HOSHIKO FARMS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on September 10, 2012, the Board was presented with an Agreement
Concerning the Purchase and Sale of Right-of-Way for Certain Improvements to County
Road 49 and a Deed of Dedication between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Works, and Hoshiko Farms, Inc., P.O. Box 119, Kersey, Colorado 80644, with terms and
conditions being as stated in said agreement and deed, and
WHEREAS, following review, the board deemed it advisable to continue the matter to
September 17, 2012, to allow additional time for staff to refine the terms of the agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement Concerning the Purchase of Right-of-Way for
Certain Improvements to County Road 49 and the Deed of Dedication between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
on behalf of the Department of Public Works, and Hoshiko Farms, Inc., be, and hereby is,
continued to September 17, 2012.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of September, A.D., 2012.
