HomeMy WebLinkAbout750202.tiff RESOLUTION WHEREAS, a public hearing was held on January 27, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Howard Haley, Rt. 1, Box 115B, Erie, Colorado, requesting approval of site for a dog kennel operation on the following described property, to-wit: That part of the North one-half of the North one-half of the North one-half (N4N)2-NZ) of Section 13, Town- ship 1 North, Range 68 West of the 6th P. M. , Weld County, Colorado, lying East of the Union Pacific R.O.W., being more particularly described as follows: Beginning at the Northeast corner (NECor) of the Northeast one-quarter (NEI) of said Section 13; thence 589°34'40"W on an assumed bearing along the North line of said North one-half of the North one-half of the North one-half (NI-NM) of Section 13 a distance of 30. 00 feet to the true point of beginning; thence S00°00'00"W along a line parallel to and 30. 00 feet West of the East line of said North one-half of the North one-half of the North one-half (N4N*Nz) of Section 13 a distance of 663. 80 feet to a point on the South line of said North one-half of the North one-half of the North one-half (NzNZN+) of Section 13; thence 589°43'31"W along said South line a distance of 2168. 50 feet to a point on the Easterly R.O.W, line of said Union Pacific Railroad; thence N12°14'55" E along said Easterly R.O.W, line a distance of 674. 63 feet to a point on the North line of said North one-half of the North one-half of the North one-half (NI-N.22-ND of Sec- tion 13; thence N89°34'40"E along said North line a distance of 2025.41 feet to the true point of beginning, containing 32 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of a dog kennell operation, and WHEREAS, the said requested location for a dog kennel operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Howard Haley, Rt. 1, Box 115B, PL0806 750202 Erie, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department, 2. That said dog kennel operation shall not contain more than forty (40) dogs at any one time. 3. That petitioner shall proceed with due diligence to effect said dog kennel operation and that he shall have up to one year from date hereof to begin construction of said dog kennel operation. 4. That an adequate fence be constructed around the perimeter of subject property compound to confine said dogs at all times and not permitted to run at large; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 5. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. SW'.; SW'., Sec. 17 T6N R67W APPEARANCE: Merril Hinkle DISCUSSION: Mr. Hinkle stated that the building which is on this property is being used as an administrative office at the present time. Is requesting a conditional use permit in order to continue using the building for this purpose. Weld County Planning staff recommends approval of this request for the following reasons : (1 ) It complies with the Comprehensive Plan of Weld County inasmuch as the activity will occur in the Windsor Comprehensive Plan area; (2) it complies with the Weld County Zoning Resolution; (3) Windsor recommends approval ; and (4) the County Health Department recommends approval , subject to an agreement being reached with the State Highway Dept. regarding , cess onto Highway 392. Mr. Honn -stated that he has talked with Jack Hale, Superintendent, and was informed that !1r. Hale is in the process of working out an access agreement with the State Highway Department. It was requested by the Planning staff that this agreement be received by the Planning Office prior to this request for conditional use permit being presented to the Board of County Commissioners. There was some confusion as to whether this office is on the city sewer system or if it has a septic tank. It does have a septic tank. RESOLUTION: Be it therefore resolved to recounrierd to the Board of County rs' Commissioners approval of this conditional use permit subject to recommendations by the Planning staff. Motion, by Mr. Anderson, seconded, Marge Yost. A vote of "Aye" by Mr. Nix, Mr. Anderson, Mrs. Yost, Mr. Rothe, and Mr. Elliott. Motion Carried. Henry Johnson is the only neighbor who is located near Mr. Haley, but he has signed the petition to grant this request. The Weld County Planning staff recommends approval for the following reasons : (1 ) Complies with the Weld County Comprehensive Plan in that it does not adversely affect agricultural interests; (2) complies with the Weld County Zoning Resolution; (3) Town of Dacona approves; and (4) County Health Dept. recommends approval . If the site is a part of a larger parcel owned by the appli- cant , the applicant will provide the list with respect to the outer boundary of the larger parcel . This information can be found in the County Assessor' s office . .11 The Special Use Permit application shall be signed by the fee owner( s ) of the parcel of property to be considered for a special use , or by a duly authorized legal agent of said fee owner( s ) . In cases where an individual or group other than the actual fee owner signs the application , a letter granting power of attorney to the agent from the ) ner must be provide~' . The Special Use Permit application shall be notarized . ( 2) No Special Use Permit application shall be assigned a case number of a hearing date set until : (a ) All required items have been completed and submitted to the Planning Department.
