HomeMy WebLinkAbout20123488.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING REVIEW OF DEVELOPMENT STANDARD#25 FOR USE BY SPECIAL REVIEW PERMIT, USR11-0015 - A. C. TRUCKING, LLC, C/O ELISEO ALCANTAR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on December 7, 2011, the Board of County Commissioners approved the application of A. C. Trucking, LLC, 15294 County Road 20, Fort Lupton, Colorado 80621, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0015, for an Oil and Gas Support Facility (water hauling, construction and excavating company) in the A (Agricultural) Zone District, for property which is described as follows: Lot A of Recorded Exemption #2609; being part of the E1/2 NW1/4 of Section 22, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, on December 10, 2012, the Board was presented with a request from Eliseo Alcantar for review of Development Standard#25 for USR11-0015, regarding the extension of his hours of operation to twenty-four(24)hours a day, seven(7)days a week, due to business demand, at which time the matter was continued to December 12, 2012, to allow Mr.Alcantar to be present, and WHEREAS, on December 12, 2012, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services, and, having been fully informed, finds that no further action is necessary and the applicant needs to pursue an amendment to the USR if he desires to change the hours of operation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that no further action is necessary regarding the request of A. C. Trucking, LLC, do Eliseo Alcantar, to modify Development Standard #25, for Use by Special Review Permit, USR11-0015, and that the applicant needs to pursue an amendment to the USR if he desires to change the hours of operation. Mr. Alcantar is requesting reconsideration of these hours due to client requirements to be at the designated well site between 5:45 a.m. to 6:45 a.m., each day. Therefore, Mr. Alcantar is requesting his hours of operation be amended to: "Hours of operation are 24 hours per day, 7 days a week, 365 days a year." Mr. Alcantar states the oilfield industry requires a 24 hour 7 day a week support operation, which they are not meeting. He indicates that if[AC Trucking, LLC] is not able to meet those requirements [AC Trucking, LLC] will lose revenue. This case, USR11-0015 was approved by the Board of County Commissioners on December 7, 2011. The applicant's, Eliseo Alcantar and Jacqueline (Jackie) Crespo have met the requirements specific to addressing the Conditions of Approval, and are currently working with Public Works in finalizing the Improvements Agreement prior to recording the USR plat. AC Trucking LLC is required to be at the well site between 05:45 -06:45 every morning, however due to the current schedule of 06:00AM- 08:00PM, we are unable to meet our client's requirements. Earlier hours of operation would allow AC Trucking LLC to arrive at the shop earlier, do the necessary truck inspections per DOT requirements, and be at client's location in a timely manner. Also longer hours of operation would allow us to do the any truck repairs needed before heading out the next morning. The oilfield industry requires a 24X7 support operations, which we are not meeting. Several of our clients have a 24X7 operation and the business requires us to meet those same requirements.
