RE: WELD COUNTY AGREEMENT ON BEHALF OF THE WELD COUNTY
HUMAN RESOUCES DEPARTMENT AND MARIA DE SANTIS.
WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that it would be in the best interest of the
County to enter into an agreement for the use and benefit of the Weld County
Human Resources Department to lease certain premises (being part of a
business building located at 5th and Oak Street), in Frederick, Colorado,
from Maria De Santis, and
WHEREAS, it is the desire of the Board to enter into an agreement
with Maria De Santis to establish the use of certain premises located in a
business building at 5th and Oak Street, Frederick, Colorado, for the use
and benefit of the Weld County Department and Human Resources, on the terms
and conditions as recited in the attached lease agreement.
NOW, THEREFORE, BE IT RESOLVED, that the County of Weld, State
of Colorado, be authorized to enter into an Agreement attached hereto for the
use and benefit of the Weld County Human Resouces Department, all as recited
and set forth in the attached Agreement.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 8th day of October, A. D. ,
1975.

AGREEMENT
THIS AGREEMENT made and entered into this 8th day of October,
1975, between WELD COUNTY, STATE OF COLORADO, by the Weld County
Board of County Commissioners, (hereinafter called County), for the use and
benefit of the Weld County Department of Human Resources, and MARIA
DE SANTIS, c/o Carmen De Santis, Frederick, Colorado.
WITNESSETH:
That for and in consideration of the covenants and agreements herein
agreed to be kept and performed, Maria De Santis hereby leases and agrees
to provide unto County the following described premises, to-wit:
The South part of the business building located
at 5th and Oak Street, Frederick, Colorado.
TO HAVE AND TO HOLD, unto County from the first day of October,
1975, to the :31st day of May, 1976. And County, in consideration of the
leasing of the premises as above set forth, covenants and agrees with Maria
De Santis to pay to said Maria De Santis as rent for the same the sum of One
Thousand One Hundred Twenty Dollars ($1, 120. 00) payable as follows, to-wit:
That the first and last months rent be paid in advance, at the rate of
One Hundred and Forty Dollars ($140. 00) per month for the duration of the
within lease.
That County keeps said lease premises in the same condition as re-
ceived at the beginning of this lease, ordinary wear and tear excepted.
That said County further covenants with Maria De Santis, that at the
expiration of the time mentioned in this lease, peaceable possession of said
premises shell be given to the said Maria De Santis, in as good a condition as
they now are, the usual wear, inevitable accidents, and loss by fire excepted;
and that upon the non-payment of the whole or any portion of said rent at the
time when the same is above promised to be paid, the said Maria De Santis
may, at her election, either distrain for said rent due, or declare this lease at
an end, and recover possession as if the same was held by forcible detainer;
that said County hereby waiving any Notice of such election, or any demand
for the possession of said premises.
IT IS FURTHER COVENANTED AND AGREED between the parties
aforesaid, that this Agreement may be cancelled by one party giving the other
party at least thirty (30) days' written notice of its intention to do so.
The covenants herein shall extend to and be binding upon the heirs,
executors, and administrators and assigns of the parties to this Lease.
IN WITNESS WHEREOF, the parties hereunto have caused this
Agreement to be duly executed in duplicate, as of the day and year first
hereinabove set forth.
